HomeMy WebLinkAbout08/04/1924 - Regular Meeting303 City Hall, Newport Beach, Aug. 4,1924 The Board of Trustees of the City of Newport Beach met in regular session on the above date. The meeting was called to order by President Geo. P. Wilson ; the roll was called, showing the full board present. The minutes of the previous meeting were read and approved. The reports of heads of departments were read and on motion .of ..rustee-Sloan, seconded by Trustee Richter and carried, were approved. The communications were read and referred to the proper order of business. REPORTS OF SPECIAL 0014DDAITTEES In the report of the Planning Commission, referring to purchase of Lot 21, Block 30, Newport Beach, it was decided to deal directly with the owner of said property, and the Clerk, instructed to offer one thousand, five hundred dollars for the lot, City to assume assess- ments standing against the above described property. City Marshall, J.A.Porter reported that Mr. Fulkerson had been seen and that Mr. Fulkerson stated that he was willing to repait all damages done to sidewalks and curbs, and that he would apply to out the sidewalk as soon as it could be decided where cut could be made to the best advantage. On motion of Trustee Wilkinson, seconded by Trustee Richter and carri -. it was decided to accept the agreement resubmitted by the Pacific Electric for an easement from 3oth to 26th Sts. On motion of Trustee Sloan, seconded by Trustee Wilkinson and carrier - all protests against vacating portions of Coast Boulevard, as recited in Resolution Ian. 250, were overruled and denied. Thereupon a roll call was taken, the trustees voting in the following manner. Ayes, Trustees Wilson, Sloan, Young, Richter and Wilkinson Noes, Trustees, None. Absent,Trustees.None. On motion of Trustee Wilkinson, seconded by Trustee Sloan, and carried, Ordinance No. 261 was passed to the second reading. In the matter of straightening channel lines as outlined by Mr. Peabody, on motion of Trustee Richter, seconded by Trustte Sloan, and carried, City Engineer Kressley was instructed to draw lines so that the bridge would be included in the city limits. On.motion of Trustee Sloan, seconded ty Trustee Richter, and carried, it was decided to take over the Bay Island sever system, in the.uanner as outlined by City Attorney Clyde Bishop, mainly, that the sewer system being in good shape, and that a map be furnished shaving the mains and laterals, and that enough land be abandoned along the certer line of the svn7er to allow the city to repair same, when necessary. NESS BUSINESS. The matter of abandoning a portion of L Street, north of Central Avenue, as presented by Mr.,Finch and Wisel, was referred to the Planning Commission for investigation. Application of the Noland Amusement Co., for space for a . merry -go -round in the triangle known as. McFadden Place, was discussed, and on motion of Trustee Wilkinson, seconded by Trustee Sloan, and carried it was moved that the request be not granted. In_the matter of leasing ground between the bay and the,proposed purchase of the American Legion at one dollar a year, on motion of Trustee Wilkinson seconded by Trustee Sloan and carried, the matter was referred to the Commitee as a whole, along with the Naval Reserve request for land, for investigation and report. Application of Gibbon -Reed Co., for a sixty -day extension on their contract, was discussed and on motion of Trustee Sloan, seconded by Trustee Young and carried, the request was granted. Correspondence from Mr. Geo. Peabody regarding dirt etc. along the ,beach was discussed and referred to the Police Cormitee. On motion of Trustee Sloan , seconded by Trustee Young and carried it was moved that City Engineer Kressly furnish City Attorney Clyde Bishop with an assessment district description from B.Street down and it was suggested that the East Bay Front property owneres petition the Board. of Trustees to form a municipal improvement district, in order to vote bonds for the proposed improvement of streets in the vicinity. COMMUNICATIONS. A communication was received from Mr. L L.Garrigues, regarding an error in making municipal reports, made by the City Clerk, and request- ing refund from the city. On motion of Trustee Young seconded by Trustee Sloan and carried the matter was referred back to Mr. Garrigues inasmuch as the city was not responsible. The matter of furnishing city aid to vessels in distress, as outlined by the Balboa Life - Saving Corps was referred to the City Attorney 2 ®4 Co,nnunication was received from the California League of Municipal- ice. ities regarding a meeting to be held October 6 -9 inclusive, and on motion "may of Trustee Sloan seconded by Trustee Young and carried, the Clerk was ilia ice`_ to write stating that the city hoped to be represented. On motion of Trustee Young,seconded by Trustee Sloan and carried, permission to sell ice cream sandwiches on the beach was granted. On motion of Trustee Wilkinson, seconded by Trustee Sloan and carried City Marshall Porter was allowed an amount not exceeding $25.00 for additional life guard equipment and supolies. On motion of Trustee Richter, seconded by Trustee Sloan and carried, City Engineer Kressly was instructed to draw up a tentative plan as recommedded by the Committee investigating water conditions in the City of Newport Beach, along with an approximate cost of the impoovement. Mr. Ffau of Balboa was present and publicly reviewed his case ' Wallace vs Pfau, No action was taken by the Board. City Marshall J.A.Porter stated to the Board, that the motor cycle of Motor Cycle Officer Alder was used up, and dangerous to ride, that Mr. Alder was planning to get a new one, and that more money should be paid him. He stated the par. Alder would furnish his own machine and the City should pay a salary of $185.00 a mobth and pay for the oil and gas ased while on duty. No Motion of Trustee Wilkinson, .seconded by Trustee Sloan and carried, the matter was referred to the Police Commission for recommeddation. The matter of aeroplanes flying low down along the beach and piers in this vicinity was brought to the attention of the Board by Major L.L.Garrigues, representing the Balboa Chamber of Commerce. The matter was referred to the Police Committee for reccommendation