Copies of Resolutions adopted.by the City Council of
Anaheim and the City Council of Santa Ana, opposing
Assembly Bill No. 28, were presented.
Resolution No. 5746, protesting Assembly Bill No. 28,
similar to the Resolutions of the City of Anaheim and the
City of Santa Ana, was adopted, and it was directed that
copies of said Resolution be sent to the proper authorities
in Sacramento.
A letter was presented from H. K. Mellor requesting
parking on one side of 36th Street between Balboa Boule-
vard and Seashore Avenue. Mr. Mellor spoke from the
audience. The matter was referred to the Public Works
Director.
The following actions against the City were presented:
(a) Notice, served on the City Clerk on February 8, of a
Hearing of Petition to File a Claim Against a Local
Public Entity in Orange County Superior Court Action
No. 110439, Cheryl Lea Love, a minor, by Ernest
Love, her guardian ad litem, Plaintiff, vs. County of
Orange, et al. , Defendants, and a Petition to File a
Claim Against a Local Public Entity in the same matt
(b) Verified Claim of Staler, Inc. against the City, in the
amount of $34, 642. 95 for payment of services rendere
and materials furnished by claimant, pursuant to a
contract to improve Dover Drive, as a subcontractor
of Sully- Miller Contracting Company.
The allegations were denied and the City Clerk's referral
of the matters to the insurance carriers was confirmed.

A letter was presented from the Junior Ebell Club of New.
port Beach requesting financial assistance in printing
copies of a booklet entitled, "Laws for Youth," which are
distributed through the Newport Beach Police Department
and by other agencies. Mrs. Clinton Hoose and Mrs.
Harry Baker, President, spoke on behalf of the Junior
Ebell Club. Mrs. Marion MacDonald spoke from the
audience and opposed a City contribution to the project
at this time. It was .directed that $200 be made available
for this project indicating agreement in principle that the
booklets are a worthy expenditure of City funds, and the
City Manager was directed to bring back to the Council at

which this maybe done.
7. A letter was presented from Angus W. Potter objecting
to the acceptance.by some City Councilmen and .some City
officials of gratuitous memberships. in the Balboa Bay
Club. Mr. Potter was in the audience, and Mayor Hart
expressed displeasure at the tone of the letter and stated
that he believed that none. of the Council members could
be influenced in any manner by receiving a courtesy card
for the Balboa Bay Club. Mr. Potter reiterated the state
ments contained in his letter.
At. the request of Councilman Cook,: his comments are
included verbatim, as follows: "I would like to have some
comments to make about this, Mr. Mayor. I think that
people have a right to know about their business and I
think if we discuss it in public, discuss it intelligently
and objectively and sanely and with dignity, maybe some
good can come out of it. .It is not what is right, I mean it
is what is right, not who is right in this entire thing.
Now, I wish to also preface any remarks that I may make
that there is no intent to imply that there has been any-
thing wrong whatsoever with. any decision that has been
made by any staff member, any Councilman relative to
this Bay Club, but the history of the Bay Club,. the lease,
some of the things that have gone on in the past might be
well to review at this time just a.wee bit, one being the
possessory interest taxes that created quite a little uproar
in our City back -a few years ago. Then there was the
building permit deal that also was involved. Then there
was the waiving of the Bay Club income on the Bay Window
magazine, that has now been straightened out; and, then
of course. just in recent years„ back. in'61, it was,dis-
covered.with great awe that the Bay Club had never paid
any, business -license, the same as other business people
in the City. So those things that have gone on.in the past
have been corrected, .I'm happy to say they have, but in
this particular instance I do not believe that the Honorable
Mayor can compare .the Bay Club property and the Bay
Club free memberships to the City Manager, to the City
Attorney, members of the Council, and I might add just
at this time, Mr. Coop, are there any other of your De-
partment Heads beside you who have had them sent to
them ?" Mr. Coop replied, "I don't know." Councilman
Cook, "You wouldn't know ?" Mr. Coop answered, "I
don't know, I haven't asked them." Councilman Cook
stated, "Well, I'm surprised that you wouldn't know, and
I ask, this for a constructive and a good reason. I would
like at this time to make a request that you give me a
.report, would you, please." Mr. Coop: "I'll be glad

