City Attorney Thompson brought up the matter of the law suit
now pending for the recovery by cities of the State of California of
their share of the automobile tax collected by the State, and on motion
of Councilman Claire, seconded by-Councilman Garfield and carried, the
City Attorney was authorized to furnish the necessary data in connection
with the City's participation in the suit.

' The City Council of the City of Newport Beach met in regular
adjourned session in the City Council Chamber of the City of Newport
Beach at 7:30 P. M. on above date with Mayor Williamson presiding.
The roll was called showing the full Council present.
REPORTS OF SPECIAL COMMITTEES
Councilman Whitson, Chairman of the Balboa Island Seawall
Committee presented the Minutes of the meeting of that Committee held
on June 4, 1936, and moved that consideration of same be Laid on the
Table; the motion was seconded by Councilman Claire and carried.
REPORTS OF STANDING COMMITTEES None.
COMMUNICATIONS
The application of Hayward Lumber and Investment Company for
permission to install underground storage facilities for the handling
of petroleum products in Block 127, Lake Tract, was on motion of Council-
man Claire, seconded by Councilman Garfield and carried, allowed subject
to the approval of the Fire Chief and Zoning restrictions.
The application of Leo Bachman to install underground storage
facilities for the handling of petroleum products at 3090 West Central
Avenue, was on motion of Councilman Claire, seconded by Councilman
Garfield and carried, allowed subject to the approval of the Fire Chief
and 'Zoning restrictions.
The application of B. D. Shafer to install temporary anchor
piling fronting on. Lot 6, Tract 515, was on motion of Councilman Claire,
seconded by Councilman Whitson and carried, referred to the City Engineer.
. The application of W. D. Fisk for a license to operate a
dining room in the Palisades Tavern, Corona del Mar, was on motion of
Councilman Claire,.seconded by Councilman Garfield and carried, allowed
subject to the approval of the Health Officer.
The application of Harrington and others for a license to
conduct a Pineapple Stand on vacant property in Block B, Balboa Bayside
Tract, was on motion of Councilman Whitson, seconded by Councilman
Claire and carried, referred to the City Attorney for report.

Various applications for permission to sell fireworks during
the Fourth of July period, were on motion of Councilman Claire, seconded
by Councilman Garfield and carried, allowed subject to the approval
and regulation of the Chief of Police.
Various applications for licenses to operate games of skill
and science were presented, and on motion of Councilman Claire, seconded
by Councilman Garfield and carried, were allowed subject to the approval
and regulations of the Polio.eo Committee.
The application of R. G. Smith for a license to operate a
chip game at 2119 Coast Boulevard, was on motion of Councilman Claire,
seconded by Councilman Whitson and carried, denied. '
The request of Fire Chief Crocker that application be made
to the Board of Supervisors of Orange County for radio service from
the Orange County Broadcasting Station was read, and on motion of
Councilman Claire, seconded by Councilman Garfield and carried, the
City Clerk was directed to make the necessary application.
The offer of Albert Barrail to exchange property owned by him
in Block 218, Section B for City owned property in the vicinity of
19th Street and the Bay Front, was presented, and on motion of Council-
man Claire, seconded by Councilman Garfield and carried, the City Clerk
was instructed to advise the writer to the effect that due to existing
statutes the City could not consider the proposition.
The application of Thomas Fox for the position of custodian
of the proposed comfort station at Corona del Mar, was on motion of
Councilman Claire, seconded by Councilman Garfield and carried, referred
to the Street Superintendent.
The petition signed by various merchants of the City protest-
ing the delivery of bakery goods directly to local consumers and allegedly
evading the City license therefor, was on motion of Councilman Claire,
seconded by Councilman Whitson and carried, referred to the Pblioe
Committee.
The letter of Thomas Dawe of Santa Barbara extending an
invitation to the Mayor and Councilmen to attend the Spanish Days
Fiesta in that City, was on motion of Councilman Claire, seconded by
Councilman Whitson and carried, ordered filed. ,
The application of Edmund Locke for permission to construct
a pleasure pier fronting on Lots 18 and 19, Block P, Tract 518, was
on motion of Councilman Claire, seconded by Councilman Whitson and
carried,•referred to the City Engineer.
The inquiry from the City of Anaheim regarding the sale of
a street sweeper to this City, was on motion of Councilman Claire,
seconded by Councilman Whitson and carried, ordered filed.
The communication of the U. S. District Engineer approving
the City's application for permission to install certain cast iron
sewer mains across the channel at Clushouse Avenue, was on motion of
Councilman Claire, seconded by Councilman Garfield and carried,
ordered filed.
UNFI.;ISHED rsUSINESS
The application of James R. Fouch for permission to construct
a pleasure pier fronting on Lot 16, Block 16, Section 3, Balboa Island,
having been approved by the City Engineer, was on motion of Councilman
Claire, seconded by Councilman Garfield and carried, allowed.
The application of G. H. Crawford for permission to repair
and rebuild temporarily and construct a new float fronting on Lots 3
and 4, Block 10, Section 1, Balboa Island, having been approved by
the City Engineer, was on motion of Councilman Claire, seconded by
Councilman Garfield and carried, allowed.
The application of Paul J. Howard for permission to construct
a pleasure pier fronting on Lots 6, 7 and g, Tract 626, having been
approved by the City Engineer, was on mo-tion of Councilman Claire,
seconded by Councilman Garfield and carried, allowed.
The application of �Iilliam H. Brauner for permission to
construct a pleasure pier fronting on Lo-t C -33, Corona del Mar, having
been approved by the City Engineer, was on motion of Councilman Claire,
seconded by Councilman Garfield and carried, allowed.
The application of Smith Bros. for permission to construct and
maintain a ramp and floats, fronting on Lots 14 and 15, Block 220,
Section A, Newport Beach, having been approved by the City Engineer,
was on motion of Councilman Claire, seconded by Councilman Garfield
and carried, allowed.

