The Board of Trustees of the City of De Mort Beach,Calif. met in adjourned session at 7:30 p.m. at the place and on the date above mentioned. :ointment of Clerk 'ro.Tem. Owing to the fact that the office of City Clerk was automatic- ally made vacant by his removal from the city,and having absented himself for more than thirty days without leave from the Council,the President of the Board of Trustees appointed Trustee Geo.P.Wilson to act as Secretary pro tem. Roll Call. On calling the roll the following Trustees•responded "Present ": H.A.Robinson, J.J.Sehnitker, Geo.P.Wilson, J.C.MeCaiin & J.P.Greeley. Absent None. Jom.nuaication from ''m.L:.Bowen and Fi. Messrs Wm.M.Bowen and H.E.Lyon,owners of property on Balboa Is- land,had an important communication to impart to the Board, and as the wished to take the eight o'clock car,the usual order of business was dispensed:with and they were asked to address the Board. Their in- formation was that there was a- strip of land. surrounding. Baj•boa Island on which taxes had not been paid for five years and that on the.26th day of June,the same would be sold beyond redemption,the amount there; on being about 53200. They advised that the city ought to buy this in 1 and become the owner of said strip. The Board signified its intention) to investigate the matter within the time allowed. Moved by Trustee J.P.Greeley,seconded by Trustee Schnitker and carried that the resignation of Claude I:T.Crego,City Clerk,be accepted and the office of City Clerk be declared vacant. Kf"c Lion of ^ Clerk . Nominations Cler. Nominations for the office of City Clerk were made as follows: R.P.Flilson and J.Royal Lemon. Ballots were taken and the result an- nounced, J.Royal Lemon receiveing three votes,R.P.Vlilson,two. It tiaas moved by Trustee J.P.Greeley,seconded by Trustee J.C.McCain and duly carried that the vote for J.Royal Lemon be made unanimous. The Presi- dert of the Roard of Trustees then declared J.Royal Lemon elected Clerk of the City of Newport Beach for the unexpired term. Moved by Trustee J.J.Schnitker,seconded Vy Trustee J.C.T..IcCain and duly carried that the action of the Board of Trustees at a meeting thereof held on the 9th day of June,1917,rejecting alr bids for the construction of the jetty except the bid of 7I.12.Ledbetter,accepting his bid and awarding the contract to said W.I11.Ledbetter,be ratified, confirmed and approved. I The Harbor Comnission,being present,requeste& that it be made td appear by the minutes that they approved the action of the Board of Trustees concerning the expenditure of funds raised by the sale of bonds for the construction of the jetty,and the action of the Board of Trustees on the 9th day of June,1917. .;-proval of City Clerk's ??ond. The bond of J.Royal Lemon,City Clerk, and the sureties thereon was 'approved by the Board of Trustees and filed with the President the Board. J.Royal Lemon took and subscribed to the oath of office and assumed official duty. r _ eadir_ of Minutes,correction and approval. The minutes of June 4,1917 were read and approved with the fol- lowing correction: In the statement in which it was noted that T.H.Led- better had agreed to deduct 90d from the contract price in the event the city should desire to pay the freight,it should read that both iN7_-A 211 The minutes of June 6,June 8 and June 9th were read and approved. The following report made by the Police Committee and the City -Marshal regarding appointment of Police officer was presented: ' "To the Board of Trustees: i7e,your committee appointed to consider the matter of the appointment of a Police Officer for the city of Newport Beach,hereby reco?nmend that `-,b.Ulrich be appointed a Police Officer for such time as in the judgment of the Board the services o an officer may be required. In making this recommendation we believe that the heads of the different departments of-the city government should have a voice in the selection of their assistants. Signed, J.J.Schnitker,Chairman of Police Committee, J.A.Porter,ivlarshal ". It was moved by Trustee Greeley,secon9_ed by Trustee 1«cCain' that in the report just presented the name of Oscar Collins be substitute for that of ddm.Ulrich. On motion of Trustee Greeley,seconded by Trus ee I,dcCain the following resolution was offered as a substitute for the foregoing motion: Resolved that Oscar Collins be and is hereby duly appointed a police officer within and for the city of Newport Beach, to serve during the pleasure of the Board of Trustees,and to receive for his services the sum of a75. per month,said police officer to be under the control and direction of the City I:Iarshal. Before entering upon his duties he shall execute a bond to the