The City Council of the city of Newport Beach met in regular session
in the City Council Chambers at the City Hall in the City of Newport Beach at
7:30 P. M. on above date with Mayor Williamson in the Chair.

The report of the City Treasurer was read, and on motion of Councilman
Claire, seconded by Councilman Gordon and carried, the report was accepted, the
reading of reports of other heads of Departments dispensed with and all the
reports ordered filed.

Approving
City Engineer Patterson presented a re uest for approval of increase
salary increases
in salary for Mike Ortego, dredge operator from 3135 00 to $175 00 per month;
Kenneth Siegel as pump man in Sewer Department from $125.00 to $135.00 per
month; emplpking,part time labor on emergency work in the Water Department
at a rate of $4.00 per day and the employment of Harry E. Rider on the City
dredge at a salary of $125.00 per month. On motion of Councilman Claire,
seconded by Councilman Gordon and carried, the request was approved but-in-
the case of the advance for the Dredge operator to apply only when employed
in that particular work.

The ordinance amending Sections 19, 22, 25 and 26 of Plumbing
Plumbing
Ordinance No. 379 came up for final passage, being an ordinance providing
for the holding of examinations for Master and Journeyman Plumbers, dates
of holding said examinations and fees to be charged therefor, together
with provisions for the issuing of certificates to do plumbing work in
the City of Newport Beach. The ordinance was read in its entirety, desig-
nated Ordinance No. 463, the adoption of same being moved by Councilman
Gordon, duly seconded by Councilman Whitson and was passed by the following
vote, to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson.
NOES: Councilmen None.

Electrical
The ordinance amending ctions 4 and of Electrical Ordinance
No, 395 came up for final passage, being an ordinance prescribing dates for
the holding of examinations for Master and Journeyman Electricians, fees to
be charged for same and the issuing of certificates for doing electrical
work in the City of Newport Beach. The ordinance was read in its entirety,
designated Ordinance No. 464, the adoption of same being moved by Council-
man Gordon, duly seconded by Councilman Whitson and was passed by the
following vote, to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson.
NOES: Councilmen None.

Demands
The monthly demands having been duly audited by the Finance
Committee, were on motion of Councilman Claire, seconded by Councilman
Gordon and carried, allowed and warrants ordered drawn for same.

City Engineer Patterson presented a written report recommending
dredge pump
the acceptance and payment for the 9 inch dredge pump and 120 H -P Diesel
engine and other equipment in accordance with the specifications and
contract between the City of Newport Beach and the Brown -Bevis Equipment
Company of Los Angeles, dated November 4, 1937•
On motion of Councilman Claire, seconded by Councilman Gordon
and carried, the report of the City En ineer was accepted, the demand of
the Brown -Bevis Equipment Company for $5,168 .00'allowed and warrant
ordered drawn for same.

Corona Del Mar, as shown on a Map recorded in Book 3, pages 41 and 42 of
Miscellaneous Maps, records of Orange County, California; and
WHEREAS, the said price is a fair and adequate price as and for the
purchase price of said lot; and
WHEREAS, the City Council of the City of Newport Beach deem that it
is for the best interests of said City that said property be sold for the said
sum of $400.00; and
WHEREAS, the price offered is just, fair, and adequate and is not

Protests in City Attorney Thompson advised that this was the time to consider
connection with protests in connection with the vacation of a portion of certain alley in
vacation of Block 10 as shown on a map of East Newport Addition, recorded in Book 3,
alley page 37 of Miscellaneous Maps, records of Orange County, California. Whereupon
the City Clerk advised that no protests had been filed with him; the Mayor
then asked if anyone present desired to protest the proceedings. No one
responded. Whereupon Councilman Claire moved the adoption of Resolution
Res. .1233 No. 1233, being a Resolution Ordering Improvement. The motion was duly
seconded by Councilman Gordon and the resolution adopted by the following
vote, to -wit:
AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson.
NOES: Councilmen None.
ABSENT: Councilmen None.
A.L.Woodill On motion of Councilman Claire, seconded by Councilman Gordon
alley in Blk and carried, the City Engineer was directed to communicate with A. L.
10, East Blk Woodill owner of certain property required for the providing of more
suitable access of the westerly end of the alley in Block 10, East Newport.
City Engineer Patterson Brought up the matter of the widening
Widening Marine of Marine Avenue on Balboa Island by the use of the State Gas Tax Fund,
Avenue the question of securing the remainder of the deeds for the 10 foot
strips on either side of said Marine Avenue being discussed, and it was
moved by Councilman Claire, seconded by Councilman Brown and carried,
that the City Attorney be instructed to check up on those deeds not yet
secured and if not all are received by February 15th to start condemnation
proceedings for same.
Minute Resolution Councilman Claire moved the adoption of a resolution, being a
Widening of resolution accepting and approving the Specifications and Contract
Marine Ave. Documents as submitted by the City Engineer for widening of Marine Avenue
Northerly of Balboa Avenue, Balboa Island. The motion was duly seconded
by Councilman Whitson and the resolution adopted by the following vote,
to -wit:

NOES: Councilmen None.

