In responae to the request of the property owners, the Newport PILL-Ming Commission granted s continuance of the November hearing relative to the proposed resming from G-2 to C-2.-Hp of the properties lying betwami the Arches and the Balboa Bay Club. Careful analysis of all available data by your Go ittee: has led tis to the def inito 0onalusion that the proposed ffH" requirement would be a wasteful utilization of the land areas by providing too much parsing and would virtually prevent proper economic development of the area, td© are of the opinion that the present Orange County parking regtairements could be adapted for our area and would provide adequate parking with feasible ecoromi,c development, if combined with some factor that would properly take into account the different peak load periods of various tenants. ()ur studies show that this area, with its two fronts ar4d great depth of over 3W feet from the highway to the Pierheaad line, maalcas it necossary to provides a dual development. Our studies also indicate that on the north front along the Pacifica Coast Raghway, small business and offioe use is most probable; while along the aouth front on Newport Ba , apRr entg, hotels or similar uses are probably indieaied. Port Orange Incorporated is the owner of two parcels which are within the area covered by the proposed change. Discussion with other property owners who would be affected has revealed that there is a great amount of concern over the effect of the proposed action on the particular property involved, and a considerable feeling that insufficient study has thus far been made. Certainly this matter is of the utmost importance, not only to the property owners themselves, but to the community as a whole, and deserves the most careful and thorough consideration, based not only upon the use being made at the present time of such property, but of probable future use as well. It is my understanding that the Commission has been asked by some owners to defer action in order to give additional time for study and consideration of the views and suggestions of the parties whose property is involved. On motion of Councilman Hart, seconded by Councilman Higbi.e end carried, the formation of the Parking Advisory Com- mittee; the members thereof as listed above; and the aims'aa set out in Mayor Stoddard's memorandum, were approvers." City and cited particularly properties fronting the so-called Mariners Mile. The Committee recognized the problems inherent in rezoning to require off- street parking, but because of its great importance to proper land use and development agreed that the Planning Commission should be requested to restudy the problem. Accordingly, the Coainittee instructed that the City Council, be requested to request the Planning Commission to study and wherever possib;e initiate rezoning of commercial areas to add the "N" factor, as an asmrurance of adequate off-street parking as new development and redevelopment of com- mercial properties occurs." Quoted herewith is action taken by the City Council on 3uly 14, 1953, regarding the recommmsmeaadation of the barking Advisory Committee: "Instructions were given to request the PlaUning Commission to study and, wherever possible, initiate rezoning of commercial areas to add tb:p H factom;, as an insurance of adequ'ate off-street =parking as new devdiopment and redevelopment of commercial properties occur." imnediately on reviewing the action of the City Council, the Planning Department initiated a laud use survey of the area described herein and, noes submit the following reco endation to the Planning Conmissioa. At this time, the one-half smile strip of laud between The Arches and the Balboa Bay Club is zoned C-2. under the present zoning ordinance, no off-street parking is required unless the Commission requests the same upon the submission of a use permit where required to establish the use of [he property. The absence of off-street parking constitutes a possible hazard both traffic and economic -wise for the businesses as well as for the City. This area is now undergoing a transitional change from existing heavy cm=ercial and light industry to professional offices, retail stores, restaurants, personal service establishments and multiple dwellings, all of which will contribute to increased traffic. The type of uses which are now in existence do not generate .zs much traffic as a lighter commercial use will. Most of the property owners in this area are now beginning to feel that a more economical use of their property is in order. Traditionally in most cities, the light industry and the heavy commercial seek the lower rental. types of land. It is also true that in most cases many of the types of uses now in existence will not gain enough revenue from their type of use to warrant their continued existence. This may not now be the case, but this office feels that with the continuance of increasingly higher cost of land values many of the existing uses will change in the near future. With this change the buildings now in existence will be torn down and replaced with modern structure. -2- At the present time in the subject area, there are approximately forty- five (45) business establishments with the total number of employees being around three hundred and sixty (360). Thera are approximately 454- accessible parking spaces. These spaces include 68 parkipg meters on the south side of the highway between. The Arches and the Balboa Bay Club. This may appear sufficient at the present time since many of the employees park in lots across the street from their place of employment. With an increasing number of improvements on the north side of Coast Highway, the existing off-street parking facilities will be greatly reduced. If the "ii" factor were applied to this C-2 zone, the existing ;ries would become 'non -conforming'. This office feels that they should not be restricted if an extension of their present use is contemplated providing the existing parking facilities are not eliminated. If the existing use changes, then ue feel the City should enforce required off-street parking as set forth under Section 9104.2 of the Newport Beach Municipal Cocke. A recent: report in The Kiplinger magazine regarding 14The ABC's of Zoning" sets forth among other things, the following: "Your zor*.ing is up-to-date if it: Requires off-street parking in all districts Prohibits homes in industrial districts as well as industry in residential districts. Is kept current through continuous revision by the City's planning staff or has been thoroughly revised within, say, the last five years by a competent planning consultant. How about your town's zoning? Is it good enough for 1958 and the years ahead?" The Pianning Department believes that now is Lhe time to rezone this area from a C-2 to a C-2-9 District and respectfully request the Planning Com- mission to give careful consideration to this report and at a very early date recommend to the City Council after a public hearing that off-street parking be required under Section 9104.21 of the Newport Beach Municipal Code. -3-
