HomeMy WebLinkAbout06/06/1932 - Regular MeetingI 1,. City Hall, Newport Beach, June 6, 1932. The City Council of the City of Newport Beach met in regular session at 7:30 o'clock P. M. on above date. Mayor Hilmer presiding. Councilmen Gordon, Claire, Ellsworth and Hilmer answered the roll call, absent Councilman Garfield. The minutes of the previous meeting were read and approved as read. The reports of the heads of departments were read, and on motion of Councilman Claire, seconded by Councilman Ellsworth and carried, the reports were accepted and filed. Councilman Claire made a report regarding the payment of City employees semi-monthly in which it was,shown that it would entail an extra expenditure of a thousand dollars annually to adopt this plan which was considered inadvisable and on motion of Councilman Gordon, seconded by Councilman Ellsworth and carried the report was accepted. Councilman Claire reported on the question of issuing a year book showing the financial transactions of the City and in consideration of the expense advised against it, and on motion of Councilman Ellsworth, seconded by Councilman Gordon and carried, the report was accepted and filed. Councilman Gordon reported on the building of an office for the Harbor Master's use on the Washington Street pier, asking for more time to consider same. Councilman Gordon asked for more time to consider the Harbor Master's communication of May 23rd regarding the use of aquaplanes on the Bay. City Engineer Patterson made a report in reference to a drinking fountain at Buck Gully in which it was stated that same could be installed by the Water Department at a cost of $98,74 and it was moved by Councilman Claire, seconded by Councilman Ellsworth and carried that the work be done. at a cost not to exceed $100.00. A communication from Secretary. Macleod of the Newport Harbor -Chamber of Commerce to City Treasurer Gant asking for the transfer of funds to the Harbor Publicity account, was, on motion of Councilman Ellsworth, seconded by Councilman Claire and carried, granted. It was moved by Councilman Claire, seconded by Councilman Ellsworth and carried, that the report of the Secretary of the Chamber of Commerce in regard to the Veteran's Hospital be accepted and filed. A communication from H. H. Williamson requesting that the City furnish a float for its representation in the Tournament of Lights was, on motion of Councilman Gordon, seconded by Councilman Claire and carried, referred to the Advertising Committee. A letter from the Commander of the American Legion of San Diego inviting the Mayor and City Council to the La Feria celebration to be held in that city July lst, was on motion of Councilman Claire, seconded by Councilman Ellsworth and carried, referred to Mayor Hilmer. A communication from George H. Ba.ynton complaining about cars being parked in his driveway in Seashore Colony Tract, was on motion of Councilman Claire, seconded by Councilman Ellsworth and carried, referred to the Police Committee. Edwin b:. Williams, Secretary of the Corona Del Mar Property Owner's Association, presented a letter of thanks to the City Council for their prompt action in making repairs to the East Jetty and on motion of Councilman Claire, seconded by Councilman Ellsworth and carried, the same was accepted and filed. Andrew J. Lenox presented a letter in regard to license fees for rooming houses asking for a reduction in same to conform with that of 1930 and on motion of Councilman Claire, seconded by Councilman Ellsworth and carried, the City Clerk was instructed to inform Mr. Lenox that the Ordinance as amended and now in force reeuired a higher rate than existed at that time. The application of Walter Morgan for a permit to operate a drug "store in the Irwin Building Newport Beach, was, on motion of Councilman Gordon, seconded by Councilman Claire and carried, laid on the table for two weeks. The application of B. S. Cummings for a pleasure pier at Lots 5 and 6, Block 334, Canal Section was, on motion of Councilman Claire seconded by Councilman Ellsworth and carried, referred to the City Engineer for report at the next meeting. 421 E. A. Bauer and R. L. Pe,terman presented an application for a pleasure pier at Lot 21, Block 19, Section 3, Balboa Island, and on motion of Councilman Claire, seconded by Councilman Ellsworth and carried, the same, was referred to the City Engineer for report in two weeks. The application of Henry S. Petersen for a permit to construct a pleasure pier at Lot 3, Block 2, Section 4, Balboa ISla.nd was on motion of Councilman Claire, seconded by Councilman Ellsworth and.car.ried, referred to the City Engineer for report in two weeks. Phe application of Halsey Denman for permission to operate a roller skating rink in Balboa was on motion of Councilman Ellsworth, seconded by Councilman Claire and carried, referred to the Police Committee. The application of Henry Helmer for a permit to operate a motion picture theatre in the Allison Building, 114-22nd Street, Newport Beach, was on motion of Councilman Claire, seconded by Councilman Ellsworth and carried, allowed subject to the approval of the Fire Chief. A communication from the referee in bankruptcy regarding Roy Thomas was on motion of Councilman Claire, seconded by Councilman Gordon and carried,.referred to the City Attorney. City Attorney Thompson presented for final passage Ordinance No. 402, known as the 'Tile and Marble Ordinance'. The Ordinance was read and considered and on motion of Councilman Claire seconded by Councilman Ellsworth was adopted by the following roll call vote: AYES: Councilmen Gordon, Claire, Ellsworth and Hilmer. NOES: Councilmen None. ABSENT: Councilman Garfield. City Engineer Patterson presented the application for a permit to construct a pleasure pier by C. A. 