HomeMy WebLinkAbout11/23/1931 - Adjourned Regular Meeting369 The election was held on the 27th day of October, 1931; the canvass of the returns was made by the City Council of the City of Newport Beach at the City Hall thereof at the hour of 7:30 o'clock P.M. of Monday, the 2nd day of November 1931. Councilman Garfield introduced a Resolution declaring the result of the special annexation election. The Resolution was read, considered, deibiganted RESOLUTION NO. 715, and upon call of the roll passed by the following vote, to -wit: AYES, Councilmen Hilmer, Claire, Ellsworth, Garfield, Johnson. NOES, Councilmen None. ' ABSENT, Councilmen None.. City Attorney Thompson stated that inasmuch as so many complaints have been entered on account of the odor from the Refiner, he thought he should be given authority to apply for a permanent injunction against them in case it is necessary for additional complaints to be made. The matter was considered and on motion of Councilman Hilmer seconded by Councilman Claire and carried, the City Attorney was empowered to get out a permanent injunction against the Orange County Refining Co. in case further complaints are filed. The communication from Helen L. Coffin asking hoer many wells the Refinery are running and paying a license on, was considered, and on motion of Councilman Claire seconded by Councilman Garfield and carried, the matter was laid oit the table to get a report from the License Collector. There being no further business on motion of Councilman Hilmer seconded by Councilman Garfield and carried, the meeting adjourned to 7:30 o'clock P. The City Council of the City of Newport Beach met in regular adjourned session at 7:30 o'clock P. Pd. on the above date. The meeting was called to order by Mayor Johnson. The roll was called showing the full Council present. The .Minutes of the previous meeting of November 2nd were read and. approved as read. The report of License Collector Summers in regard to the wells at the Refinery was read, and on motion of Councilman Claire seconded by Councilman Garfield and carried, the report was accepted and filed, 'and the License Collector instructed to collect the balance of $300.00 due on the other.three wells. The report of the Harbor Haster in regard to the mooring of boats a,s complained of by G. A. R. Lewington at the last meeting was read, and it appearing that the vessels are moored according to the terms of the permit. On motion of Councilman Claire seconded by Councilman Garfield and carried, the report was accepted and together with the letter of Mr. Lewington, filed. The report of R. L. Patterson, City Engineer reporting on 'the cost of removing the sand and replacing the water and sewer pipes in Blocks B and C in Tract 515 was read,' and as the cost was considerable for which no provision was made in the budget, on motion of Councilman ' Garfield seconded by Councilman Ellsworth and carried, the report was accepted and filed together with the letter of 0. E.ogrown. The co::uaunications were read and acted upon as follows: A petition re_oresenting 124 lot owners on Balboa Island asking that the break in the seawall on the northwest corner of Balboa Island be repaired, was taken up, and some of the property owners were present and stated there was urgent need for such improvement. After carfully considering the matter on motion of Councilman Hilmer seconded by Councilman Claire and carried, the City Engineer was instructed to make temporary provision for keeping the seawater out until such time as more permanent improvements can be arranged for. c 370 On motion of Councilman Hilmer seconded by Councilman Claire and carried the City Engineer was instructed to send out notices, particularly to the bay front property owners in that district, to ascertain if they are willing to pay for a new seawall, and report at the next meeting. On motion of Councilman Claire seconded by Councilman Garfield and carried, the reauest of the City Clerk for two weeks vacation, was allowed. The request of the Crandall Bo ,-.t Co. for permission to construct a Marine Railway in front of their boat shop, was considered, and on motion of Councilman Claire seconded by Councilman Hilmer and carried, the request was granted subject to the approval of the Building inspector and City Engineer. On motion of Councilman Ellsworth seconded by Councilman Garfield and carried, the communication from Richardson & Dromgold thanking the Engineering Department for arranging to keep the flood water out of their building, was filed. On motion of Councilman Claire seconded by Councilman Garfield and carried, the application of D. S. Lloyd for permission to install an underground gasoline storage tank, was allowed subject to the approval of the Fire Chief. The communication from the Newport Harbor Chamber of Com:aerce asking that an appropriation be made out of the unappropriated advertising fund of $150.00 towards the American Legion bugle and drum corps was considered, and on motion of Councilman Hilmer seconded