A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, AUTHORIZING
THE SUBMITTAL OF AN APPLICATION FOR THE
WATERSMART: WATER AND ENERGY EFFICIENCY
GRANT FOR 2018 FOR THE CITY'S ADVANCED METER
INFRASTRUCTURE SOLUTION PROJECT
WHEREAS, the United States Bureau of Reclamation is currently offering grant
opportunities through the WaterSMART: Water and Energy Efficiency Grants for Fiscal
Year ("FY") 2018 program;
WHEREAS, the WaterSMART: Water and Energy Efficiency Grants for FY 2018
program is a cost -shared grant program emphasizing water and energy efficiency;
WHEREAS, the City Council supports the submission by the City of Newport
Beach ("City") of a grant application, prepared and approved by the City, to the
WaterSMART: Water and Energy Efficiency Grants for FY 2018 program, for the City's
Advanced Meter Infrastructure Solution Project ("Project");
WHEREAS, under the WaterSMART: Water and Energy Efficiency Grants for FY
2018 program, the United States Bureau of Reclamation may award up to One Million
Dollars and 00/100 ($1,000,000.00) towards the maximum 50/50 cost sharing to pay for
the Project costs and the City is capable of providing an additional Eight Million One
Hundred Eighty -Eight Thousand Nine Dollars and 00/100 ($8,188,009.00) in cash and/or
in-kind contributions specified in the grant application's funding plan to pay for all
remaining Project costs; and
WHEREAS, if selected to receive funds for the WaterSMART: Water and Energy
Efficiency Grants for FY 2018 program, the City will work with the United States Bureau
of Reclamation to meet established deadlines for entering into a cooperative agreement
regarding funding for the Project.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as
follows:
Section 1: The City Council does hereby approve the submission of the
application for the WaterSMART: Water and Energy Efficiency Grants for FY 2018
program by the City for fiscal year 2018-19 for the Advanced Meter Infrastructure Solution
Project.
Section 2: In the event grant funding is provided by the United States Bureau of
Reclamation, the City Council does hereby authorize the City Manager or his or her
designee to accept the grant and sign any contract for administration of the grant funds.
The City Council does hereby delegate the City's Finance Department Director to act as
a fiscal agent for any grant funding received.

Section 3: The recitals provided in this resolution are true and correct and are
incorporated into the operative part of this resolution.
Section 4: If any section, subsection, sentence, clause or phrase of this resolution
is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the
validity or constitutionality of the remaining portions of this resolution. The City Council
hereby declares that it would have passed this resolution, and each section, subsection,
sentence, clause or phrase hereof, irrespective of the fact that any one or more sections,
subsections, sentences, clauses or phrases be declared invalid or unconstitutional.
Section 5: The City Council finds the adoption of this resolution is not subject to
the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the
activity will not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or indirectly.
Section 6: This resolution shall take effect immediately upon its adoption by the
City Council, and the City Clerk shall certify the vote adopting the resolution.