City_of Newport Beach in the sum of ?1000. by two sureties to be approved by the Board of Trustees and filed with the Clerk. He shall-also take and subscribe to the oath of office. On motion of Trustee J.J.Schnitker,seconded by Trustee Geo.n.I7ilson,the' foregoing resolution was carried with th name of 7,9m.Ulrich substituted for that of Oscar Collins. On calling the roll the following responded "Aye ". Trustees H.A.Robinson, J.J. Schnitker,Geo.P.17ilson and J.P.Greeley. The following responded "No" Trustee J.C.I.IcCain. Moved by Trustee J.J.Schnitker,seconded by Trust e Geo.?.;7ilson that 1.,§n.Ulrich be appointed Police Officer. On calling the roll the following Trustees responded "Aye": H.A.Robinson, J.J. Whereas certain protests against the said im- provement had been filed within the time allowed therefor,and wherea the Board of Trustees had set this date for the hearing of protests, ' and whereas no person appeared before the Board in behalf of the protesters,the following resolution was adopted by the Board of Trustees, moved by Trustee.Schnitker,seconded by Trustee I:IcCain. On calling the roll the following Trustees responded "Aye ":H.A.Robinson J. J. Schnitker ,Geo.".71ilson,J.C.lic0ain and J.P.Greeley. Noes none, Absent none. whereas,the Board of Trustees of the City of Newport Beach did on the 19th day of I:iarch,1917 duly adopt an Ordinance No.129 declar- ing its intention to order the extension,opening and widening of Bay Avenue,from the northwesterly line of the Alley between Twenty -Third Street and Twenty- Fourth Street, and being parallel to said Tv.enty- Third and Twenty - Fourth Streets,to the Southeasterly line of Thirti- eth Street within the said City: And ,Ihereas, s-"id ordinance of Intention was published L.s pro- vided by law,and notice of the passage thereof was duly published 212 and posted by the Street Superintendent of said City as required by law and postal cards were mailed by the City Clerk,eontaining a noti of the passage of said Ordinance, to each property owner in the asse ment district,at his last known address as the same appeared on the tax rolls of said City,as required by law; And 'ilereas,certain protests against the extension,opening and widening of said Bay Avenue were filed within the time therefor, and the City Clerk having presented said protests at the next regular meeting of the city council after the expiration of the time for fil ing protests,and the said Council having upon determination found an declared that the said protests were not signed by the owners of a majority of the frontage of the property fronting on streets within the said assessment district, fixed the hour of 7:30 p.m. of Konday the 11th day of June,1917 as the time and the regular meeting place of the Board of Trustees,as the place to hear said protests, and n6tiee of the hearing of said protests was published as provided by law, sand d�B _rd did on this 11th day of June,1917,hear all said nrotes�zns tine extension; opening and widening of said Bay Avenue are hereby denied. Resolution No.81 was then passed awarding the contract for the construction of a board walk on Surf Ave, to Glenn Helms. On calling the roll the following Trustees responded "Aye ": H.A. Robinson, J. Contract ioi• t_ =e re;aoval of garbage from 73L:lbo� Island; It was moved by Trustee Greeley, seconded by Trustee i°ilson and carried that the City enter into a certain contract for the removal of garbage from Balboa Island, and that the 'resident of the Board of Trustees and the City Clerk be authorized to execute the same. Report of Chamber of Commerce Committee on C_nning ^actory. Report was made by the Trades and lianufactures Committee of th - Chamber of Comrerce of which J.J.Schnitker is Chairman,on the pro- posed capping factory. Said report was made by Lew H.17allace who stated. that the gentlemen who proposed to establish the factory wand definite assurance that the Board. of Trustees would arrange to pro'. a channel for boat service from Last Nemn ort to the proposed site o4 the canning factory. Attorney be given full authority to act in the matte -r of the tax sale to be held June. 26th at which time a strip of land surrounding Balboa Island is to be sold for taxes. Report of I':_rsh l Forter regarding c:.sting from wharf. I.Tarshal J.A.Porter made a report regardinn- the danger attending casting from the wharf,stating thrit a number of persons had been injured through carelessness in casting,and that there ought to be an ordinance drafted to regulate the same. It wr::s moved by Trustee J.P.Greeley,seconded by Trustee J.0.LTcCain and carried that the City Attorney be instructed to draft an ordinance to that effect. Adjournment.
