Ayes ORDINANCES FOR INTRODUCTION: 1. Proposed Ordinance No. 1193, being, AN ORDINANCE OF THE CITY OF NEWPORT BEACH AMENDING SECTION 20. 20.030 OF THE NEWPORT BEACH MUNICIPAL CODE RELATING TO PLANNING AND ZONING, Planning Commission No. 226, which proposes to bring the C -N zone into line with the other commercial zones and authorizes the Planning Commission to permit non - flashing signs in excess of 35 square feet in area and non - flashing signs not appurtenant to any permitted use, was presented with the findings of the Planning Commission and a memorandum from the City Attorney dated November 3, 1966. Planning Director Ernest Mayer spoke from the audience. Ordinance No. 1193 was introduced and set for Motion public hearing on November 28, 1966. Roll Call: Ayes Noes 2. Proposed Ordinance No. 1194, being, AN ORDINANCE OF THE CITY OF NEWPORT BEACH REPEALING CHAPTER 10.48 OF TITLE 10 OF THE NEWPORT BEACH MUNICIPAL CODE AND ADDING A NEW CHAPTER 10.48 THERETO RELATING TO WEED AND RUBBISH ABATEMENT, was presented with a memorandum from the City Attorney dated November 8, 1966. Section 10.48.050 of proposed ordinance was amended to read, "A. postcard...... shall be mailed by the Fire Chief at least ten days prior to the date set for said hearing...''; and Ordinance No. 1194 was Motion introduced, as amended, and passed to second Roll Call: reading on November 28, 1966. ORDINANCE FOR ADOPTION: 1. Ordinance No. 1192, being, AN ORDINANCE OF THE CITY OF NEWPORT BEACH AMENDING SECTION 6.04. Z10 OF THE NEWPORT BEACH MUNICIPAL CODE RELATIN TO REFUSE, GARBAGE, AND CUTTINGS, was presented for second reading. Councilman Cook made a motion to adopt Ordinance 1192. With the unanimous consent of the Council, Mayor Gruber stated that further reading of the ordinance was waived. A vote was taken on Councilman Cook's motion, and Ordinance 1192 was adopted. CONTINUED BUSINESS: 1. A report from the City Manager dated November 14, 1966 regarding delinquent accounts and billing procedure was presented. The recommendations of the staff were approved. A memorandum dated November 4, 1966 from the City Attorney regarding competitive bidding requirements was presented with a memorandum from the Public Works Director dated November 14, 1966 regarding the receipt of six bids by the Deputy City Clerk on October 18, 1966 in connection with the improvement of Seashore Drive between 55th Street and Orange Street (C- 1066). A verbal report was given by the City Manager relative to conditions caused by the Tastee Freez z establishment at 19th Street and Balboa Boulevard. Councilman Parsons made a motion that the report Motion x from the City Manager be referred to the Planning Commission to be added to its file on drive -in restaurants. Mrs. Kathryn Ballif spoke from the audience and stated that the litter problem in the area was greatly improved but the noise in the late evening and early morning hours was still excessive, and requested that the Tastee Freez establishment be closed at 10:00 P.M. A vote was taken on Councilman Parson's motion, Ayes x x x x x x x which motion carried. 4. A memorandum was presented from the Public Works Director dated November 14, 1966 regarding the construction of a 12 -inch water main in University Drive easterly of Tustin Avenue and request for reimbursement by the Y. M. C. A. The City was authorized to reimburse the Orange Motion x Coast Y. M. C. A. in the amount of $ 1 , 202. 79 for the Ayes X x x x x x x City's share of the cost of the 12" water line in University Drive subject to completion of the right -of -way dedication. 5. A report from the City Manager was presented relative to painting of certain traffic islands in Corona del Mar on the Pacific Coast Highway. Councilman Parsons made a motion to authorize the staff to go ahead with the project of painting the islands with a paint that would seal as well as color, which motion was withdrawn. A letter from the Balboa Bay Club dated November 3, 1966, requesting Council approval of a proposed ° non- conforming wall to separate the Balboa Bay Club property from the Pacific Coast Highway, was presented. City Attorney Tully Seymour stated that the Council had authority to waive a zoning requirement if it were in connection with City -owned property. A discussion was had. Mr. Richard Stevens, Vice President of the Balboa Bay Club, spoke from the audience. A discussion regarding the communication from the League of California Cities relative to resolutions referred to the Board of Directors for consideration and study was had. The Urgent Pending Legislation Committee was authorized to communicate the concern of the City in these areas, particularly the motorcycle resolutions, to the League of California Cities Resolutions Committee. Mayor Gruber requested permission to be absent from the State from November 22 to November 27. The request of Mayor Gruber was granted. Mayor Gruber stated that the regularly scheduled Study Session for November 21, 1966 would not be held. The meeting was adjourned at 10: 10 P.M.
