City Hall, Newport Beach, Sept. 14, 1931.
The.City Council of the City of Newport Beach met in regular
adjourned session at 7:30 o'clock P. M. on above date. The meeting was
called to order by Mayor Johnson.
The roll was called showing the full Council present.
The minutes of the previous meeting of Sept. 7th were read and
approved as read.
Councilman Hilmer reported in regard to the bulkhead at the west
end of Balboa Island, that some were in favor of it and some were not,
that a permanent bulkhead would have to be petitioned for and charged
against the property, and temporary repairs probably would also. He
would recommend that the property owners be advised of the situation.
The temporary repairs according to City Engineer Patterson would cost
about $4.00 per foot and it would require about 70 feet.. The matter
was considered and on motion of Councilman Claire seconded by Councilman
Ellsworth and carried, the Street Superintendent was instructed to notify
the property owners that it will be necessary to circulate a petition for
either permanent or temporary repairs for the bulkhead.
Councilman Hilmer also reported on the lease asked for by Calvin
F. Brown and Thomas J. Gentle, that he did not think the City should
compete with other tax payers in the City, and would recommend, if leased,
that the pri-ce be not less than $14.0O.per front foot for the first five
pears increasing for subsequent years, and on a lease not to exceed 25
years. The matter was considered and on motion of Councilman Claire
seconded by Councilman Garfield and carried, the report was accepted and
the Clerk instructed to notify them of the action taken.
Councilman Hilmer had no special report on the communication from
the Building Officials Conference, except that if it is worth while for
officials to go to these Conventions he thought they should endeavor to
keep their expenses down as low as possible.
On motion of Councilman Claire seconded by Councilman Ellsworth
and carried, the Building Inspector was authorized to attend the Building
Officials Conference at Berkeley, October 5th to 10th with expenses allowed
not to exceed $50.00.
Councilman Ellsworth stated he thought the rezoning of Block 15
Balboa Eastside was a matter for the Planning Commission to decide,
which brought out the fact that the Planning Commission was not func -.
tioning at present. The matter was considered and on motion of Councilman
Ellsworth seconded by Councilman Claire and carried, all of the offices
of the Planning Commission are declared vacant except the office of
President and Secretary.
Mayor Johnson stated he would appoint a new Planning Commission
soon, and on motion of Councilman Claire seconded by Councilman Garfield
and carried, the matter of rezoning•Block 15, Balboa Eastside was referred
to the Committee when appointed.
The communications were read and acted upon as follows:
The petition from Fred E. Lewis, Industrial Properties Corporation
and R. N. Frick, asking that the City vacate the end of "M" street, in
Tract 756, and they in turn would deed to the City Lots 40 and 41 in the
same .Tract, which would provide additional beach space, was considered,
and on motion of Councilman Hilmer seconded by Councilman Garfield and
carried, the matter was laid on the table to next meeting.
On motion of Councilman Hilmer seconded by Councilman Garfield
and carried, the City Attorney was instructed to draw up an Ordinance
of vacation for consideration at the next meeting.
On motion of Councilman Claire seconded by Councilman Garfield
and carried, the request of J. A. Gant for transfer of funds from various
accounts to sundry other accounts was allowed.
The communication from H. L. Sherman enclosing the resignation
of Mrs. Harriet Coleman as a member of the Library Board, was considered,
and on motion of Councilman Hilmer seconded by Councilman Claire and
carried, the resignation was accepted.
Mayor Johnson then appointed Gilbert Upright to fill the unexpired
term of Mrs. Coleman ending June 30, 1932, and on motion of Councilman
Garfield.seconded by Councilman Hilmer and carried, the appointment was
confirmed.
On motion of Councilman Ellsworth seconded by Councilman Hilmer
and carried, the communication from the Long Beach Chamber of Commerce
calling attention to a meeting to consider means of prohibiting the
dumping of oil on our beaches, was referred to the Chamber of Commerce
for action.
On motion of Councilman Claire seconded by Councilman Garfield
and carried, the communication from 8orona Del star Property Owners Assn.
calling attention to a leaking drinking fountain at the foot of Heliotrope
Avenue, was referred to the (Water Supt, for attention.

On motion of Councilman Claire seconded by Councilman Garfield
and carried, the application of Emma J. Alexander for permit to Construct
a pier in front of Lots 508 and 509 in Tract 907, was allowed subject
to the will of the Council.
A petition asking that all that property in Newport Heights
to the center line of 16th Street, and from and including the Newport
Harbor Union High School to the easterly line of Newport Boulevard, be
-annexed to and made a pqrt of the City of Newport Beach was considered.
City Engineer Patterson testified as to the correctness of the descrip-
tion and the City Clerk testified as to checking the signatures with the
' Great Register of Orange County, but inasmuch as the total number of
registered voters in the district was not known and consequently the
Council could not ascertain whether the petition contained the required
number of signatures or not, on motion of Councilman Garfield seconded
by Councilman Ellsworth and carried, the matter was laid on the table
until next meeting.

NEW BUSINESS.
On motion of Councilman Claire. seconded by Councilman Hilmer
and carried, the two demands having been signed and approved by the
Finance Committee, were allowed and warrants to be drawn for same.
City Engineer Patterson presented his report of July 12, 1930
on the then present condition and future requirements of our water supply
system,-. and recommending that axound 30 acres of water- bearing land in
the vicinity of Talbert and Fairbiew Avenues be acquired, and if so
that SO acres out of the 93 acre tract be sold, also that no permanent
improvements be added to the present plant. The matter was considered
and on motion of Councilman Garfield seconded by Councilman Ellsworth
and carried, the report was accepted and filed together with all other
letters, reports and analyses pertaining to and accompanying same.
City Attorney Thompson presented an Agreement for Escrow
Instructions covering a contract for the purchase of approximately 34
acres of water - bearing land from Myron T. Powell at a price of $750.00
Per acre with a down payment of $2,000.00, the option for purchase at '
' this price expiring on September 15th. The matter was discussed and
on motion of Councilman Claire seconded by Councilman Garfield and
carried, the City Clerk was instructed to draw a warrant for $2,000.00
in famor of City Attorney Thompson to be placed in escrow tomorrow
morning, the amount to be taken out of the water surplus fund.
There being no further business on motion of Councilman
Ellsworth seconded by Councilman Hilmer and carried, the meeting
adjourned to 7:30 o'clock P. M. on Friday, September 18, 1931.

corrected and approved.
On motion of Councilman Hilmer seconded by Councilman Garfield
and carried, the regular order of business was suspended to take up the
matter of action on the petition for annexation of Newport Heights
Addition to the City of Newport Beach.
B.-F. Chaplin and Russell Hamptmn testified as to the
circulation and signing of the petition, and the City Clerk read his
affidavit of checking the petition and number of voters in the territory
to be annexed. Attorney J. E. Ogle of Santa Ana spoke for the
Protestants against annexation, and stated they would take the matter