and report. Request of City Attorney Clyde Bishop for vacation to the 8th day of September was granted. The City Engineer presented an assessment for the improvement of Ocean Boulevard and ceraain other streets, avenues and alleys in Tract No. 518 or more particularly described in Resolution of Extention No.273 upon motion of Trustee Sloan seconded by Trustee Richter and carried, the said diagram was approved. The question.of establishing a district or districts in which ' the business of drilling for, developing and production of oil, petroleum and other hydrocarbons might be carried on in the city of newport Beach was considered and on motion of Trustee Wilkinson seconded by Trustee Young a and duly carried, the matter was referred to the city planning commission re- quiring said commission to recommedd the boundaries of the district, and appropriate regulations and restrictions to be enforded therein. directing said commission to consider said matter, give notice of and hold a public meeting thereon to make a tenatative report. The ordinance No. 262 and referred to the city Attorney. ORBINANCE No. 26® ordering certain improvements to be made in j the City of Newport Beach and directing an action be be commenced for the condemnation of the property necessary to be taken therefor, came up for final hearing, was read, considered, the roll was called, and the ordinance passed by the following vote; Ayes; Trustees, Wilson, Sloan,Young Richter and Wilkinson Noes, Trustees, None Absent Trustees, None In the matter_. of the proposed improvement of certain portions of McFadden Place and 21st. St. This being the time fixed by Resolution. of Intention Nb. 289, passed July 7,1924 for hearings protests in the matter of-the improvement therein described, and certain weitten protests having been filed with the City Clerk in said matter, all of said protests e presented to and considered by the Board of Trustees, and all persons destr� to be heard in the matter of the said protests were heard by said Board whereupon Trustee Sloan moved the Resolution No. 291 entitled "A resolution over - ruling protests in the matter of the improvement of certain portions of McFadden Place and 21st St. within the City of Newport Beach" be adopted, which motion was seconded by Trustee Young, and carried by the following vote: Ayes: Trustees Wilson, Sloan, Young Richter and Wilkinson, Noes; Trustees, None Absent Trustees None. Trustee Young: presented and moved the adoption of Resolution No. 292 entitled "A Resolution of the Board of Trustees of the City of Newport Beach ordering certain work, to be done and improvement to be made on certain portions of McFadden Place and 21st Street within said City" which motion was seconded by Trustee Richter and carried by the following vote: Ayes; Trustees Wilson, Sloan, Young, Richter and Wilkinson; Noes None Absent, None. 2 ®5 Trustees Richter presented and mooved the adoption of Resolution 14o.293 entitled, "A resolution of the Board of Trustees of the City of Newport Beach directing certain work or improvement to be done under the direction of the City Engineer of said City ", which motion was seconded by T.- Trustee Sloan, and carried by the following vote: Ayes; Trustees, Wilson, Sloan, Young, Richter and Wilkinson. Noes. Trustees, None. Absent Trustees, None, On motion of Trustee Wilkinson seconded by trustee Young, and ca rried the meeting was adjourned to the 25th day of,August , 1924 at 7;30 P.M. P.Wilson, The Roll was called showing the full board present with the exception of Trustee Young. Communications were read and referred to the proper order of business. On motion of Trustee Richter seconded by trustee Sloan, and carried, the Street Superintendent was instructed to order the Fulkerson people to immediately apply for permit to cut the curb at their property and to immediately establish a crossing as called for by City Ordinance. On motion of Trustee Wilkinson, seconded by Trustee Sloan and carried, Resolution #294 was adopted by roll call the trustees voting in the following manner: Ayes; Trustees Wilson,Sloan, Young Richter and Wilkinson Noes; None Absent None. A communication was received from Mr. Hancock Banning and after some discussion a committee of Trustee Sloan, Trustee Young, S. A. Cundiff and Lew H.111allace was appointed to Meet with Mr. Banning: A communication was received from the Sims Gudell Co. regarding a reservoir site on Corona Del Mar. Owing to the absence of Attorney Bishop the matter was laid over to Sept 8 ,1924 and the Clerk instructed to write. On motion of Trustee Wilkinson seconded by trustee Sloan and carried complaint of E.G.Smith of Los Angeles regarding the calling of wares early in the morning, was referred to City Marshall J.A.Porter. On motion of Trustee Wilkinson seconded by trustee Richter, carried application to transfer Liscense No.329 -330 to John Stuckenbruck was granted. This being the time fixed for 6pening bids for certain work o8 certain portions of McFadden Place and 21dt Street as contemplated by Resolution of Intention N. 289 of this Board, the Board in open session publicly opened, examined and declared all sealed bids received for said work, to -wit: E. M. Burris for 8" concrete pavement including grading per sgft. 420 E. M. Burris for concrete curbing complete including Grdg. linealft.68¢ ' 230 Lee R.Weber for 8" concrete pavement including grading per sqft. 420 Lee R.Weber for concrete curbing complete including Grdg.per lineal ft 70�, H.H.PP erson for 8" concrete pavement including grading per sq ft. 37V H .Peterson for concrete curbing complete including grading per lineal ft. 694 AND THEREUPON, said bids were referred to the City Engineer for checking and report. The City Engeneer reported Jd= H.H.Peterson, the lowest bidder for the .work to be done on certain portions of McFadden Pland and 21st Street and thereupon Trustee Sloan presented Resolution No.294, entitled "A Resolution of the Board of Trustees of the City of Newport Beach awarding the contract for certain woek on certain portions of McFadden Place and 21st St, within said City" and seconded by Trustee Young said Resolution was adopted ty the following vote: Ayes Trustees Wilson, S1oan,Richter Young and Wilkinson Noes Trustees, None Absent Trustees, None.
