TERMS AND CONDITIONS OF ENCROACHMENT PERMIT
1. Encroachment Permits may be taken out by the owner of benefited property or a licensed contractor. A licensed
contractor must provide a "Letter of Authorization" to allow another party to pull a permit. An approved copy of the
permit and construction plan shall be kept at the job site at all times. Work, which has been done prior to issuance of
a permit, is subject to rejection/fine. City reserves the right to void permit if work does not commence within 30 days
after dale of issuance.
2. The Permiltee agrees to defend, indemnify and hold the City, its authorized agent, officers, representatives and
employees harmless from any responsibility, liability, suit or action of any description arising out of any accident, loss
or damage to persons or property occurring as a result of work undertaken under this permit.
3. All work shall be done in accordance with the approved plans, Standard Special Provisions and Standard Drawings
of the City of Newport Beach, and in compliance with all applicable State laws and City ordinances.
4. Permittee guarantees all work performed under this permit to be free of hidden and latent defects. Any failures shall
be corrected within two weeks after notification to the satisfaction of the Public Works Director.
5. A valid State licensed contractor must perform all construction within the public right-of-way, unless waived by the
Public Works Director. A valid State Contractor License Class A can perform any work in the public right-of-way. For
construction or connection to water lines a valid State Contractor License Class C-34 is required. For construction or
connection to sewer lines a valid State Contractor License Class C-42 is required
6. All trenching and/or resurfacing shall conform to City Standard 105-L for parkway/roadway and City Standard 140-L,
in the alley, where a minimum half -alley width resurfacing shall be provided, unless otherwise directed by the Public
Works Dept. Contractors shall obtain permits to perform excavation or trench work from the California Division of
Industrial Safety prior to commencing underground construction as required by Stale law. Walls and faces of all
excavations over 5 feet in depth shall be protected by a shoring system, sloping of the ground, or other equivalent
means. Trenches less than 5 feet in depth shall be guarded when hazardous ground movement may be expected.
7. The Public Works Department Inspectors must inspect all work in the Public right-of-way. Forms and subgrade must
be inspected and approved before concrete is ordered/poured. Sewer, pipelines, and subgrade construction must be
inspected and approved before backfilling, or applicant may be required to excavate site. Separate Utilities
Department or General Services Department inspections may be required depending on scope of work performed.
8. All trench restoration must be inspected by the Public Works Department. No utility installation(s) shall be allowed
over or within 5 feet of any City utilities, unless approved by the Public Works Department. Locate and pothole
existing City -owned utilities (ie water, sewer, or street lighting conduits) to verify locations Maintain a one -foot
clearance over or under existing City -owned utilities. Sewer cleanouts require VCP or PVC SDR35 be used with a
4TT box over the riser
9. Properly lighted barricades must be provided and maintained around all trenches, excavations and obstructions. All
signs, flags, lights and other warning and safety devices shall conform to the requirements of the current "Manual of
Warning Signs, Sights and Other Devices for the Use in Performance of Work Upon Highways issued by the
California Department of Transportation. If needed, barricades can be obtained from the City at a charge of $10.00
per barricade per day, with a minimum charge of $35.00 It is the responsibility of the applicant to place barricades to
protect the general public. Access to fire hydrants must be maintained at all times.
10. Work within or near beach sensitive areas will not be allowed during, City holidays, spring break, Memorial Day
weekend, summer between June 15 and September 15, and during the holiday season from December 19 to
January 1, unless approved by the Public Works Department.
11. Any work that extends into traffic or parking lanes and impedes the normal flow of traffic requires the applicant to
acquire a Temporary Street Closure Permit from the Public Works Department. Access for fire, police and
emergency vehicles must be maintained at all times. Traffic Control must be per Work Area Traffic Control
Handbook (WATCH). No nighttime traffic lane closures, unless prior approval has been granted. Any lane(s) closure
on a major street will only be allowed between 9:00 a.m. and 3:00 p.m. (Monday thru Friday), unless approved by
the Public Works Department. Any work affecting the State Highway's traffic or within the Slate Highway right-of-way
will require a Caltrans Permit. All vehicles shall be lawfully parked.
12 This permit does not authorize the closure of sidewalks. streets, or alleys for construction access. storage of
materials, or parking of construction vehicles unless detailed on an attached Temporary Street Closure.
13. Applicant must notify USA at 1-800-227-2600 2 days before starting any underground construction. Applicant
must notify all affected residents 24 hours in advance of restricted access and any inconveniences.
14. Refuse or unused materials shall be. removed within 24 hours after completion of the work. If not removed, the City
may remove and bill the applicant Coordinate alley closures with City's refuse pick-up days by calling 949-644-3066
for the collection schedule so service is not interrupted. To place a dumpster or materials in the public right-of-way, a
Temporary Street Closure Permit must be obtained from the Public Works Department.

