AN ORDINANCE OF THE CITY OF NWPORT BEACH AMENDING CHAPTER 5 OF ARTICLE IX BY ADDING .SECTION 9105.4 (h) ENTITLED "SWIVIMING POOLS" TO THE MUNICIPAL CODE OF THE CITY OF NMIPORT BUCH The City Council of the City of Newport Beach does ordain as follows: SECTION 1: That Section 9105.4 (h) entitled "Swimming:" n'ry Pools" be added to Chapter 5 of Article IX of the Municipal Code ;s of the City of Newport Beachto read as follows: "Section 9105.4 (h). Swimming Pools.' " (1) Any swimming pool. i fish poral or other body of water which contains water eighteen inches (1811) or more in depth in R districts shall be at least five feet (51) from any side or rear yard property line and t„en feet (101) from any front yard property line. No such swimming pool., fish pond or other body of water shall be permitted in any required yard space unless..endlosing fence hereinafter required Is permitted within the yard required by Section 9105.2 (b) of the Municipal Code. =r Pump, filter and heater installation shall be enclosed in a vault of masonry construction and located not less than five feet (5`) from any side or rear yard property line and in no event nearer than ten feet (10') to any main dwelling on adjoining prop- erties. Pump may be operated only between the hours of 8sO0 a.m. and 8:00 p.m. 11(2) Fences. Every person owning land on which there is situated a swimming pool, fish pond or other ID dy of water which contains -rater 18 inches or more in depth at any point, shall erect and Maintain thereon an adecsuate fence sufficient to make such body of water inaccessible to small children. Such fence, including gates therein, must be not less than five feet above-- the underlying ground; all gates must be self -latching with latches placed five feet above the underlying ground or otherwise made inaccessible from the outside to small children. 120) Time for Compliance. All persons maintaining such Page 2 pools shall comply with the provisions of paragraph (2) of Section 9105.4 (h) of this code within ninety (90) days after the effective date of this ordinance. 1(4) Modifications. The Planning Comission may permit other protective devices or structures to be used so long as the degree of protection afforded by the substitute devices or struc- tures is not iess than the protection afforded by the fence, gate and latch described herein. Upon the application of a property miner, the Building Department may grant extensions of time for complla:.ce, for geod cause shown in individual cases. Such extensions shall not exceed thirty (30) days at a time." SECTIO 2: This ordinance shall be published at least once in the fiewport Harbor Hews -Press, a newspaper of general circulation, printed, published and circulated in the City of New- port Beach and the same shall be in full force and effect 30 days after this passage. The Commission realizes that the proposal of Mr. Sturtevant would function satisfactorily in subdivisions, such as his' wherein the location of all structures including shimming pools are controlled by the Subdivider. The Commission also realizes that there are many other residential areas in the City containing lots of various sizes where swimming pools will be installed, and that adequate protection must be provided for adjoining property miners. The Commission feels that the proposed changes and the proposed ordinance as changed do not entirely coincide with Mr. Sturtevant's suggestions' but for regulating swimming pools throughout the City is necessarily strict but much more liberal than swimming pool ordinances of many other cities. Y the Department of .Building In addition .to the above amendment,,the.Zoning Ordinance h was also amended to prohibit swimming pools in any yard where the height of fences is limited to 3f feet. This would appy principally to a front yard where such a 31 foot limitation applies. The other amendment was an excep- tion to the height limit requirements of the Zoning Ordi- nance to permit the fencing of any swimming pool required to be fenced and which was not existing prior to June 1, 1956. The People of the City of Pasadena ordain as follows; SECTION 1, SHORT TITLE This ordinance shall be known as the "Swimming Pool Ordinance" of the City of Pasadena. SECTION 2. PUBLIC POLICY. It is found, declared c*nd determined that the maintenance of private swimming pools without appropriate prrtoutionary measures constitute a severe hazard to the safety of the inhabitants of the City of Pasadena, porticuiarly children, SECTION 3. CONTROL (n) No person, firm or corporation in possession of land within the City of Posaaeoz, either as owner, purchaser under contract, lessee, tenant or licensee, upon which is situated c swimming pool or other outside body of water designed or used for swimming, dipping or rn:mersion purposes by men, women or children, of a minimum depth of eigl- 'en (18) inches, shall fail to maintain on the lot or premises upon which such pool or body of water is located and completely surrounding such pool a. - body of water, a fence or wall not less than four (4) feet in height, with openings, holes or gaps therein no larger than four (4) inches in any dimension except for doors or gates; provided, however, that if a picket fence is erected or maintained the horizontal dimension shall not exceed four (4) inches; provided, further, that a dwelling house or accessory b0cling may be used as a part of such enclosure. Any person, firm or corporation violating any of the provisions of this ordinance shall -be deemed guilty of a misdemeanor, and upon con- viction thereof shall be punishable by a fine of not more than five hundred dollars ($504.00), or by imprisonment in the City Jail for a period of not more than six (6) months, or by bath such fine and imprisonment. Each such person, firth or corporate shall be deemed guilty of a separate offense for every day during any portion of which arty violation of any provision of this ordinance is committed, continued or permi•u-i by such person, firm or corporation and shall be punishable therefor as provided by this ordinance_ SECTION S.
