Brown, City Clerk - 949-644-3005, (brown@newportbeachca.gov PREPARED BY: Jennifer Nelson, Assistant City Clerk PHONE: 949-644-3005 TITLE: Confirmation of Appointment to the Newport Beach Restaurant Association Business Improvement District Advisory Board of Directors ABSTRACT: The California Streets and Highways Code Sections 36500 et seq., grants the City Council the authority to appoint an advisory board for Business Improvement Districts formed under the Parking and Business Improvement Area Law of 1989. On June 13, 2017, the City Council appointed ten (10) applicants to the NBRA BID Advisory Board of Directors for FY 2017-2018. The NBRA BID bylaws allow up to eleven (11) members. RECOMMENDATION: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Appoint Thaddeus Foret, representing The Winery Restaurant and Wine Bar, as the 11th member to the NBRA BID Advisory Board of Directors for term ending June 30, 2018. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. 15-1 Appointment to the Newport Beach Restaurant Association Business Improvement District August 8, 2017 Page 2 DISCUSSION: The Newport Beach Restaurant Association Business Improvement District (NBRA BID) was formed pursuant to the Parking and Business Improvement Area Law of 1989 (1989 Law), codified in Streets and Highways Code Sections 36500 et seq., for the purpose of financing activities and programs to benefit businesses located and operating in the area. The City Council has the authority to appoint an Advisory Board to the NBRA BID and limit membership on the Advisory Board to persons subject to the BID assessment. The Advisory Board that serves on the NBRA BID is not appointed in the same manner as other City Boards, Commissions, and Committees. The City relies on the Streets and Highways Code for Business Improvement District advisory board appointments rather than City Council Policy A-2, Board, Commission and Committee Appointments. The NBRA BID Advisory Board's bylaws allow up to 11 members. On June 13, 2017, the City Council appointed 10 individuals to the NBRA BID Advisory Board of Directors for FY 2017-2018. The City Clerk prepared and posted a Notice of Scheduled Vacancy on June 15, 2017, in the City Clerk's Office, at the Central Library, on the City's webpage, and on the bulletin board located in the City Council Chambers; and published the Notice of Vacancy in the Daily Pilot on June 17, 2017. The City Clerk received two applications. It is the NBRA BID Advisory Board's desire to fill the 11t" vacancy on the Board of Directors for the remaining FY 2017-2018 term, ending June 30, 2018. At its July 26, 2017 meeting, the NBRA BID Advisory Board of Directors reviewed the applications on file and is recommending that the City Council appoint Thaddeus Foret, representing The Winery Restaurant and Wine Bar, to the Advisory Board of Directors for FY 2017-2018. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
