TERMS AND CONDITIONS OF ENCROACHMENT PERMIT
Encroachment Permits rnay be taken out by the owner of benefited property or a licensed contractor. A licensed
contractor must provide a 'Letter of Authorization' to allow another party to pull a permit. An approved copy of the
permit and construction plan snail be kept at the job site at all times Work, which has been done prior to issuance of
a permit, is subject to rejection/fine. City reserves the right to void permit if work does not commence within 30 days
after dale of issuance
The Permittee agrees to defend, indemnify and hold the City.. its authorized agent, officers, representatives and
employees harmless from any responsibility, liability, suit or action of any description arising out of any accident, loss
or damage to persons or property occurring as a result of work undertaken under this permit.
All work shall be done in accordance with the approved plans, Standard Special Provisions and Standard Drawings
of the City of Newport Beach, and in compliance with all applicable State laws and City ordinances.
Permittee guarantees all work performed under this permit to be free of hidden and latent defects. Any failures shall
be corrected within two weeks after notification to the satisfaction of the Public Works Director.
A valid State licensed contractor must perform all construction within the public right-of-way, unless waived by the
Public Works Director. A valid State Contractor License Class A can perform any work in the public right-of-way. For
construction or connection to water lines a valid State Contractor License Class C-34 is required. For construction or
connection to sewer lines a valid State Contractor License Class C-42 is required.
All trenching and/or resurfacing shall conform to City Standard 105-L for parkway/roadway and City Standard 140-L,
in the alley, where a minimum half -alley width resurfacing shall be provided, unless otherwise directed by the Public
Works Dept. Contractors shall obtain permits to perform excavation or trench work from the California Division of
Industrial Safety prior to commencing underground construction as required by State law. Walls and faces of all
excavations over 5 feet in depth shall be protected by a shoring system, sloping of the ground, or other equivalent
means. Trenches less than 5 feet in depth shall be guarded when hazardous ground movement may be expected.
The Public Works Department Inspectors must inspect all work in the Public right-of-way. Forms and subgrade must
be inspected and approved before concrete is ordered/poured. Sewer, pipelines, and subgrade construction must be
inspected and approved before backfilling, or applicant may be required to excavate site. Separate Utilities
Department or General Services Department inspections may be required depending on scope of work performed.
All trench restoration must be inspected by the Public Works Department. No utility installation(s) shall be allowed
over or within 5 feet of any City utilities, unless approved by the Public Works Department. Locate and pothole
existing City -owned utilities (ie water, sewer, or street lighting conduits) to verify locations. Maintain a one -foot
clearance over or under existing City -owned utilities. Sewer cleanouts require VCP or PVC SDR35 be used with a
4TT box over the riser.
Properly lighted barricades must be provided and maintained around all trenches, excavations and obstructions. All
signs, flags, lights and other warning and safety devices shall conform to the requirements of the current "Manual of
Warning Signs, Sights and Other Devices for the Use in Performance of Work Upon Highways issued by the
California Department of Transportation If needed barricades can be obtained from the City at a charge of $10.00
per barricade per day, with a minimum charge of $35.00. It is the responsibility of the applicant to place barricades to
protect the general public. Access to fire hydrants must be maintained at all times.
Work within or near beach sensitive areas will not be allowed during. City holidays, spring break. Memorial Day
weekend, summer between June 15 and September 15, and during the holiday season from December 19 to
January 1, unless approved by the Public Works Department.
Any work that extends into traffic or parking lanes and impedes the normal flow of traffic requires the applicant to
acquire a Temporary Street Closure Permit from the Public Works Department. Access for fire, police and
emergency vehicles must be maintained at all times. Traffic Control must be per Work Area Traffic Control
Handbook (WATCH). No nighttime traffic lane closures, unless prior approval has been granted. Any lane(s) closure
on a major street will only be allowed between 9:00 a.m. and 3:00 p.m. (Monday thru Friday), unless approved by
the Public Works Department Any work affecting the Slate Highway's traffic or within the State Highway right-of-way
will require a Caltrans Permit. All vehicles shall be lawfully parked.
This permit does not authorize the closure of sidewalks, streets, or alleys for construction access, storage of
materials, or parking of construction vehicles unless detailed on an attached Temporary Street Closure.
Applicant must notify USA at 1-800-227-2600 2 days before starting any underground construction. Applicant
must notify all affected residents 24 hours in advance of restricted access and any inconveniences.
Refuse or unused materials shall be removed within 24 hours after completion of the work. If not removed, the City
may remove and bill the applicant Coordinate alley closures with City's refuse pick-up days by calling 949-644-3066
for the collection schedule so service is not interrupted. To place a dumpster or materials in the public right-of-way, a
Temporary Street Closure Permit must be obtained from the Public Works Department.

HOLD HARMLESS STATEMENT
I understand that I am locating minor encroachments within the City Right-of-
Way/Easement. As property owner it is my responsibility to maintain the
encroachments. I will be responsible for replacing the improvements if the City
removes them for maintenance of utilities or other public need. I shall indemnify
and hold the City harmless for any liability associated with the minor
encroachments.

16 Homeowner, contractors, and subcontracotrs may each be liable for violations of Water
Quality Laws. Best Management Practices will be enforced. It is against the law to
discharge construction debris into the gutter and storm drain. Felony violations of Water
Quality Laws are punishable by fines up to $25,000 and/or up to three years in Stale
prison plus the full cost to clean up an illegal discharge or spill.
17. If a refundable deposit was paid, applicant must submit a Soils Compaction
Certificate or Evidence of a Slurried Backfill and request a final inspection from the
Public Works Department. Monies may be held for six months after final inspection
before a refund will be processed.
18. No trees in the public right-of-way shall be planted, removed, trimmed, or relocated
without approval from the General Services Department.
19. All work in the public right-of-way must meet the approval of the Public Works
Department or corrections will be required (i.e. removals, exposing connections,
etc.). Additional inspection fees may be required.
20. Permit is for standard materials in the public right-of-way only, unless previously
approved by Public Works and an Encroachment Agreement has been processed.
21. Permit is valid for "description" of work noted on front only. Additional work
performed may require issuance of a separate permit and/or additional fees.

