February 7, 1938. • The City Council of the city of Newport Beach met in regular session in the City Council Chambers at the City Hall in the City of Newport Beach at 7:30 P. M. on above date with Mayor Williamson in the Chair. ' The roll was called, the following Councilmen answering present: Roll Call Gordon, Claire, Whitson, Brown, Williamson. Absent: Councilmen None. REPORTS OF HEADS OF DEPARTMENTS The report of the City Treasurer was read, and on motion of Councilman Claire, seconded by Councilman Gordon and carried, the report was accepted, the reading of reports of other heads of Departments dispensed with and all the reports ordered filed. REPORTS OF SPECIAL C01VITTEES .None. REPORTS OF STANDING COTVITTEES None. COMMUIUCATIONS �@^ The applications of D. B. Maurice for-permission to construct a D.B.Maurice pleasure pier fronting on Lot 856, Tract 907 (Lido Isle) and of Hugh J. Lowe pier permit to construct a pleasure pier fronting on Lot 3, Block 27, Balboa Eastside Addition, were on motion of Councilman Claire, seconded by Councilman Whitson . and carried, referred to the City Engineer for approval. • The application of the Standard 011 Company for permission to install Standard Oil Ci additional underground storage for petroleum products on the Storey property petroleum at "A" Street and Bay Front, was on motion of Councilman Claire, seconded by storage ,permit Councilman Gordon and carried, allowed subject to the approval of the Fire Chief. The complaint of John L. Klenk of the lack of drainage for storm John L.Klenk water at the northeast corner of Balboa Avenue and the Grand Canal, Balboa storm drainage Island, was referred to the Street Department which had already looked into the matter, and the letter was ordered filed. The request of Earl D. Killion and Alfred E. Rogers that they be Earl D.Killion notified of any action taken by the City Council in reference to the case of Alfred Rogers Bartholomae Oil Corporation versus Seager, was on motion of Councilman Gordon, Seager case. seconded by Councilman Claire and carried, ordered filed. The application of Frank L. Smith to lease certain City property Frank L.Smith lying between the.Coast Highway and the channel north of Lido Isle for boat application to anchorage purposes, was on motion of Councilman Whitson, seconded by Council- lease land. man Gordon and carried, referred to a Committee to be appointed by the Mayor. The application of Irwin Construction Company to lease certain city Irwin Const.Co owned property on the north side of the Newport Harbor Channel adjacent to the application to State Highway for the purpose of installing a trailer park., was on motion of lease land. Councilman Claire, seconded by Councilman Brown and carried, referred to a Committee to be appointed by the Mayor. In connection with the above applications-to lease City owned Committee on property, Mayor Williamson appointed Councilman Gordon,Chairman and Councilman Land leasing. Whitson as member of a committee to investigate and report on same. The letter of the Alta San Rafael Company requesting the removal of Alta San certain trees from the parkway fronting on Lots 12 and 13, Block 3, Section Rafael Co. 5, Balboa Island, was presented and on motion of Councilman Claire, seconded trees in park- by Councilman Whitson and carried, the City Engineer was authorized to remove way. the trees at the expense of the owners of the property. The communication of the U.S. District Engineer in reference to U.S.Dist.Eng. alleged oil pollution in the westerly arm of Newport Bay and outlin .ing Oil pollution certain suggestions for the prevention of same, was presented. Whereupon City Engineer Patterson reported on the feasibility of the suggested plans ' and the probable cost of same, and after considering the matter it was moved by Councilman Claire, seconded by Councilman Whitson and carried, that the City Engineer be authorized to proceed with the construction of the prevent- ative measures necessary. The request of the Advertising Committee of the Newport Harbor Chamber of Chamber of Commerce to subscribe for a full page in the 50th Anniversary Commerce • Edition of the Long Beach Press - Telegram and setting forth the advertising advertising. value of same, was presented and after due consideration it was moved by Councilman Whitson, seconded by Councilman Claire and carried, that same be allowed. A petition carrying the names of property owners in the vicinity Petition of Palm Street and Bay Avenue and protesting the licensing of the amusement Noise from