HomeMy WebLinkAbout2017-14 - RECINDED SEE 2017-66: Establishing “No Parking” Restrictions on the Designated Streets on Specific Days and Times to Improve Street Sweeping Effectiveness and Repealing Resolution 2015-73RESOLUTION NO. 2017-14 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, ESTABLISHING "NO PARKING" RESTRICTIONS ON THE DESIGNATED STREETS ON SPECIFIC DAYS AND TIMES TO IMPROVE STREET SWEEPING EFFECTIVENESS AND REPEALING RESOLUTION NO. 2015-73 WHEREAS, Newport Beach Municipal Code (NBMC) Subsection 12.44.150(A) provides that the City Council shall by resolution designate streets or portions of streets on which the parking or standing of vehicles is to be prohibited; WHEREAS, NBMC Subsection 12.44.150(A) also requires the City Council to designate in the resolution the days of the week and the exact hours during which such parking prohibition shall be in effect; WHEREAS, the City of Newport Beach (City) has determined that it is reasonable and in the public interest to prohibit parking of vehicles at certain times and in certain areas of the City to effectively operate the City's street sweeping program; and WHEREAS, to address parking conditions related to Corona del Mar High School and improve street sweeping effectiveness in the area, the City desires to change the day and time of parking restrictions on the south side of Vista Del Oro from Eastbluff Drive to Mar Vista Drive and the north side of Mar Vista Drive to Monday between 7:00 am and 8:00 am; NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: Section 1: The parking of vehicles shall be prohibited on the streets, days, and times as provided in Exhibit "A," which is attached hereto and incorporated herein by reference. Section 2: Resolution No. 2015-73 is hereby repealed. Section 3: The City Traffic Engineer is authorized and directed to cause signs to be erected in "no parking" areas of the City for street sweeping purposes; Section 4: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution. Section 5: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Resolution No. 2017-14 Page 2 of 22 Section 6: The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Section 7: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution.