'Neighbors with a recommendation that same be granted and on motion of Councilman Claire, seconded by Councilman Ellsworth and carried the same was approved. City Engineer Patterson approved the application of George A. Rogers for a pleasure pier and on motion of Councilman Claire, seconded by Councilman Ellsworth and carried the permit was granted. The application of Roy Lyons for a permit to build a boat slip at the Yacht Basin was on motion of Councilman Claire, seconded by Councilman Ellsworth and carried, referred to the City Engineer for further information regarding its construction. J. H. L:acklin addressed the Council in regard to having certain houses removed from Nardina Street in Seashore Colony Tract and it was moved by Councilman Claire, seconded by Councilman Ellsworth and carried that the Street Superintendent be instructed to 'order the removal of the houses. NEW BUSINESS It was moved by Councilman Claire, seconded by Councilman Ellsworth that Resolution No. 745 rescinding the adoption of plans and specifications as contained in Resolution No. 743 be adopted, the same nas passed by the following roll call vote: AYES: Councilmen Gordon, Claire, Ellsworth and Hilmer. NOES: Councilmen None. ABSENT: Councilman Garfield. A -Labor and Material bond was presented to protect the City in the Construction of a dike at Tract 772 and upon a ruling by the City Attorney that the bond was insufficient, Councilman Claire made a motion which was seconded by Councilman Gordon and carried that the City Engineer be instructed to stop the work until such a time that a bond meeting with the approval of the City Attorney be filed. Insurance policy i4o. 63501 covering certain properties of the City, was on motion of Councilman Claire, seconded by Councilman Ellsworth and carried, approved and ordered filed. The monthly demands on the City Treasurer having been duly signed and approved by the Finance Committee were on motion of Councilman Claire, seconded by Councilman Ellsworth and carried, allowed and warrants to be drawn for same. The terms of two of the members of the Library Board having expired, Mayor Hilmer appointed Mrs. George P. Wilson and Gilbert M. Wright to succeed themselves in that capacity and on motion of Councilman Claire, seconded by Councilman Ellsworth and carried, the appointments were approved. X22 H. E. Perez addressed the City Council regarding the pay being offered by the Southern Counties Gas Co. for certain work being done by them, it being out of the jurisdiction of the City, no action was taken. L. L. Booth and G. 17. Kitzrailler each addressed the Council in regard to plans for the improvement of alleys on Balboa Island, and at the suggestion of City Engineer Patterson a meeting was arranged to go over the matter. A. B. Hohenshell an operator of Live Bait boats from the Newport pier asked that the Council adopt certain schedules in regard to the boats, and on motion by Councilman Claire, seconded by Councilman Ellsworth and carried, the Police Committee was appointed to meet with the boat owners with a view of working out some satisfactory arrangement. City Engineer Patterson reported that 135 feet of pipe costing jp215 would be required for installation on the State Highway and it was moved by Councilman Ellsworth, seconded by Councilman Claire and carried that the Water Superintendent be authorized to install same. There being no further business to come before the Council it was moved by Councilman Claire, seconded by Councilman Ellsworth and 4ND ON carried that an adjournment betaken until 7 :30 o'clock P..M. ' The City Council of the City of Newport Beach met in regular adjourned session at 7:30 P. M. on the above date. The meeting was called to order by Mayor Hilmer. The roll was called showing the full Council present. The minutes of the previous meeting of June 6th were read and approved as read. Councilman Ellsworth as Committeeman to report on certain . requests embodied in a communication from H. H. Ailliamson of the Tourna- ment of Lights Committee, asked for more time to consider the matter. Councilman Ellsworth reported favorably in regard to a float being entered in the Tournament of Lights by the City and on motion of Councilman Ellsworth seconded by Councilman 01&ire and carried, the City Engineer and the City Electrician were appointed to design and build same. Councilman Gordon reporting for the Police Committee in connectim with a complaint from Mr. Baynton regarding the parking of cars in his driveway said the matter had been satisfactorily disposed of. Councilman Gordon asked for more time to report on the fishing boat schedule now under consideration. He also advised that there was no report on the application to operate a roller skating rink in Balboa, no specific location having been given by the applicant. It was moved by Councilman Claire, seconded by Councilman Garfield and carried that the reports be accepted. COi a:UN I CATIONS ' A letter from E. L. Burris in which he objected to certain work alleged to have been done by the City in competition with himself and other local contractors. This was followed by oral discussion on the part of Mr. Burris and members of the Council, and on motion of Councilman Claire, seconded by Councilman Gordon and carried the matter was laid on the table. A Resolution adopted by the Orange County Council of the Anerican Legion urging that all labor performed and materials purchased be done within the boundary of this County, and on motion of Councilman Claire, seconded by Councilman Garfield and carried, the letter was ordered filed.
