Councilman Marshall stated that in view of the fact that sb had. served as. a member of the Planning, Commission wher the recommendations, were made to the Council in connec- tion with subject hearing, she desired to be- excused,.from participating. Councilman Marshall.left the rostrum. The Clerk presented the findings, of the Planning Commis- sion and a letter, dated April 10,. 1962, from Peter H. DeRosa modifying:his requested encroachment. to 2 feet 10 inches, and bearing .the. signatures of seven property owners„ withdrawing,protests- previously made. Mr. DeRosa spoke. from the, audience. He- stated that he would agree..to the.-imposed condition .inAhe granting of the Variance that no one. would be permitted to enclose. the upper or- .lower floors in the encroached area. Planning Director J. W. Drawdy spoke. from.the,audience and.-state ,that. the. only property owner:who,had not signed. .the. with- drawal of protest was the owner of property located at 10,6 Apolena, which property encroached:, further into the re- quired front yard setback than that proposed by Peter H. DeRosa. The hearing,was.closed.
