The City Engineer stated to the Council that since the adoption

changes had been made, the special Counsel advised that a new Resolu-
tion should be adopted adopting the plans and specifications as they
now exist and in final form. On motion of Councilman Bennett, seconded
by Councilman Ridderhof and unanimously carried, Resolution No. 4353
re- adopting plans and specifications, was adopted.
The Clerk announced that on August 9, 1954, the Council had ap-
proved a report of the Health Officer, dated August 3, 1954, stating
that the necessity for the construction of said sewers as a health
measure, and that he had been advised by the Special Counsel handling
the proceedings that the law requires that said communication be
spread in full upon the minuted of the Council. On motion made and
unamimously carried, the Clerk was instructed to spread said communica-
tion upon the minutes, which communication is in words and figures as
follows:

As Health Officer of the City of Newport Beach and of the
County of Orange, I hereby recommend that proceedings should
be instituted at once for the construction of sanitary
sewers in that portion of Newport Beach, bounded on the north
by 16th and 17th Streets, on the east by 17th Street, on the
douth by Tract No. 1210 and on the west by Irvine Avenue.
The area is now entirely serviced by cesspools and septic
tanks.
"This recommendation is made as a measure necessary to the
protection of public health, and is also made pursuant to
Section 2808 of the State and Highway's Code of the State of
California.
"We have made an investigation of the sanitary conditions in
this area of the city and we have found that residents there-
in have been, and are, experiencing difficulties with their
individual sewage disposal systems.

will take the offenders into court.

of charges, then a Public Hearing will have to be
set by the Council and the reporters subpoenaed to
testify under oath.

Natl. Inst. of iun. Law The City Attorney requested permission to attend the National
Officers Conference Institute of Municipal Law Officers conference to be held in Miami
request of C. Atty. to November 20 -22. On motion of Councilman Ridderhof, seconded by

inst. to write St. hiway.State Highway Department advising them of the extreme urgency of