apparatus known as 'Loop the Loop' was presented, and on motion of Councilman Fun Zone. Gordon, seconded by Councilman Brown and carried, was referred to the Police Committee. The application of the City Planning Commission for an appropriation Planning Corn. of $600.00 to defray the expense to counsel and a study of traffic conditions, appropriation was presented, Dr. Howard W. Seager, Secretary of the Planning Commission and Fred Storey each addressing the Council concerning the request. After some discussion it was moved by Councilman Gordon, seconded by Councilman Claire and carried, that same be Laid on the Table until the next meeting of the Council. The request of the Balboa Yacht Club for an appropriation of Balboa Yacht $250.00 for their Trophy Fund was presented, and on motion of Councilman Club Claire, seconded by Councilman Gordon and carried, was Laid on the Table appropriation until the time for making up the Budget for the fiscal year. .The request of the Balboa Island Yacht Club for an appropriation Balboa Island ' of $200.00 for their Trophy Fund for the year 1938, was presented, and on Yacht Club motion of Councilman Claire, seconded by Councilman Gordon and carried, appropriation was Laid on the Table until the time for making up the Budget for the • fiscal year. The request of A: J. Twist, Treasurer of the Tournament of Lights Tournament of Association for an appropriation of $1,750.00 for the annual Tournament of Lights Assn. Lights, was presented, and on motion of Councilman Claire, seconded by appropriation Councilman Gordon and carried, was Laid on the Table until the time for making up the Budget for the fiscal year. 50 Approving City Engineer Patterson presented a re uest for approval of increase salary increases in salary for Mike Ortego, dredge operator from 3135 00 to $175 00 per month; Kenneth Siegel as pump man in Sewer Department from $125.00 to $135.00 per month; emplpking,part time labor on emergency work in the Water Department at a rate of $4.00 per day and the employment of Harry E. Rider on the City dredge at a salary of $125.00 per month. On motion of Councilman Claire, seconded by Councilman Gordon and carried, the request was approved but-in- the case of the advance for the Dredge operator to apply only when employed in that particular work. UNFINISHED BUSINESS Ord. No.463 The ordinance amending Sections 19, 22, 25 and 26 of Plumbing Plumbing Ordinance No. 379 came up for final passage, being an ordinance providing for the holding of examinations for Master and Journeyman Plumbers, dates of holding said examinations and fees to be charged therefor, together with provisions for the issuing of certificates to do plumbing work in the City of Newport Beach. The ordinance was read in its entirety, desig- nated Ordinance No. 463, the adoption of same being moved by Councilman Gordon, duly seconded by Councilman Whitson and was passed by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. NOES: Councilmen None. ABSENT: Councilmen None. Ord. No 464 Electrical The ordinance amending ctions 4 and of Electrical Ordinance No, 395 came up for final passage, being an ordinance prescribing dates for the holding of examinations for Master and Journeyman Electricians, fees to be charged for same and the issuing of certificates for doing electrical work in the City of Newport Beach. The ordinance was read in its entirety, designated Ordinance No. 464, the adoption of same being moved by Council- man Gordon, duly seconded by Councilman Whitson and was passed by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. NOES: Councilmen None. ABSENT: Councilmen None. NEW BUSINESS Demands The monthly demands having been duly audited by the Finance Committee, were on motion of Councilman Claire, seconded by Councilman Gordon and carried, allowed and warrants ordered drawn for same. Accepting City Engineer Patterson presented a written report recommending dredge pump the acceptance and payment for the 9 inch dredge pump and 120 H -P Diesel engine and other equipment in accordance with the specifications and contract between the City of Newport Beach and the Brown -Bevis Equipment Company of Los Angeles, dated November 4, 1937• On motion of Councilman Claire, seconded by Councilman Gordon and carried, the report of the City En ineer was accepted, the demand of the Brown -Bevis Equipment Company for $5,168 .00'allowed and warrant ordered drawn for same. City Attorney Thompson presented an ordinance, being AN ORDINANCE lst reading OF THE CITY OF NEWPORT BEACH, PROVIDING FOR THE