Res. 1234 City Engineer Patterson presented a resolution, being a resolution
Wage Scale for setting foth Wage Scale in pursuance to statute in connection with the
widening of widening of Marine Avenue, Northerly of Balboa Avenue, Balboa Island for
Marine Ave, which bids are about to-be called for. The resolution was considered,
designated Resolution No. 1234 and on motion of Councilman Claire, seconded
by Councilman Whitson, was adopted by the following vote, to -wit:

ABSENT: Councilmen None.
On motion of Councilman Claire, seconded by Councilman Whitson
and carried, the City Clerk was instructed to advertise for bids for the
widening of Marine Avenue Northerly of Balboa Avenue, Balboa Island, if
and when the rights of way for same are secured.
Res. 1235 Resolution No. 1235. A Quitclaim Deed dated the 1st day of
February, 1938, from OrtANGE COUNTY IMPROVEMENT ASSOCIATION, a corporation,
to the city of Newport Beach, a municipal corporation of the sixth class,
remising, rbleasing and quitclaiming to the city of Newport Beach all that
certain real property situated in the city of Newport Beach, County of
Orange, State of California, and more particularly described as follows,
to -wit: Lot 20 (except R. R. ), Block 30, Newport Beach, as shown on a
map recorded in Book 3, page 26 of Miscellaneous Maps, records of Orange
County, California. Lot 3, Block 1-440 Canal Section, Newport Beach, as
shown on a map recorded in Book 4, page 98 of Miscellaneous Maps, Records
of Orange County, California, was presented- to the City Council of the
city of Newport Beach, California.
WHEREUPON, Councilman Claire made a motion, duly seconded by
Councilman Gordon and carried, that said Quitclaim Deed be- accepted by
the City of Newport Beach, and that the City Clerk be instructed to
record the same forthwith with the County Recorder of Orange County,
California:

from EASTSIDE BUILDING & FINANCE COMPANY, a former California corporation, which on
December 11th, 1937, filed in the office of the Secretary of State its certificate
of winding up and dissolution, to the City of Newport Beach, a Municipal corporation
of the sixth class of the State of California, remising, releasing and quitclaiming
to the city of Newport Beach all that certain real property situated in the city of
Newport Beach, County of Orange, State of California, and more particularly
described as follows: Lot 1 in Block 440 of Corona Del Mar, as shown on a Map
recorded in Book 3, pages 41 and 42 of Miscellaneous Maps, Records of Orange

Newcomb case.
Newcomb versus the City of Newport Beach, wherein the Supreme Court had
rendered a decision favorable to the City.
In the matter of the approval of the Map of Tract 1007, presented

City of Newport Beach a certain License Agreement dated the 17th day of January,
1935, wherein, The Irvine Company is referred to as Licensor and the City of

WHEREAS, said License Agreement provides that the Licensor, upon the terms
and conditions in said agreement specified, grants to the Licensee the right to
erect, construct and maintain an aerial radio receiving tower on that certain real
property described as follows: A parcel of land in Block 94 of Irvine Subdivision,
as shown upon a map recorded in Book #1, page 55 of Miscellaneous Maps, Records of
Orange County, California, more particularly described as follows: Beginning at a
point which point is 230 feet North and 45 feet West from the intersection of the
Northerly prolongation of the center line of Marine Avenue, as shown upon a map of
Section 4, Balboa Island, recorded in Book 7, page 37 of Miscellaneous Maps, Records
of Orange County, and the center line of Bayside Drive; thence West 20 feet; thence
North 20 feet; thence East 20 feet; th South 20 feet to the point of beginning.
Containing 400 square feet, together with the right of ingress and egress to the
State highway for automobiles, trucks and other motor vehicles over the lands of ,
the Licensor, with the further right to construct and maintain proper wires and
wiring system from the poles of the Southern California Telephone Company to and