HOLD HARMLESS STATEMENT
I understand that I am locating minor encroachments within the City Right-of-
Way/Easement. As property owner it is my responsibility to maintain the
encroachments. I will be responsible for replacing the improvements if the City

15. Any above ground utility facilities will require documented approval from the adjacent
affected property owner(s).
16 Homeowner, contractors, and subcontracotrs may each be liable for violations of Water
Quality Laws. Best Management Practices will be enforced. It is against the law to
discharge construction debris into the gutter and storm drain. Felony violations of Water
Quality Laws are punishable by fines up to $25,000 and/or up to three years in Stale
prison plus the full cost to clean up an illegal discharge or spill
17. If a refundable deposit was paid, applicant must submit a Soils Compaction
Certificate or Evidence of a Slurried Backfill and request a final inspection from the
Public Works Department. Monies may be held for six months after final inspection
before a refund will be processed.
18. No trees in the public right-of-way shall be planted, removed, trimmed, cr relocated
without approval from the General Services Department.
19. All work in the public right-of-way must meet the approval of the PL:blic 1,-"Jork,
Department or corrections will be required (i.e. removals. exposing connectio;is.
etc.). Additional inspection fees may be required.
20. Permit is for standard materials in the public right-of-way only. unless previously
approved by Public Works and an Encroachment Agreement has been processed.
21. Permit is valid for "description" of work noted on front only. Additional work
performed may require issuance of a separate permit and/or additional fees.
INo work related to this encroachment permit shall be performed until the Public Works Department has issued this permit. Applicant hereby acknowledges he/she has re nd understands the terms and

The following are the additional Encroachment Permit N2018-0450 conditions of
approval for temporary dewatering activity to the high tide line near 1608 W. Ocean
Front:
• Discharge pipe shall be buried a minimum of 36" below grade.
• Contractor shall be responsible to maintain all discharge equipment
(including delineators, fencing, sand anchor and baffle) at all times,
including weekends and holiday. All equipment shall be inspected by the
contractor on a daily basis, including weekends and holidays.
• Any erosion due to the discharge shall be immediately repaired by
contractor and may include sand replenishment.

• A preconstruction meeting with the Public Works inspector, Lifeguard (Batt
Chief Jacobsen, 949.644.3048), Police (Lt. Cartwright, 949.644.3740),
Public Works Inspector (Mike St Clair, 949.870.8133) and Public Works
General Services (Joe Delgado, 949.718.3463) is required prior to any
construction activity on the beach or public right of way.
• A bond in amount of $20,000 shall be submitted and approved by the City
prior to permit issuance.
• Contractor shall request Underground Service Alert prior to any work in the
beach or public right of way. Based on past experience, there is a gas line
near or adjacent to the Ocean Front Walk in this area.
• Contractor shall modify the discharge set up at the direction of the City.
• The contractor shall implement any additional requirements identified by
City Staff.
• Contractor shall limit the initial draw down discharge to 800 GPM maximum
and after draw down the discharge rate shall be reduced to 500 GPM
maximum, per the approved dewatering plan. Contractor shall install a gate
valve to control flows to 800 GPM at draw down and 500 GPM after draw
down. Discharge above 800 GPM is prohibited.
If complaints or other issues arise, the applicant/contractor may be required
to implement alternative discharge methods at the direction of City Staff.
The applicant/contractor shall bare the cost and responsibility for the
implementation of the alternative discharge method.

GREAT FOR MAKING A SAND ANCHOR FOR THE BOAT
Item arrived fast and as described. I will be making sand anchors for boating and this is
just what I needed.
MUCH NEEDED DEVICE FOR OUR BOAT DOCK!
Nice device for holding our boat dock in place. We have attached this to a long pole
which attaches to our dock and this keeps our dock in place. Works excellent and I do
not have to worry about the dock coming into the bank or floating further out during
storms or high water.
THESE WORK FANTASTIC. VERY EASY TO ATTACH TO PIPE
These work fantastic. Very easy to attach to an inch and a quarter. Steel pipe . Drives it
into a sandy rocky bottom lake to attach a waverunner dock

