Alford, Zoning Administrator The Zoning Administrator meeting is subject to the Ralph M. Brown Act. Among other things, the Brown Act requires that the Zoning Administrator agenda be posted at least seventy-two (72) hours in advance of each regular meeting and that the public be allowed to comment on agenda items before the Zoning Administrator and items not on the agenda but are within the subject matter jurisdiction of the Zoning Administrator. The Chair may limit public comments to a reasonable amount of time, generally three (3) minutes per person. Please Note: All mail or written communications (including email) from the public, residents, or applicants regarding an agenda item must be submitted by 5 p.m. on the business day immediately prior to the meeting. This allows time for the Zoning Administrator to adequately consider the submitted correspondence. NOTICE REGARDING PRESENTATIONS REQUIRING USE OF CITY EQUIPMENT Any presentation requiring the use of the City of Newport Beach's equipment must be submitted to the Community Development Department 24 hours prior to the scheduled meeting. If in the future, you wish to challenge in court any of the matters on this agenda for which a public hearing is to be conducted, you may be limited to raising only those issues which you (or someone else) raised orally at the public hearing or in written correspondence received by the City at or before the hearing. Dean Residence Demolition Coastal Development No. CD2017-070 (PA2017-167) Site Location: 16 Bay Island Zoning Administrator Meeting March 29, 2018 Page 2 Project Summary A coastal development permit to demolish an existing 2 -story, 2,929 -square -foot single-family residence. Recommended Action 1. Conduct a public hearing; 2. Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 under Class 1 (Existing Facilities), because it has no potential to have a significant effect on the environment; and 3. Adopt Draft Zoning Administrator Resolution No._ approving Coastal Development Permit No. CD2017-070. 3. The LOT Minor Use Permit No. UP2017-020 (PA2017-139) Site Location: 999 Newport Center Drive Project Summary Request for approval of minor use permit to allow a Type 47 (On -Sale General, Full Liquor) Alcoholic Beverage Control license at an allowed eating and drinking establishment operating in conjunction with the movie theater in Fashion Island. The theater is currently being renovated to add a full service eating and drinking establishment with late hours (after 11:00 p.m.) in conjunction with the a renovation of the theater that is reducing the number of theater seats from 680 to 420. Type 47 (On -Sale General, Full Liquor) alcohol sales and service is currently allowed at the theater through Mminor Use Permit No. UP 2016-001. The request also includes live entertainment at dancing. Pursuant to NBMC 5.25, the operation as described requires the owner/operator to obtain an Operator License through the City because the change in use from a thereter to a theater and eating and drinking establishment with entertainment, dancing and late hours for a portion of the tenant sapce. If approved, this Minor Use Permit will supersede Use Permit No. UP2016-001 which would become null and void. Recommended Action 1. Conduct a public hearing; 2. Find this project exempt from the California Environmental Quality Act (CEQA) pursuant Section 15301 under Class 1 (Existing Facilities) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because proposed project will allow the continuation of alcohol service with the added allowance for live entertainment and dancing in an existing tenant space occupied by an eating and drinking establishment and theater and has no potential to have a significant effect on the environment; and 3. Adopt Draft Zoning Administrator Resolution No. _ approving Minor Use Permit No. UP2017-020. 4. 2100 East Balboa Boulevard Demolition Coastal Zoning Administrator Meeting March 29, 2018 Page 3 Development Permit No. CD2018-018 (PA2018-041) Site Location: 2100 East Balboa Boulevard Project Summary A coastal development permit to demolish an existing 6,300 -square -foot residence with a detached 600 -square -foot garage. Recommended Action 1. Conduct a public hearing; 2. Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 under Class 1 (Existing Facilities), because it has no potential to have a significant effect on the environment; and 3. Adopt Draft Zoning Administrator Resolution No. _ approving Coastal Development Permit No. CD2018-018. 5. Gulliver Vehicle Sales Minor Use Permit No. UP2018-001 (PA2017-264) Site Location: 2230 Bristol Street Project Summary A minor use permit to allow the operation of a vehicles sales facility within an existing commercial building. No vehicle repair will occur at the site. Recommended Action 1. Conduct a public hearing; 2. Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301, of the State CEQA (California Environmental Quality Act) Guidelines - Class 1 (Existing Facilities) of the CEQA Guidelines, because it has no potential to have a significant effect on the environment; and 3. Adopt Draft Zoning Administrator Resolution No. _ approving Minor Use Permit No. UP2018-001. 6. Kroener Residence Coastal Development No. CD2017-101 (PA2017-237) Site Location: 5607 Seashore Drive Project Summary A request for a coastal development permit (CDP) to allow the demolition of an existing single-family residence and construction of a 3,163 -square -foot, single-family residence with attached 2 -car garage. The design includes hardscape, walls, landscaping, and drainage facilities. The project complies with all applicable development standards and no deviations are requested. Recommended Action 1. Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15303 under Class 3 (New Construction or Conversion of Small Structures) because it has no potential to have a significant effect on the environment; and 3. Adopt Draft Zoning Administrator Resolution No. _ approving Coastal Development Permit No. CD2017-101. V. PUBLIC COMMENTS ON NON -AGENDA ITEMS Public comments are invited on agenda and non -agenda items generally considered to be within the subject matter jurisdiction of the Zoning Administrator. Speakers must limit comments to three (3) minutes. Before speaking, we invite, but do not require, you to state your name for the record. The Zoning Administrator has the discretion to extend or shorten the speakers' time limit on agenda or non -agenda items, provided the time limit adjustment is applied equally to all speakers.
