Planning Commissioners are citizens of Newport Beach who volunteer to serve on the Planning Commission.
They were appointed by the City Council by majority vote for 4-year terms. At the table in front are City staff
members who are here to advise the Commission during the meeting. They are:

NOTICE TO THE PUBLIC
Regular meetings of the Planning Commission are held on the Thursdays preceding second and fourth Tuesdays of
each month at 6:30 p.m. The agendas, minutes, and staff reports are available on the City's web site at:
http://www.newportbeachca.gov and for public inspection in the Community Development Department, Planning
Division located at 100 Civic Center Drive, during normal business hours. If you have any questions or require copies
of any of the staff reports or other documentation, please contact the Community Development Department, Planning
Division staff at(949) 644-3200.
This Commission is subject to the Ralph M. Brown Act. Among other things, the Brown Act requires that the
Commission's agenda be posted at least 72 hours in advance of each meeting and that the public be allowed to
comment on agenda items before the Commission and items not on the agenda but are within the subject matter
jurisdiction of the Commission. The Commission may limit public comments to a reasonable amount of time, generally
three (3) minutes per person. All testimony given before the Planning Commission is recorded.
It is the intention of the City of Newport Beach to comply with the Americans with Disabilities Act (ADA) in all respects.
If, as an attendee or a participant of this meeting, you will need special assistance beyond what is normally provided,
the City of Newport Beach will attempt to accommodate you in every reasonable manner. Please contact Leilani Brown,
City Clerk,at least 72 hours prior to the meeting to inform us of your particular needs and to determine if accommodation
is feasible (949-644-3005 or(brown@newportbeachca.gov).
APPEAL PERIOD: Use Permit, Variance, Site Plan Review, and Modification Permit applications do not become
effective until 14 days following the date of approval, during which time an appeal may be filed with the City Clerk in
accordance with the provisions of the Newport Beach Municipal Code. Tentative Tract Map, Tentative Parcel Map, Lot
Merger, and Lot Line Adjustment applications do not become effective until 10 days following the date of approval,
during which time an appeal may be filed with the City Clerk in accordance with the provisions of the Newport Beach
Municipal Code. General Plan and Zoning Amendments are automatically forwarded to the City Council for final action.

ITEM NO. 2 1706 PARK AVENUE SETBACK DETERMINATION (PA2016-197)
Site Location: 1706 Park Avenue
Summary:
A request for an alternative front setback due to the existing orientation of the lot and development
limitations created by the required front setback. The proposal is to reduce the front setback abutting
Park Avenue from 20 feet to 10 feet. The applicant would maintain the required 3-foot side setbacks
and the 5-foot rear alley setback.
Recommended Action:
1. Conduct a public hearing;
2. Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to
Section 15305,of the California Environmental Quality Act(CEQA)Guidelines-Class 5(Minor
Alterations in Land Use Limitations), which consists of minor alterations in land use limitations
in areas with an average slope of less than 20 percent, which do not result in any changes in
land use or density, including but not limited to: minor lot line adjustments, side yard, and
setback variances not resulting in the creation of any new parcel; and
3. Adopt Resolution No. approving Staff Approval for an Alternative Setback Determination
No. SA2016-018 that would establish a 10-foot front setback.

ITEM NO. 3 VUE NEWPORT RESTAURANTS AND PARKING MANAGEMENT PLAN (PA2016-157)
Site Location: 2300 Newport Boulevard, McFadden Square Area, Balboa Peninsula
Summary:
Two Conditional Use Permits to allow a 5,204 square-foot,fine-dining restaurant with Alcoholic Beverage
Control (ABC) License Type 47 (On-Sale General- Eating Place) and a 2,142 square-foot casual-dining
restaurant with ABC License Type 41 (On-Sale Beer and Wine-Eating Place)at the VUE Newport mixed-
use development currently under construction. No live entertainment, dancing or acoustic music is
proposed with either restaurant.The hours of operation forthe restaurants will be 6:00 a.m.to 10:00 p.m.,
Monday through Wednesday and 6:00 a.m.to 11:00 p.m.,Thursday through Sunday. Each restaurant will
have a small outdoor dining area that will not exceed 25 percent of the interior dining area. The
applications also include a parking reduction and a parking management plan pursuant to Newport Beach
Municipal Code Section 20.40.110.
Recommended Action:
1. Conduct a public hearing;
2. Find each project to be exempt from the California Environmental Quality Act(CEQA)pursuant
to Section 15301 under Class 1 (Existing Facilities)of the CEQA Guidelines, California Code
of Regulations, Title 14, Chapter 3, because they have no potential to have a significant effect
on the environment;
3. Adopt Resolution No. -_ approving Conditional Use Permit No. UP2016-048 for the
proposed 5,204 square-foot fine dining restaurant including a parking reduction; and
4. Adopt Resolution No. — approving Conditional Use Permit No. UP2016-041for the
proposed 2,142 square-Foot casual dining restaurant including a parking reduction.
ITEM NO. 4 DAWSON RESIDENCE VARIANCE (PA2015-224)
Site Location: 2741 Ocean Boulevard
Summary:
A variance to allow portions of a new single-family residence to exceed the height limit from grade and to
allow retaining walls and a garage with pool above to encroach into the 10-foot rear setback along Way
Lane. The new residence height will not exceed the top of curb height limit along Ocean Boulevard.
Variance Nos. VA653 and VA1137 will be rescinded if the application request is granted.
Recommended Action:
1. Conduct a public hearing;
2. Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to
Section 15303, Article 19, of Chapter 3, Guidelines for Implementation of the California
Environmental Quality Act) under Class 3, (New Construction or Conversion of Small
Structures)of the CEQA Guidelines, because it has no potential to have a significant effect on
the environment; and
3. Adopt Resolution No. approving Variance No. VA2015-005, allowing portions of the
proposed residence to exceed the height limit, allowing encroachments within the required
rear yard setback,and modifying the residence so that the dining nook and sitting room below
do not extend beyond the line of the existing balcony and limiting the extent of the fire pit tower
at the upper level to the line of existing development.

VIII. CURRENT BUSINESS
ITEM NO. 5 WEST COAST HIGHWAY CAPACITY INFORMATION SESSION (PA2016-081)
Site Location: Mariners' Mile Area
Summary:
The Public Works Department will provide a presentation to outline the background and City's role in
planning and maintenance of Coast Highway. An overview of the Master Plan of Arterial Highways
and a discussion of the key policies of the General Plan Circulation Element will also be covered.
Additionally, Public Works staff will summarize the existing and future traffic volumes and review the
capacity requirements for Coast Highway.
Recommended Action:
1. This is an information item only. No action is required.
