HomeMy WebLinkAbout14 - 2010 Bowl Championship Series BannersCITY OF NEWPORT BEACH CITY COUNCIL STAFF REPORT Agenda Item No. 14 December 8, 2009 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: Public Works Department David Keely, Senior Civil Engineer 949 - 644 -3349 or dkeely @newportbeachca.gov SUBJECT: 2010 BOWL CHAMPIONSHIP SERIES NATIONAL CHAMPIONSHIP BANNERS — APPROVAL OF ENCROACHMENT PERMIT N2009 -0317 RECOMMENDATION: Conditionally approve the request of the Pasadena Tournament of Roses Association for the installation of 178 banners on City streetlight poles, from Monday, December 14, 2009, to Monday, January 11, 2010, for the 2010 Bowl Championship Series (BCS) National Championship. Installation will be along Jamboree Road from University Drive to East Coast Highway and MacArthur Boulevard from Campus Drive to Jamboree Road. DISCUSSION: The Pasadena Tournament of Roses Association (PTRA) has selected the City of Newport Beach as a host City for the 2010 BCS National College Football Championship. The association will have both teams reside at hotels within Orange County. The media hotels for the BCS National Championship game will be the Marriott Newport Beach and the Island Hotel. The Balboa Bay Club will also be utilized for game related personnel and events. The PTRA has requested that 178 private banners be installed from Monday, December 14, 2009 through Monday, January 11, 2010 along the City's major thoroughfares, for the 2010 Bowl Championship Series (BCS) National Championship. The banners will be mounted on City streetlight poles in the public right -of -way along Jamboree Road (130 banners) from University Drive to East Coast Highway and MacArthur Boulevard (48 banners) from Campus Drive to Jamboree Road. Exhibit A shows the proposed BCS banner locations. On Thursday, January 7, 2010, the PTRA will host the 2010 BCS National Championship game in Pasadena, California. The 2010 National Championship game is sponsored by Citi, as show in Exhibit B. The additional sponsor logo(s) will be BCS Banners — Approval of Encroachment Permit N20OM317 December 8, 2009 Page 2 determined by Monday, November 30, 2009 with the final design of the sponsor(s) logo to follow. The teams selected for the BCS National Championship game will be chosen once the regular college football season has concluded on Saturday, December 5, 2009. Exhibit B shows the proposed BCS banner layout. The event is not co- sponsored by the City of Newport Beach and is not free to the public. Council Policy L -16 prohibits the use of a commercial sponsor's name on banners. However, the event will be open to the public, and may create additional revenue to the City through restaurants, businesses, and hotel reservations. The applicant's request to install 178 private banners will exceed the 100 - banner limit allowed per City Council Policy L -16. In the past, requests for similar event have been approved by City Council and there have been no reported public complaints. Should the City Council elect to approve the installation of 178 private banners in the City for 29 days, staff recommends the following conditions of approval: 1. No banners shall be installed on traffic signal poles. 2. The applicant must provide on -going maintenance of the banners and brackets 3. The applicant must sign a "Hold Harmless Statement" requiring maintenance of the banners /brackets and indemnification and hold harmless for any liability associated with the banners /brackets. 4. The applicant must maintain a minimum of $1,000,000 in liability insurance from a company with a Best's Key Rating Guide parameter of "A" or better, and a financial size category of "VIII" or higher. 5. The applicant will obtain an Encroachment Permit (N2009 -0317) by the Public Works Department. 6. The banners shall conform to City Council Policy L -16 with the exception of the number of banners, open to the public free of charge, and co- sponsor by the City requirements. 7. All banners and brackets shall be removed by the end of the approved time unless otherwise approved by the conditions stated in the Encroachment Permit. 8. All banners and brackets shall comply with the Encroachment Permit conditions. 9. If needed, the City may require removal of some of the banners to allow other organizations to install banners at the same location and during the same time period. The traffic control plans related to lane closures necessary for installation of the banners shall be prepared in accordance with the Work Area Traffic Control Handbook (WATCH). The traffic control shall be set up per the approved traffic control plans and WATCH. 11. A minimum of two 5 -inch wide half - circle wind slits per banner are required to minimize the wind load. 12. The City Manager shall approve the Team Logos and Sponsor Logo(s), prior to approval of the Encroachment Permit (N2009- 0317). 13. Team Logos shall not exceed 26 inches wide by 21 inches tall. 14. Sponsor logo(s) shall not exceed 26 inches wide by 6.5 inches tall. Environmental Review: Staff determined that the project is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15378 of the Guidelines. This action is not considered to be a project as defined by CEQA. . Funding Availability: No City funds will be required. Sponsor logo to be determined by Nov.30, 2009. 30" 30" 30" Bowl Championship Series (BCS) Teams Al & 82 will be chosen once the regular college football season has been completed on Oec.5, 2909, The BCS ranking system that selects these teams is a computerized formula with variables determined by team record, strength of schedule, AP and coaches' polls in addition to other more minor variables. Team with lowest total BCS points is the At ranked team and the team with the second lowest points is the d2 ranked team. By role, these 2 teams will then play one another in the BCS National Championship Game to be held at the Rase Bowl on January 7, 2010 at the Rose Bowl Stadium. The Pasadena Tournament of Roses Association will have both teams reside at hotels in Orange County and practice at facilities in Orange County. The media hotel for the BGS game will be the Newport Marriott and the Island Hotel and Balboa Bay Club will also be utilized for game - related pemonmel and events.