On March 30, 2017, you submitted a complete Notice of Intent to begin discharging wastewater
from various sites under the terms and conditions of the Regional Board's renewed general
permit, Order No. R8-2015-0004.
Effective immediately, you are authorized to discharge wastewater under the terms and
conditions of Order No. R8-2015-0004. Enclosed is Monitoring and Reporting Program (MRP)
No. R8-2015-0004-042, which specifies the frequency of sampling and the constituents to be
monitored.
Although Griffin Dewatering is authorized to discharge under this Order, we highly encourage
you to find beneficial reuse or multiple uses of the water prior to surface water discharge, where
feasible.
Please note that you are required to notify this office five (5) days in advance of any
planned discharge from locations not yet reported, and include all the information in the
permit Notice of Intent (NOI), Page 2 (Part V., "Other Information Required"). If the
discharge source is groundwater, you must analyze a representative sample of the
discharge for the presence of USEPA Priority Pollutants (MRP, Attachment A) and for
constituents with water quality objectives' specified for the receiving water. Please
submit the results for our review prior to commencing discharge. Discharges that exceed
water quality objectives are not covered under this authorization.
Monitoring reports are due by the 30th day of each month. The California Water Code
Section 13261 specifies civil liability may be assessed for failure to submit a report
required under Section 13260. Alternatively, Section 13385 (i) (1) (B) requires the
Regional Board to assess a mandatory minimum penalty of $3,000 for failure to submit a

Attachment E — Monitoring and Reporting Program (MRP)
The Code of Federal Regulations (CFR) at 40 CFR §122.48 requires that all NPDES permits
specify monitoring and reporting requirements. CWC Sections 13267 and 13383 also authorize
the Regional Water Quality Control Board (Regional Water Board) to require technical and
monitoring reports. This MRP establishes monitoring and reporting requirements that
implement the federal and California regulations.
I. GENERAL MONITORING PROVISIONS
A. General Monitoring Provision
1. All sampling and sample preservation shall be in accordance with the current edition
of "Standard Methods for the Examination of Water and Wastewater" (American
Public Health Association).
2. All laboratory analyses shall be performed in accordance with test procedures under
40 CFR 136 (revised as of April 11, 2007) "Guidelines Establishing Test Procedures
for the Analysis of Pollutants," promulgated by the United States Environmental
Protection Agency (EPA), unless otherwise specified in this Monitoring and
Reporting Program. In addition, the Regional Water Board and/or EPA, at their
discretion, may specify test methods that are more sensitive than those specified in
40 CFR 136.
3. Chemical analyses shall be conducted at a laboratory certified for such analyses by
the State Water Resources Control Board in accordance with Water Code Section
13176, or conducted at a laboratory certified for such analyses by the EPA or at
laboratories approved by the Regional Water Board's Executive Officer.
4. The Discharger shall report the results of analytical determinations for the presence
of chemical constituents in a sample using the following reporting protocols:
a. Sample results greater than or equal to the reported ML shall be reported as
measured by the laboratory (i.e., the measured chemical concentration in the
sample).
b. Sample results less than the reported ML, but greater than or equal to the
laboratory's current Method Detection Limit (MDL)', shall be reported as
"Detected, but Not Quantified," or "DNQ." The estimated chemical concentration
of the sample shall also be reported.
c. Sample results not detected above the laboratory's MDL shall be reported as "not
detected" or "ND."
MDL is the minimum concentration of a substance that can be measured and reported with 99 percent
confidence that the analytical concentration is greater than zero, as defined in 40 CFR 136, Appendix B,
revised as of April 11, 2007.

5. The Discharger shall submit to the Regional Water Board reports necessary to
determine compliance with effluent limitations in this Order. The Discharger shall
report with each sample result:
a. The reporting level achieved by the testing laboratory; and
b. The laboratory's current MDL, as determined by the procedure found in 40 CFR
136 (revised as of April 11, 2007).
6. The Discharger shall have, and implement an acceptable written quality assurance
(QA) plan for laboratory analyses. Duplicate chemical analyses must be conducted
on a minimum of ten percent (10%) of the samples, or at least one sample per
month, whichever is greater. A similar frequency shall be maintained for analyzing
spiked samples. When requested by the Regional Water Board or EPA, the
Discharger will participate in the NPDES discharge monitoring report QA
performance study.
7. The Discharger shall assure that records of all monitoring information are maintained
and accessible for a period of at least five years (this retention period supersedes
the retention period specified in Section N.A. of Attachment D) from the date of the
sample, report, or application. This period of retention shall be extended during the
course of any unresolved litigation regarding this discharge or by the request of the
Regional Water Board at any time. Records of monitoring information shall include:
a. The information listed in Attachment D - IV Standard Provisions — Records,
subparagraph B. of this Order;
b. The laboratory which performed the analyses;
c. The date(s) analyses were performed;
d. The individual(s) who performed the analyses;
e. The modification(s) to analytical techniques or methods used;
f. All sampling and analytical results, including
(1) Units of measurement used;
(2) Minimum reporting level for the analysis (minimum level);
(3) Results less than the reporting level but above the method detection limit
(MDL);
(4) Data qualifiers and a description of the qualifiers;
(5) Quality control test results (and a written copy of the laboratory quality
assurance plan);
(6) Dilution factors, if used; and
(7) Sample matrix type.
g. All monitoring equipment calibration and maintenance records;
h. All original strip charts from continuous monitoring devices;
i. All data used to complete the application for this Order; and,
j. Copies of all reports required by this Order.
k. Electronic data and information generated by the Supervisory Control and Data
Acquisition (SCADA) System.

