RESOLUTION NO. 93 -67 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />NEWPORT BEACH ADOPTING FINDINGS AS A <br />RESPONSIBLE AGENCY REGARDING THE <br />ENVIRONMENTAL EFFECTS IDENTIFIED IN THE FINAL <br />• ENVIRONMENTAL IMPACT REPORT PREPARED BY THE <br />METROPOLITAN WATER DISTRICT AS LEAD AGENCY <br />FOR THE SAN JOAQUIN RESERVOIR IMPROVEMENT <br />PROJECT <br />WHEREAS, a Final Environmental Impact Report (FEIR) was prepared pursuant <br />to the requirements of the California Environmental Quality Act (hereinafter "CEQA" - <br />Public Resources Code Section 21000 et seq.), and the State CEQA Guidelines (California <br />Code of Regulations Section 15000 et seq. - hereinafter "Guidelines ") by the Metropolitan <br />Water District as Lead Agency for the San Joaquin Reservoir Improvement Project to <br />address the environmental effects, mitigation measures, and project alternatives associated <br />with the proposed project; and <br />WHEREAS, the City of Newport Beach, as a Responsible Agency and a co -owner <br />of the reservoir, is required by CEQA to consider the information contained in the Final <br />EIR prepared by the Lead Agency and to balance the benefits of a proposed project against <br />its unavoidable environmental risks in determining whether to approve the components of <br />the proposed project for which the City has jurisdiction; and <br />WHEREAS, Section 21081 of CEQA and Section 15091 of the Guidelines require <br />that a Responsible Agency make one or more of the following findings prior to approval of <br />a project for which an EIR has been completed identifying one or more significant effects <br />of the project, along with statements of facts supporting each finding: <br />FINDING 1- Changes or alterations have been required in, or incorporated into, the <br />project which avoid or substantially lessen the significant environmental effects as <br />identified in the EIR. <br />• FINDING 2 - Such changes or alterations are within the responsibility and <br />jurisdiction of another public agency and not the agency making the finding.