to give the Council a report on.it, but I didn't know; no
one had asked me." Councilman Cook said,. "No offense,
no offense. Would you please be so kind as to give it to
me,, but I would like to know. " Councilman Stoddard in-
jected, "Did you say those who asked to have the cards
sent to them ?" Councilman Cook replied, "No, I didn't
say that. No. I didn't say it. Have received them; have
received them, any of your Department Heads who have
received them. " Mr. Coop:. "I. don't know. " Councilman
Cook: "That was the intent, who have received them, not
who asked, not to solicit, no, not by any means."
Councilman Cook continued, "Now, this particular piece
of property,: as all of you know, belongs to the people.
We, . as, the City Council, act as a trustee for the people.
The Department Heads and the Staff are required to give
us advice on things.. Possibly it could go on for years. anc
never be anything, but it does lay us open to some criti-
cism,, and I firmly believe that a big majority of the peopl
of this City would rather see us not do it. Now, the cate-
gory into which the employees of this City fall are proba-
bly two or three: One, the employees who work for the
City Manager, and the others, the employees who are
hired by the City Council. Now the people who are hired
by the City Council are the City Manager, the City Attor-
ney and. the City Clerk. Some of this may be, a little old
to some of you people, but I would like to get it into the
record. Now, the elected officials are elected. They
stand on .their own ground, they rise or fall by what the
.people think of them. Now, for the people who work for
the City, I believe that a short time ago a letter went for-
ward stating that it is a policy of this City and of the ad-
ministration, of which .I concur,. it concurs, that no City
employee. will accept gratuities from anyone doing-- ,busi-
ness with the City. Now, to have two standards, one for
.
the little Indians.. and one for the big Indians, I don't think
is good for morale. A short time ago a City employee,
I hear, I was told, was called into Court by the administr,
tion and fined a full day's pay for making a remark that
'I don't drink this kind, you know I've always drunk the
other kind.' And, as I understand it, no present was
forthcoming from the friend of this particular employee of
many years, so I think that if we're going to have one rule
for one, we should have the same rule for all. I believe
that sincerely, I believe it's right. Now, as for the acceF
tance of it, when do you accept it, and when don't you
accept, I don't know myself, but I do know this, that the
Internal Revenue Service considers a membership in a
club that you know to be accepted when you receive a nice
formal letter saying you are now a member and here's
your card. It's signed and ready to go to work -for you.
It's.accepted unless you send it back, and that if you don't

value received, both for the initiation fee, the amount of
the 20% to the government, and.also the dues which you
are passed up on each.month to the tune of $24 a month as
income on your income tax, which is perfectly all right
with me, if you wish to. Now, I just feel a,little strongly
about this, and.as I say, it's not who is right, but what is
right. What is right for one should be right for all I be-
lieve." Mayor Hart: "You kind of like that sign on my
desk, don't you ?" Councilman Cook: "Yes, I do. I reall
do. I think that it places the employee of the Council,. or
the employee. of the City, who is. required.to advise us,
who has accepted these gratuities, and they are gratuities
they are something of value,. and they stand on one side. of
the table and advise . us, when the party that is on the othe:
side of the table is the one who is given the gratuity. I
just feel..that that is. an epic that I can't. understand. I am
willing to be convinced, but I assure.you.that I'll be a littl
hard to be convinced on this subject. Now,. as I say, I
hope that some good can come out of this, no one is being
pointed at with any fingers in any way, shape or form. I
made my position clear a long time ago,. that I did not
wish, to accept, would not accept any membership in any
club, that if I wanted to belong, could afford to belong,
then I would pay my way just like everyone. else. So, in
conclusion, I would like to say I would certainly like to
see this Council establish a policy relative to this one par
ticular club, which is different than the others, entirely
different. I would like to see them, request them, all em
ployees.who have had in their possession, free and unpaid
memberships in the Balboa Bay Club, return. them, and I
would .like to see my colleagues do the same.. I would, like
to put that in the form of a motion."
Mr. Potter requested that his letter be. read. Mayor Har
read the letter. A further discussion ensued. Mr. Dave
Hargraves spoke from the audience. The Clerk read
Councilman Cook's motion as. follows: That all employee;
who have in their possession free and unpaid membership
in the Balboa Bay Club return them with a letter of thanke
and Councilman Cook suggested that his colleagues do the
same. Said motion failed adoption.
The communication was ordered filed.
AMENDMENTS:
The following - Budget Amendments were approved:
No. ,C -36, in the amount of $16, 500 (increase in Unap-
propriated Surplus), being.a decrease. in Budget Appro-
priations and a decrease in Revenue Estimates for Coast

Highway signalization, this is a "State let" contract with
the City contributing rather than "City let" contract with
the State contributing, as originally proposed; City's con-
tribution $53, 500 less Macco contribution of $12, 000 =
$41;500; from Unappropriated Surplus Capital Outlay
$30, 000, and from Budget Appropriation $46, 500 to
Budget Appropriation Control Traffic, Land Improvement;
Coast Highway Signals $46, 500 and from Donations and
Contributions $30, 000.
No. C -38, in the amount of $75,433.34, being an.increase
in Unappropriated Surplus for recording of final collectior.
of Sakioka Note Receivable and Adjustments of Surplus

"our wonderful Fire and Police Department," who
responded within a few minutes to render assistance to
her husband when he fell on the sidewalk on January 19.
Mr. Theodore Hambrook, of the Pacific Telephone Company
introduced two guests who had attended the Council meeting
with him, Mr. Jerry Richards and Mr. William Clay.
The meeting was. adjourned at 9:45 P. M.
