HomeMy WebLinkAbout04/22/1937 - Adjourned Regular MeetingME Newport Beach, April 22, 1937• The City Council of the City of Newport Beach met in adjourned regular session in the City Council Chambers, at the City Hall in the City of Newport Beach at 10 o'clock A. M. on above date with Mayor Williamson in the Chair. The roll was called and the following Councilmen answered present: Councilmen Gordon, Claire, Whitson, Williamson. Absent: Coun- t oilman Garfield. \ REPORTS OF SPECIAL COMMITTEES Councilman Gordon reported on the condition of the landing on the Newport paler, advising that cable and other materials were needed to put the landing in condition. Whereupon it was moved by Councilman Claire, seconded by Councilman Gordon and Carried, that the Street Superintendent be given power to act in the matter. REPORTS OF STANDING COMMITTEES Councilman Whitson brought up the question of re- zoning the Fire Districts in a portion of the Balboa section, whereby Class C construction would become allowable. The matter was discussed at length, Mayor Williamson offered objections to changing the classification: the Council was also addressed on the subject by Mr. Small of the Board of Underwriters, L. W. Briggs and others. The question was laid over to New Business. COMMUNICATIONS The application of 'Wyman Smelser for a license to operate a restaurant and delicatessen in the Kepke Building at 206 Palm Street, was on motion of Councilman Claire, seconded by Councilman Whitson and ' carried, allowed subject to the approval of the Health Officer. The communication of Blanche W. Harvey regarding a request for a set -back variance for Lot 32, Tract 742, Balboa Island, was read and the matter discussed by the Council, City Engineer, City Attorney, L. W. Briggs,and Grainger Hyer. On motion of Councilman Claire, seconded by Councilman Whitspn and carried, the matter was referred to the Planning Commission. The letter of Wm. R. Hessell, Pastor of Christ Church, commend- ing the ruling of Attorney General Webb regarding certain games, was read, and on motion of Councilman Claire, seconded by Councilman Gordon and carried, the letter was ordered filed. The invitation of Mayor Shaw of Los Angeles for the City to be represented at the Mayors Regional Conference of Mayors to be held on May 6th was presented, and on motion of Councilman Claire, seconded by Councilman Whitson and carried, Mayor Williamson was authorized to attend the convention. Grainger Hyer addressed the Council concerning the proposed widening of Marine Avenue, Balboa Island, and advised that deeds had been secured from all property owners but two on the east side of the street and all but three on the west side, but expressed an opinion that the rest of the deeds could be secured without difficulty. UNFINISHED BUSINESS 'The matter of changing the classification of building restric- tions between Adams and A Streets and North of Bay Avenue in the Balboa section, was brought up and considered and discussed from various angles, after which Councilman Whitson moved the adoption of an ordinance effect - ing the change as petitioned for by the pro arty owners in the district. the ordinance was designated Ordinance No. 453, the motion for adoption being duly seconded by Councilman Claire and was passed by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson. NOES: Mayor Williamson. ABSENT: Councilman Garfield. 360 MEN BUSINESS Attorney Guy Eddy appearing in behalf of E. E. Marshall, presented a check in the sum of one thousand dollars, being payment for certain lots in Tsact 772, and in accordance with a tentative agreement on the part of the purchaser and the City of Newport Beach. City Attorney Thompson presented an ordinance respecting certain amentments to License Ordinance No. 393, the ordinance was read and considered and on motion of Councilman Claire, seconded by Councilman Whitson, was passed to the second reading by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Williamson. NOES: Councilmen None. ABSENT: Councilman Garfield. City Attorney Thompson presented an ordinance, being a TaI Moratorium Ordinance, the ordinance was read and considered and on, motion of Councilman Claire, seconded by Councilman Gordon was passed to the second reading by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Williamson. NOES: Councilmen None. ABSENT: Councilman Garfield. The ordinance known as the Dog Ordinance was presented for final passage and after the reading of same and due consideration, the ordinance was designated Ordinance No. 454, and on motion of Councilman Claire, seconded by Councilman Gordon, the same was adopted by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Williamson. NOES: Councilmen None. ABSENT: Councilman Garfield. Resolution No. 1127 was presented, being a resolution accept- ing the offer of Muriel White for Lot 3, Block 741, Corona del Mar in the City of Newport Beach, as shown on Map recorded in Book 3, pages ' 41 and 42 of Miscellaneous Maps, Records of Orange County, California and providing further for the payment of a commission to Arthur H. Pease for negotiating. the sale of said real property. The adoption ofe-t esolutiou was moved by Councilman Claire, duly seconded by Councilman Whitson and was passed by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Williamson. NOES: Councilmen None. ABSENT: Councilman Garfield. Resolution.Mo..1128 was presented, being a resolution accept- ing the offer of Grace Gray for Lots 9 and 11, Block 333, Corona del Mar in the City of Newport Beach, as shown on Map recorded in Book 3, pages 41 and 42 of Miscellaneous Maps, Records of Orange County, California. The adoption of the resolution was moved by Councilman Claire, seconded by Councilman Whitson and passed by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Williamson. NOES: Councilmen None. ABSENT: Councilman Garfield. Councilman Claire moved the adoption of a Resolution, being a resolution authorizing the Mayor and City Clerk to execute on behalf of the City of Newport Beach a quitclaim deed in favor of H. A. Wallace, E. R. Berberet, & Bernice Stein, Trustees for Reliable & Loan Assn, and covering the Northeasterly 50 feet of Lots 12 and 13, Block 20, ' First Addition to Newport Beach, as shown in Map Book 3, page 27, records of Orange County, California. The motion was duly seconded by Councilman Whitson and the resolution passed by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Williamson. NOES: Councilmen None. ABSENT: Councilman Garfield. I, Frank L. Rinehart, City Clerk of the City of Newport Beach, hereby certify that the above and foregoing resolution was passed and adopted by the City Council of the City of Newport Beach at an adjourned regular meeting thereof held on the 22nd day of April, 1937. City Clerk of the city of Newport Beach HIT Resolution No.2129 authorizing the Mayor and City Clerk to execute on behalf of the City of Newport Beach a contract for furn- iehing water to 1. Oka„ under certain stipulated conditions, was presented, and on motion of Councilman Claire, seconded by Councilman Gordon, the resolution was adopted by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Williamson. NOES: Councilmen None. ABSENT: Councilman Garfield. City Engineer Patterson presented a report on the completion of the new water well, and recommended that the demand of the drillers, B. F. Page et al, be allowed in accordance with the contract for same. On,motion of Councilman Claire, seconded by Councilman Whitson and carried, the demand was allowed, the warrant ordered drawn for same and the report of the City Engineer ordered filed. Sam Myers addressed the Council concerning the advertising of the delinquent tax list, and after some discussion it was moved by Councilman Gordon, that an ordinance providing for said publication of said delinquent tax list be adopted. The motion was duly seconded by Councilman Whitson and the ordinance passed to the second reading by the following vote, to -wit:. AYES: Councilman Gordon, Claire, Whitson, Williamson, NOES: Councilmen None. ABSENT: Councilman Garfield. .City Engineer Patterson reported on the proposed dredging of the Grand Canal on Balboa Island, Grainger Hyer also talked on the subject.