LEVY AND COLLECTION FOR of Ordinance EACH FISCAL YEAR OF A TAX OF TEN CENTS (10¢) ON EACH ONE HUNDRED DOLLARS to make Park ($100.00) OF ASSESSED VALUATION, FOR MUNICIPAL PURPOSES; PROVIDING THE 100 per Hundred MANNER OF USING SUCH TAX, AND THE TIME OF COLLECTION THEREOF, AND ORDERING THE SUBMISSION OF THIS ORDINANCE TO ELECTORS OF THE CITY OF NEWPORT BEACH AT A GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY OF NEWPORT BEACH ON THE 12TH DAY OF APRIL, 1939; AND REPEALING ORDINANCE NO. 390 OF THE CITY OF NEWPORT BEACH AND ALL OTHER ORDINANCES IN CONFLICT WITH THIS ORDINANCE. Williamson Mayor of the city of Newport Beach Protests in City Attorney Thompson advised that this was the time to consider connection with protests in connection with the vacation of a portion of certain alley in vacation of Block 10 as shown on a map of East Newport Addition, recorded in Book 3, alley page 37 of Miscellaneous Maps, records of Orange County, California. Whereupon the City Clerk advised that no protests had been filed with him; the Mayor then asked if anyone present desired to protest the proceedings. No one responded. Whereupon Councilman Claire moved the adoption of Resolution Res. .1233 No. 1233, being a Resolution Ordering Improvement. The motion was duly seconded by Councilman Gordon and the resolution adopted by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. NOES: Councilmen None. ABSENT: Councilmen None. A.L.Woodill On motion of Councilman Claire, seconded by Councilman Gordon alley in Blk and carried, the City Engineer was directed to communicate with A. L. 10, East Blk Woodill owner of certain property required for the providing of more suitable access of the westerly end of the alley in Block 10, East Newport. City Engineer Patterson Brought up the matter of the widening Widening Marine of Marine Avenue on Balboa Island by the use of the State Gas Tax Fund, Avenue the question of securing the remainder of the deeds for the 10 foot strips on either side of said Marine Avenue being discussed, and it was moved by Councilman Claire, seconded by Councilman Brown and carried, that the City Attorney be instructed to check up on those deeds not yet secured and if not all are received by February 15th to start condemnation proceedings for same. Minute Resolution Councilman Claire moved the adoption of a resolution, being a Widening of resolution accepting and approving the Specifications and Contract Marine Ave. Documents as submitted by the City Engineer for widening of Marine Avenue Northerly of Balboa Avenue, Balboa Island. The motion was duly seconded by Councilman Whitson and the resolution adopted by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson NOES: Councilmen None. The resolution was considered, designated Resolution No. 1234 and on motion of Councilman Claire, seconded by Councilman Whitson, was adopted by the following vote, to -wit: AYES: Councilmen Gordon, Claire, Whitson, Brown, Williamson. On motion of Councilman Claire, seconded by Councilman Whitson and carried, the City Clerk was instructed to advertise for bids for the widening of Marine Avenue Northerly of Balboa Avenue, Balboa Island, if and when the rights of way for same are secured. A Quitclaim Deed dated the 1st day of February, 1938, from OrtANGE COUNTY IMPROVEMENT ASSOCIATION, a corporation, to the city of Newport Beach, a municipal corporation of the sixth class, remising, rbleasing and quitclaiming to the city of Newport Beach all that certain real property situated in the city of Newport Beach, County of Orange, State of California, and more particularly described as follows, to -wit: Lot 20 (except R. R. ), Block 30, Newport Beach, as shown on a map recorded in Book 3, page 26 of Miscellaneous Maps, records of Orange County, California. Newcomb versus the City of Newport Beach, wherein the Supreme Court had rendered a decision favorable to the City. In the matter of the approval of the Map of Tract 1007, presented Approval of at a previous meeting of the City Council, the same was discussed at length, map of Tract and on motion of Councilman Claire, seconded by Councilman Gordon and 1007. carried, the Map was tentatively ap)roved subject to a certain alley to be dedicated in said Tract being given a width of twenty feet or suitable radii provided at the entrance thereto, together with certain restrictions in connection with the sidewalk fronting on Edgewater Place. Presenting Engineer J. A. Woolley presented a tentative map of Tract 1026, Map of a proposed subdivision of Tract 1006, Corona del Mar.
