TITLE: 2017-2018 Playground Improvements Project— Notice of Completion
for Contract No. 8494-1 (18P01)
ABSTRACT:
On September 26, 2017, the City Council awarded Contract No. 8494-1, 2017-2018
Playground Improvements, to R. E. Schultz Construction, Inc. (R.E. Schultz) of Orange,
California. All contract work has been completed to City's satisfaction.
RECOMMENDATION:
a) Accept the completed work and authorize the City Clerk to file a Notice of Completion for
the project. On September 26, 2017, City Council found this project exempt from the
California Environmental Quality Act (CEQA) pursuant to Section 15302(c) (Replacement
or Reconstruction);
b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the Notice
of Completion has been recorded in accordance with applicable portions of the Civil Code;
and
c) Release the Faithful Performance Bond one year after acceptance by the City Council.

The work necessary for the completion of this contract consisted of removing and disposing
of existing deteriorated playground improvements; furnishing and installing flexible play
surface systems and a synthetic turf play system; constructing a concrete mow curb;
transporting, placing, and grading sand; removing offending tree roots; installing tree root
barriers; and other incidental items to complete the work in places required by the contract
documents. The playgrounds included in this contract were located at the following parks:
West Newport Park at Orange Street, Irvine Terrace Park, Begonia Park and Coastal Peak
Park. The 2017-2018 Playground Improvements project was awarded to R.E. Schultz on
September 26, 2017 with a Notice to Proceed date of January 2, 2018.
The contract was completed to the satisfaction of the Public Works Department. A summary
of the contract cost is as follows:

One change order was issued for this project and the final construction contract cost was
approximately three percent over the original contract amount. The change order was due to
the additional installation of city -provided playground equipment at Coastal Peak Park, as
requested by Recreation & Senior Services Department.

ENVIRONMENTAL REVIEW:
City Council found this project exempt from the California Environmental Quality Act (CEQA)
pursuant to Section 15302 (replacement of existing facilities involving negligible expansion of
capacity) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3,
because it has no potential to have a significant effect on the environment.

NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of the
meeting at which the City Council considers the item). In addition, the City Clerk will be filing
a Notice of Completion for the project as a result of this action.
The Notice Inviting Bids was advertised in the City's official publication and in construction
industry publications.
