1. Mayor Gruber opened the public hearing for the purpos
of reconsidering the City Council's decision of

ik February 28, 1966, to overrule the denial by the
City Planning Commission of Use Permit No. 1188

applied for by the First Western Bank and Trust
Company, as Trustee under the Will of Earl W.
Stanley, Deceased, to permit the construction iand
operation of a service station on a portion of Lot 3,
Tract 1125, 757 Dover Drive, Newport Beach. The
findings of the Planning Commission were presented.
Letters from the following protesting the use of the
property at 16th Street and Dover Drive for a service
station were presented: C. T. Rafferty, Patsy A.
Rafferty, Mr. and Mrs. Earl Stoneback, Robert L..
Werkheiser, Mr. and Mrs. Howard Gesley, Mr, and
Mrs. Arthur R. Eisert, Mr, and Mrs. Milton Kelly,
Louise S. Travers, Wallace and Elaine Parker, Betty
Pettengill. The Deputy City Clerk presented additional
letters received March 28, 1966, opposing a service
station on said property from the following: Mr, and
Mrs. Zachary J. Sham, Mrs. Herbert Koehler, Mr.
and Mrs. O. V. Clawson and Daniel E. Gilcrest.
Attorney John Hopwood spoke in behalf of the Newport
Harbor Lutheran Church and introduced Richard
Reese of The Irvine Company; Jules Brady, architect;
Pastor Blain of the Newport Harbor Lutheran Church;
who urged the Council to reconsider its February 28
decision and to deny subject Use Permit. Attorney
Gordon Richmond, representing the First Western
Bank and Trust Company and Mrs. Mildred Stanley;
and Ben Reddick, representing Mrs. Stanley; spoke
from the audience requesting the Council to sustain
its original decision. Albert Eccles, Jr., represent-
ing the Church of Jesus Christ and Latter Day Saints;
Jack and Ralph Hoyle, original lessees of property
contiguous to property in question; spoke against
subject Use Permit being granted.
The hearing was closed.

(a) A letter from Calvin Rohrs and a letter received
March 28 from M. W. Johnson in favor of keeping
surfing regulations as they are.
(b) Letters in favor of relaxing surfing regulations
from the following: Mrs. J. E,. Donalson, B. G.
Silzle, L. C. Darrow, Mrs. G. F. Shallenberger.
The Mayor stated that the surfing matter would come
to the Council April 11.
Chief Lifeguard Robert Reed and Ralph Watson spoke
from the audience.

Harbor 20 -30 Club. A letter from John B. and
Virginia H. Wassall was presented in favor of legis-
lating skill games out of town. The Deputy City Clerk
stated that additional letters were received on March
28 from Norman Montapert, Secretary of Central
Newport Beach Community Association, and Harold C.
Wilhelmy in favor of proposed ordinance.
Lee Heeter, George Pearland, Merl Willhite, and

14. A memorandum was presented from the Public Works
Department dated March 28, 1966 regarding Easter
Week traffic regulations.
The following Resolutions were adopted:
Resolution No. 6325, establishing certain temporary
no parking areas, as amended.
Resolution No. 6326 designating temporary one -way
streets during the Easter Vacation period.
15. The request of the City Manager for authorization for
replacement of jeep in the Lifeguard Department was
approved.
APPLICATION FOR HARBOR PERMIT:
1. A memorandum was presented from the Public Works
Director dated March 28, 1966 regarding application
of Mrs. Arthur W. Colby, 1101 South El Molino,
Pasadena, for Harbor Permit No. A -420 -R to replace
existing 12' x 20' rectangular float with new 20' x 40'
slip, bayward of Lot 4, Block 25, Eastside Addition,
1607 East Bay Avenue.
Ralph Parks, representing Mrs. Colby, spoke from
the audience. Mrs. Emory S. Moore and Mr. A. P.
Quirk spoke from the audience opposing subject
permit. A discussion was had.
A motion was made by Councilman Elder to grant the
permit subject to the outer limits being held back four
feet from that shown on the drawing of the proposed
float, which motion failed to carry.
The application for Harbor Permit No. A -420 -R was
approved subject to prior approval of the U. S. Corps
of Engineers.
COMMUNICATIONS - REFERRALS:
1. A memorandum from the League of Cities, regarding
the 9th Biennial Institute for Mayors and Councilmen,
was ordered filed.
2. The following communications were ordered filed:
(a) A letter from the City of Fountain Valley attaching

