[EARINGS:
Mayor Hart opened the public hearing regarding the appea
of Harry E. Brockman, 331 Lindo Avenue, and twelve
other residents of the area, appealing from the decision
of the Planning Commission granting Applicationfor Var-
iance No. 752 to Mr: and Mrs. George W. Ellis for per -
mission to have a 7 1/2 ' front yard setback instead of
required 10'; 3' side yard setbacks for the dwelling and a
zero side yard setback on the south for the purpose of
constructing carport. support posts only; a 2 1/2' rear
yard setback instead of required 5' for the second story
only; a carport in the front one -half of the lot; portion of
lots 144 and 145, Block A; East Newport, Zone R -1; 335
Lindo'Street, Newport. Beach.
The findings of the Planning Commission and the protest
petition from thirteen complainants were presented.

7. Mayor Hart opened the public hearing regarding
'No. 1053, being
AN ORDINANCE OF THE CITY OF NEWPORT BE
ADDING CHAPTER 3 TO ARTICLE IV OF THE N
PORT BEACH MUNICIPAL CODE RELATING TO
DANCING.
No one desired to speak from the audience. Councilman
Elder made a motion to close the hearing. Councilman
Cook requested a discussion. Councilman Elder with-
drew his motionto close -the hearing. A discussion en-
sued.
Councilman Cook made a motion to amend the proposed
ordinance to permit.the City: Manager to.issue a tempor-
ary permit -and then have that permit come before the
Council at.its next meeting for approval or disapproval;
and to close the hearing. Said motion failed adoption.
The hearing was closed.
It was directed that the proposed Ordinance be •revised
and amended as to Section 4303. regarding requirements
for floor space for. dancing, in language as submitted by
the City.Attorney's office, and that the revised Ordinance
be presented for second reading at the next Council meet-
ing.

Act.
ADDITIONAL BUSINESS:
The City Manager was instructed to contract. for. liability
insurance for the City with Jay and Renfro, for a period
of one year, in accordance with'the bid submitted.
2. The City, Attorney was instructed to prepare a resolution
'for presentation at the next meeting to prohibit any single
.expenditure from the Community Promotion Fund in ex-
.cess of $250 unless specific Council approval is obtained.
3. A discussion was had regarding beach erosion control.
The City's participation in the Beach'Erosion Control
.project was authorized to the extent of 11.18':% of the
local share which is 16: 5% of the total cost.