Ordinance No. 442, being an ordinance regulating the parking of
motor vehicles on Marine Avenue, Balboa Island, came up for final passage,
the adoption of the ordinance being moved by Councilman Claire, seconded
by Councilman Whitson and passed by the following vote, to -wit:.
AYES: Councilmen Gordon, Claire, Whitson,.Garfield, Williamson.
NOES: Councilmen None.
ABSENT: Councilmen None.
Ordinance No. 443, being an ordinance amending Section 23 of
License Ordinance No. 393, came up for final passage, the adoption of the
ordinance being moved by Councilman Claire, seconded by Councilman Whitson
and passed by the following vote, toz.,*it:
.AYES: Councilmen Gordon, Claire, Whitson, Garfield, Williamson.
NOES: Councilmen None.
ABSENT: Councilmen None.
Upon a motion by Councilman Gordon that an emergency now exists
due to many taxpayers being unable to pay their taxes, or redeem their
property from sale to the City for delinquency, and acting is accordance
with Section 1 of Article IV of the Constitution, it is necessary in order
to redeem this property that the City of Newport Beach adopt an ordinance
forthwith in order that the above mentioned delinquent tax payers may
take advantage of the rights granted by this act. The motion was seconded
by Councilman Garfield, and passed by the following vote, to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Garfield, Williamson.
NOES: Councilmen None.
ABSENT: Councilmen None.
City Attorney Thompson presented an Emergency Ordinance, being an
ordinance adding new sections to Tax Ordinance No. 428, said new sections
being designated 29aa, 28bb, 26cc, 28dd, 28ee, 26ff, 28gg, 28hh, 28ii and
28jj. The Ordinance was considered togetherwith the urgency thereof
and designated Ordinance No. 444, the adoption of same being moved by
Councilman Gordon, seconded by Councilman Garfield and passed by the
following vote, to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Garfield, Williamson.
NOES: Councilmen None.
ABSENT: Councilmen None.
On motion of Councilman Claire, seconded by Councilman Whitson
and carried, the City Clerk was instructed to advertise for bids for one
12 ton Ford V -8 Truck; one Chevrolet 4 -door sedan; one Ford V-8 Coupe,
and one Ford V -8 Pick -up.
NEW BUSINESS
The agreement presented by the Hamasi Corporation relating to
certain delinquent lots in Corona del Mar and signifying their willingness
to execute a purchase agreement in connection with same, was on motion of
Councilman Claire, seconded by Councilman Garfield and carried, ordered
filed.
City Attorney Thompson presented a Tax Deed from J. C. Lamb,
Tax Collector for the County of Orange granting to the City of Newport
Beach certain real property as shown upon a map of "Resubdivision of
Corona del Mar" as recorded in Book 4, page 67 of Miscellaneous Maps,
Records of Orange County, togetherwith a resolution accepting same on
behalf of the City of Newport Beach. The resolution was considered and
designated Resolution No. 966 and on motion of Councilman Claire,
seconded by Councilman Whitson, was passed by the following vote, to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Garfield, Williamson.
NOES: Councilmen None.
ABSENT: Councilmen None.
City Attorney Thompson presented an ordinance, being an ordinance
relating to the offer of the Hamasi Corporation of Los Angeles, California,
to purchase from the City of Newport Beach certain real property situated
in the City of Newport Beach and shown in "Resubdivision of Corona del
Mar" as per map recorded in Book 4, page 67 of Miscellaneous Maps, Records
of Orange County, California; and furthermore to give notice to the public
through publication of the ordinance of the intention of the City of
Newport Beach to execute said agreement with the Hamasi Corporation.

On motion of Councilman Claire, seconded_by Councilman
Whitson, the ordinance which was designated Ordinance No. 445, was
passed to the hecond' reading, by thetfollowing vote, to -wit
AYES: Councilmen Gordon, Claire, 4hitson, Garfield, Williamson.
NOES: Councilmen None.
ABSENT: Councilmen None.
City Attorney Thompson presented a communication from the
Firemen's Fund Insurance Company regarding certain.insurance respecting
City owned marine property. On motion of Councilman.Garfield, seconded
by Councilman Gordon and carried, the matter was referred to the City
Attorney for report.
City Engineer Patterson presented an application from:J. A.
Beek and L. W. Briggs for a deed of Right of Way from the City of
Newport Beach for .road purposes, being a portion of the road leading
from the State Highway to Harbor Island. On advice of the City Attorney,
it was moved by Councilman Claire, seconded by Councilman Whitson and
carried, that the application be referred to the Planning Commission
for approval.