8. Monitoring and reporting shall be in accordance with the following:
a. Samples and measurements taken for the purpose of monitoring shall be
representative of the monitored activity.
b. Whenever the Discharger monitors any pollutant more frequently than is required
by this Order, the results of this monitoring shall be included in the calculation
and reporting of the data submitted in the discharge monitoring report specified
by the Executive Officer.
c. A "grab" sample is defined as any individual sample collected in less than 15
minutes.
d. Daily samples shall be collected on each day of the week.
H. MONITORING LOCATIONS
The Discharger shall establish monitoring locations to demonstrate compliance with the
effluent limitations, discharge specifications, and other requirements in this Order. The
monitoring locations shall be located where representative samples of the discharge can be
obtained.
III. INFLUENT MONITORING REQUIREMENTS — NOT APPLICABLE

Whenever there is a discharge and the Discharger asserts that the discharge percolated
before it reached a stream with aquatic life, the Discharger shall record in a permanent
log the following information: (a) the date(s), time(s), and duration(s) of the discharge;
(b) a description of the location where the discharge(s) percolated into the ground, (c)
the climatic condition in the area during the discharge and (d) the name of the
individual(s) who performed the observation.
For discharges that do reach a stream, the Discharger shall on a weekly basis make
visual observations of the receiving water8 (only when a discharge is occurring) for any
visible oil sheen or coloration of the receiving water. The findings of these observations
shall be recorded in a permanent log.
Copies of the above logs shall be submitted with the required monthly report.
VIII. REPORTING REQUIREMENTS
A. General Monitoring and Reporting Requirements
1. The Discharger shall comply with all Federal Standard Provisions (Attachment D)
related to monitoring, reporting, and recordkeeping.
2. Discharge monitoring data shall be submitted in a format acceptable to the Regional
Water Board. Specific reporting format may include preprinted forms and/or
electronic media. The results of all monitoring required by this Order shall be
reported to the Regional Water Board, and shall be submitted in such a format as to
allow direct comparison with the limitations and requirements of this Order.
3. All monitoring reports, or information submitted to the Regional Water Board shall be
signed and certified in accordance with 40 CFR 122.22 and shall be submitted under
penalty of perjury.
4. Five days prior to any discharge from locations already reported, the Discharger
shall notify the Regional Board staff by phone or e-mail indicating the date and time
of the proposed discharge.
5. Five days prior to any planned discharge9 from locations not yet reported, the
discharger shall notify the Regional Board staff by phone or by a fax letter indicating
the following:
a. Specific type of the proposed wastewater discharge (see listing on Finding 1 of
the Order);
For discharges from monitoring or injection wells, document the visual description of the discharged water
at the point of discharge at the well location.
For those unplanned discharges, as much prior notification as possible is required before any discharge
is initiated.