(b) A letter from City of Huntington Beach enclosing a
copy of its Resolution No. 2345 requesting to be deletes
from the Orange County Harbor District; also enclosin€
a copy of its Resolution No. 2344 protesting the require
ment by the Postmaster General of rural -type mail-
boxes for curb delivery in all new subdivisions.
3. The following claim for damages was denied and the
City Clerk's referral of the matter to the insurance
carrier was confirmed:
Claim for damages of Western Salt Company alleging
that the City of Newport Beach, together with its
agents, employees and independent contractors, cause(
a section of Jamboree Road, which was being realigned
and widened, to be improperly designed, located,
sloped and graded, so as to cause fresh water and silt
to drain from said Jamboree Road into Claimant's
salt- making facility, including Vat H; and destroying
the then unharvested salt in that Vat and making the
further production of salt for sale from such Vat
impossible for at least the period of one year; alleging
damages for unharvested salt in Vat H lost on
November 23, 1965, $8600; loss of production in Vat
H for 1966, $6700; cost of repairing Vat H, $700.
4. A letter from Thomas Keevil, Editor, Daily Pilot,
asking that the Daily Pilot be notified of any special
meetings, was ordered filed; and a letter from
Christine Ringblom, a senior at Newport Harbor High
School, asking for material concerning the Newport
Freeway, was referred to the City Manager.
BUDGET AMENDMENTS:
The following Budget Amendments were approved:
C -69, in the amount of $4,421, being a decrease in Un-
appropriated Surplus, and an increase in Budget Appro-
priations for additional funds to increase the amount
available ($2, 579) in Parks & Parkways Capital Outlay
section to $7, 000 for purchase of one Toro Mower; $4, 421
from Unappropriated Surplus, Park and Recreation to
Parks, Parkways, etc., Equipment N. O. C.
C -70, being a transfer of Budget Appropriations to loan
General Fund money to Park & Recreation Fund in order
to aid in making available $7, 000 for purchase of one Toro
7 Gang Mower; from Unappropriated Contingency Reserve
to Park and Recreation Fund; $3, 113 to Unappropriated
Surplus Park and Recreation.

ADDITIONAL BUSINESS:
1. A letter from Donald C. Simpson dated March 24,
1966, questioning the advisability of annexing the
McDonnell Aircraft site along the westerly side of the
Orange County Airport, was presented.
A motion was made by Councilman Forgit to file
subject letter, which motion was withdrawn.
Subject letter was referred to the City Manager.
2. The City Manager was authorized and directed to
enter into a contractual arrangement with R: L.
Patterson, Consulting Civil Engineer, for tidelands
and submerged lands consulting services; such ser-
vices to relate primarily to Lower Newport Bay, and
shall be designed to assist the City in developing
engineering data related to tidelands and submerged
lands in Newport Harbor and to prepare material
which may be required by the State of California
regarding tidelands and submerged lands; and the
City Manager was authorized to spend up to $10, 000
for these consulting services.
3. The following Budget Amendment was approved.
C -72, being a transfer of Budget Appropriations for
Tidelands Consulting Services - R. L. Patterson;
$10, 000 from Unappropriated Contingency Reserve
to General Services- Streets, Professional Services.
4. The City Manager was authorized to work with Costa
Mesa and go into joint bid for aerial work for aerial
photographs of the entire City and to report back to
Council at a subsequent meeting with a firm proposal
for exactly what the City will be purchasing.

COMMUNICATIONS - ADVISORY:
1. A copy of a letter to Newport Harbor Daily Pilot from
William E; Mader, architect, protesting traffic
congestion problems and the lack of a plan of action
in connection with the traffic, was referred to the
Traffic Engineer.
2. The following communications regarding real estate
sign regulations were referred to the Planning Com-
mission for its public hearing:
(a) Letters in favor of prohibiting the use of real
estate signs on residential property were received
from the following: John D. Thomas; Florence F.
Rypinski; Donald Rypinski; Edward K. and Anne Kusby;
John Jeske, President of Cameo Community Associa-
tion; Newport Harbor Chamber of Commerce letter and
resolution.
(b) A letter from Newport Harbor -Costa Mesa Board
of Realtors attaching a bulletin mailed to its member-
ship regarding violations of the City ordinance pro-
hibiting the placing of signs or flags on public
property.
3. The following communications were ordered filed
(a) A letter from City of Corcoran enclosing resolu-
tion expressing support and devotion to members
of the Armed Forces fighting in Viet Nam.
(b) A letter from Southern California Association of
Governments enclosing a copy of a letter sent to
Mr. Victor Fischer of the Department of Housing
and Urban Development, as directed by the
General Assembly, in deciding that the Federal
Government should be advised of the organization
of SCAG.
(c) A letter from Roy Dance, Long Beach, suggesting
that the Council do what it can to preserve our
beach.
(d) A letter from Robert T. Martin, Assistant
Secretary to the California Highway Commission,
advising of the meeting to be held April 21 in the
Public Works Building, 1120 N Street,
Sacramento.