by Councilman Claire and carried, the appropriation was allowed. On motion of Councilman Claire seconded by Councilman Garfield and carried, the communication from Miss Coffin in regard to the Refinery oil wells was filed. On motion of Councilman Garfield seconded by Councilman Claire and carried, the communication from Mayor John C. Porter'of Los Angeles calling a meeting of Mayors and Council representatives of all cities in California, to consider the unemployment situation principally as regards "floaters ", was filed. A communication from Beax & Son offering to lease the 34 acres of water- bearing land recently pruchased and giving the City one - quarter of the bean crop as rental, was considered, and on motion of Councilman Claire seconded by Councilman Hilmer and carried, the communication was laid on the table until next meeting, and the City Attorney instructed to prepare a lease for the next meeting. The communication from E. B. Cubbon and C. E. McFarland asking renewal of their contract for exclusive pier privileges on the Newport and Balboa piers, was considered, and on motion of Councilman Ellsworth seconded by Councilman 'Garfield and carried, the matter was laid on the table until next meeting for consideration. • On motion of Councilman Claire seconded by Councilman Garfield and carried, the application of Lyman Boomer for transfer of his license No. 192 from 21st and Central to 2110 West Central,' was allowed. On motion of Councilman Ellsworth seconded by Councilman Garfield and carried, the application of Ed E-operly for transfer of his license No. 426 from 2616 hest Central to 208 - 21st Street was allowed. UNFINISHED BUSINESS ORDI ?ANCE NO. 395, entitled: AN ORDINANCE OF THE CITY OF NEWPORT BEACH CREATING AND ESTABLISHING FIRE ZONES IN THE CITY OF NEWPORT BEACH. CAME UP FOR FINAL PASSAGE, WAS READ, CONSIDERED, AND UPON THE ROLL BEING called was passed by the following vote, to -wit: AYES, Councilmen Hilmer, Claire, Ellsworth, Garfield, Johnson. NOES, Councilmen None. ABSENT, Councilmen None. NEIL BUSINESS On motion of Councilman Claire seconded by Councilman Garfield and carried, a number of demands from the Banks, having been signed and approved by the Finance Committee, were allowed and warrants to be drawn for same. City Attorney Thompson presented an Agreement dated the 12th day of November, 1931, with the Southern Pacific Company, covering an easement for S" drain pipe under their tracks at the extension of 22nd Street, and Councilman Garfield introduced a Resolution accepting the Agreement and authorizing the Mayor and City Clerk to sign and execute the same. The Resolution was read, considered, designated RESOLUTION NO.719, and upon call 69 the roll passed by the following vote, to -wit: 371 AYES, Councilmen Hilmer, Claire, Ellsworth, Garfield, Johnson. NOES, Councilmen None. ABSENT, Councilmen None. Councilman Claire introduced a Resolution accepting an Agree:ient dated the 4th day of November, 1931', with the Pacific Electric Railway Co. for easement for an S" water line under their tracks at Cedar Street, and authorizing the Mayor and City Clerk to sign and execute the same. The Resolution was read, considered, designated RESOLUTION NO. 720, and upon call of the roll _passed by the following vote, to -wit: AYES, Councilmen Hilmer, Claire, Ellsworth, Garfield, Johnson NOES, Councilmen None. ABSENT, Councilmen None. Councilman Claire introduced a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, APPROVING )HAP SHOWING A PORTION OF OCEAN AVENUE IN THE CITY OF NEWPORT BEACH, TO BE CLOSED UP AND ABANDONED. The Resolution was read, considered, designated RESOLUTION NO. 721, and upon call of the roll passed by the following vote, to -wit: AYES, Councilmen Hilmer, Claire, Ellsworth, Garfield, Johnson. NOES, Councilmen None. ABSENT, Councilmen None. Councilmen Ellsworth introduced a Resolution entitled: A RESOLUTIONf OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, DECLARING THEIR INTENTION TO ORDER THE CLOSING UP AND ABANDONMENT OF PORTIONS OF A CERTAIN STREET KNOWN AS OCEAN AVENUE IN THE CITY OF NEWPORT BEACH, DECLARING IT TO BE FOR THE PUBLIC INTEREST AND CONTTEM ENCE, AND FIXING THE TIME AMID PLACE FOR HEARING OBJECTIONS TO SAID PROPOSED I1IPROVEMEN ^1 . The Resolution was read, considered, designated RESOLUTION No. 722, and upon call of the roll passed by the following vote, to -wit: ' AYES, Councilmen Hilmer, Claire, Ellsworth, Garfield, Johnson. NOES, Councilmen None. ABSENT,.Councilmen None. City Engineer Patterson presented a Map of a subdivision of Block B, Bayside Tract for approval, and on motion of Councilman Claire Seconded by Councilman Garfield, and carried, the Map was referred to the Planning Commission. City Engineer'Patterson was granted additional time to report in regard to the bulkhead at the northwest corner of Balboa Island. The reports of the heads of departments were read and on motion of Councilman Claire seconded by Councilman Garfield and carried, the report's were accepted and filed.