b. The estimated average and maximum daily flow rates;
c. The frequency and duration of the discharge;
d. The affected receiving water(s);
e. A description of the proposed treatment system (if appropriate); and
f. A description of the path from the point of initial discharge to the ultimate location
of discharge (fax a map if possible);
6. Noncompliance Reporting
a. The discharger shall report any noncompliance that may endanger health or the
environment. Any information shall be provided to the Executive Officer (951-
782-4130) and the Office of Emergency Services (1-800-852-7550) orally within
24 hours from the time the discharger becomes aware of the circumstances. A
written submission shall also be provided within 5 days of the time the discharger
becomes aware of the circumstances. The written submission shall contain a
description of the noncompliance and its cause, the period of noncompliance,
including exact dates and times and, if the noncompliance has not been
corrected, the anticipated time it is expected to continue, and, steps taken or
planned to reduce, eliminate, and prevent reoccurrence of the noncompliance.
b. Any violation of a maximum daily discharge limitation for any of the pollutants
listed in this Order shall be included as information that must be reported within
24 hours.
c. The Regional Water Board may waive the above required written report on a
case -by -case basis.
7. Except for data determined to be confidential under Section 308 of the Clean Water
Act (CWA), all reports prepared in accordance with the terms of this Order shall be
available for public inspection at the offices of the Regional Water Quality Control
Board and the Regional Administrator of EPA. As required by the CWA, effluent
data shall not be considered confidential.
8. For Dischargers discharging at a volume equal to or greater than 150,000 gallons
per day, the Discharger shall submit semi-annual reports that tabulate all measured
flows and measured parameters within the most recent six month period. Where
discharges associated with these projects last less than 6 months, a report covering
the period of discharges shall be submitted. Copies of these monitoring reports shall
be submitted to the Regional Water Board and to the Water Quality Director of the
Orange County Water District at P.O. Box 8300, Fountain Valley, CA 92728-8300.
B. Self -Monitoring Reports (SMRs)
1. Monitoring reports shall be submitted by the 30th day of each month following the
monitoring period and shall include:

a. The results of all physical/chemical analyses for the previous month,
b. The daily flow data,
c. A copy of the receiving water observation log,
d. A summary of the month's activities including a report detailing compliance or
noncompliance with the task for the specific schedule date, and
2. If no discharge occurs during the previous monitoring period, a letter to that effect
shall be submitted in lieu of a monitoring report.
3. At any time during the term of this Order, the Regional Water Board may notify the
Discharger to electronically submit Self -Monitoring Reports (SMRs) using the State
Water Board's California Integrated Water Quality System (CIWQS) Program Web
site (http://www.waterboards.ca.gov/ciwqs/index.html). Until such notification is
given, the Discharger shall submit hard copy SMRs. The CIWQS Web site will
provide additional directions for SMR submittal in the event there will be service
interruption for electronic submittal.

The following plan must be implemented when a construction won Bay Island involves
demolition, construction of a new building or a significant remodev4c"c inn.

1. Bay Island Club will use their property manager to assist in implementing the
Construction Management plan noted below. The shareholder will be responsible for
paying the cost of this additional time by the property manager.
A. Coordinating deliveries of materials, including verifying tha Temporary parking sdev�&`k-
permit or Island Ave have been obtained and properly noted for large eliveries. ClcSve- 1Pl '

B. Communicating with the Bay Island Shareholders and residents on Island and
Edgewater to ensure that they are aware in advance of any disruptive deliveries.
C. Ensure that Contractors have a person stationed at the Bay Island Gate during
deliveries to allow the gate to remain open during the removal on/off the island.
D. Maintain a record of the signatures from contractors stating that they have read and
received the Bay Island Club Contractor's Manual
2. If a crew is going to be working on the Island for an extended period of time, then the
Shareholder or contractor should purchase a "Blue Meter" parking pass for the
contractors, so that they can park on the meters found on Balboa Blvd. These are
purchased either online or at Newport Beach City Hall. All Contractors s�beuf b` e

trash can be left or stored on the sidewalk or public area of Island Ave and Edgewater.

CONSTRUCTION NOTES
1. Well to be drilled with bucket auger type rig
2. Drilling fluid , including water with or without addiives (no bentonite) will be used to prevent caving of borehole
3. Borehole will be logged durning drilling to identify groundwater level and soil conditions
4. Centralizers will be installed at the top and bottom of wellscreen section to insure adequate
filter pack thickness throughout: slotted section
5. 6 ea dewatering wells will be drilled. Well depth will be 40 ft. unless clay or poorly permeable material is encountered.
(anticipated tip elevation -25 msl)
6. Wellcasing will extend approximately 1 ft above existing grade and be protected with a
poly type cap installed with self -tap screws. The cap can be cut to accomodate riser pipe when pump is installed
7. Well filter pack will be #5 - Pacific Aggregate or approved equivalent.
8. Wellscreen slots shall be machine slotted 0.030"
9. Anticipated maxirnum flow rate 750-800 Gallons per minute -After drawdown anticipated flow 400-500 GPM.
10. Wells will be test pumped prior to connection to discharge system until determined to be clear.
11. Anticipated duration of dewatering operations 3-4 months.(not during summer months)
12. Well casings will be pulled and borehole backfrlled with pea gravel
13. A vacuum wellpoint system will not be used unless noise limits can be maintained below 50dba on adjacent property.
14. Depth of deepest excavation - Sewage ejector and stormwater ejector pits - (-2.5) ft msl.