The above signed Encroachment Agreement was picked up & submitted to David Keely this morning at the City of
Newport Beach. The document will be recorded by the city both the Irvine Company & Stantec will receive a copy of the
recorded document.
There is also the Encroachment Permit itself. It will be ready to issue at the counter. The contractor will simply need to
complete the attached application & pay a $330.00 fee. The contractor will only need to fill out the area of the application
which is marked, all other information is already on file with the city.

TITLE: Encroachment Agreement for Existing Improvements within the
Public Right -of -Way adjacent to 900 Avocado Avenue.
ABSTRACT:
The applicant requests to retain an existing planter wall within public right-of-way located
at the corner of East Coast Highway and Avocado Avenue adjacent to 900 Avocado
Avenue. The City and Owner have no record of an encroachment agreement for the
existing planter wall.
RECOMMENDATION:
a) Determine that the action is exempt from the California Environmental Quality Act
(CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines
because it will not result in a physical change to the environment, directly or indirectly;
b) Waive City Council Policy L-6, Private Encroachments in the Public Right -of -Way, to
retain an existing planter wall that encroaches in excess of 1-foot into the public right-
of-way at the corner of East Coast Highway and Avocado Avenue; and
c) Direct staff to enter into an Encroachment Agreement with the Owner and authorize
the City Manager and City Clerk to execute the Encroachment Agreement within one
(1) calendar year upon receipt of approval.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item.

DISCUSSION:
The Owner has submitted plans for site improvements at the Corona Del Mar Shopping
Center located at 810 to 984 Avocado Avenue. As part of the plan review, staff identified
the existing planter wall located within the public right-of-way. The City and Owner have
no record of an encroachment agreement for the existing planter wall. The Owner is
requesting a waiver of City Council Policy L-6 to retain an existing 102-foot long planter
wall that encroaches up to 12.3-feet into the public right-of-way at the corner of East Coast
Highway and Avocado Avenue. Based on the information provided by the applicant, the
wall was constructed in 1997. The applicant is also proposing to install decorative
carriage walks along the Avocado Avenue frontage that are consistent with the City
Council Policy.
City Council Policy L-6, "Private Encroachments in Public Rights -of -Way" explains and
describes how the public rights -of -way are to be reserved for public use or open space;
and that the rights of the public, present and future, are not to be diminished by the
installation of private improvements within the public rights -of -way. The Policy specifies
allowable and prohibited encroachments and describes the required permits or
encroachment agreements.
In Section A, which outlines the general encroachment prohibitions, "...structural
encroachments including fences, walls, patios, raised planters, etc., which encroach in
excess of 1-foot into the public right-of-way or exceeds 3 feet in height..." are prohibited.
The owner is requesting City Council consideration for waiver of this policy to allow the
retention of the planter wall that encroaches up to 12.3-feet into the East Coast Highway
and Avocado Avenue public rights -of -way.
Staff has reviewed this request and supports this policy waiver. In staffs review of the
existing site conditions, the existing improvements do not hinder the use of the public right
of way, including sidewalks. The retention of the various improvements will not diminish
the rights of the public, present and future, at these locations.
Should the City Council elect to approve the waiver and retention of the said private
improvements and appurtenances, staff recommends that the City Council require the
owner to enter into an encroachment agreement with the City. The encroachment
agreement specifies the rights of the City including future removals and the
responsibilities of the property owner. The encroachment agreement is recorded onto
the property's title and provides important notice and protections for the City and for the
current and future property owners.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this project exempt from the California
Environmental Quality Act (CEQA) pursuant to Section 15060(c)(2) and 15060(c)(3) of
the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has
no potential to have a significant effect on the environment.

Dear David,
As requested, in association with Plan Check #2375-2017 for site improvements at Corona Del Mar
Shopping Center, we are submitting for an Encroachment Agreement / Permit for an existing planter
wall located within the public right-of-way. The wall in question, constructed in 1997, encroaches over
the Avocado Avenue right -of -way -line at the corner of Avocado Avenue and Pacific Coast Highway.
This wall, likely constructed to hold back excessive grade at the corner, is approximately 2' tall though
this section and follows the back of the sidewalk. Related plans for the construction of the wall include
a precise grading plan, PC#851G97, which defers grading in the area in question to a landscape plan,
PC#851 L97. The sidewalk was improved as part of the Avocado Avenue street improvements, R-5649-5
in around 1990. The City of Newport Beach does not have any records of an encroachment
agreement on file for this wall, hence this permit submittal.
The improvement plans we submitted for review as Plan Check #2375-2017 (currently in process) only
include scope located behind this already established planter wall. No modifications to the existing wall
are proposed in the encroaching segment. The scope of the currently proposed improvements
includes the removal and replacement of landscape planting, as well as voluntary hardscape
improvements to address accessibility compliance issues at the Center. The improvements aim to
improve the existing access routes and only minimally modify lengths and alignments to achieve
compliant slopes and gradients. The scope of work includes moving the landings for the existing access
stairs and ramps to the Irvine Company side of the property line as requested, however the portions
tying into the public walk are proposed to be set with concrete pavers. We have been informed that
completing this work will require an encroachment permit, and therefore request that these proposed
paver transitions connecting the privately -owned portions to the public walk be included in this
encroachment request.
