TITLE: Receive FEMA Reimbursement for Storm Related Work at Newport
Beach Civic Center
ABSTRACT:
Storm events in December 2010 damaged a portion of the construction site of the new Civic
Center. Emergency repair work was completed by CW Driver and emergency relief funds were
recently received from Federal Emergency Management Agency (FEMA) for reimbursement of
this expense. This item recognizes that the funds were received from FEMA and requests that
they be identified in the City's budget.
RECOMMENDATION:
Approve Budget amendment No. 13BA -022 transferring funds received into the General Fund
from FEMA in FY 12 to the Civic Center Fund in FY 13 and appropriating $127,030.00 to 7410 -
C1002030 for storm related emergency repairs made to the Civic Center site.
FUNDING REQUIREMENTS:
Upon approval of the budget amendment, sufficient funds have been identified for the
emergency repair work already performed by CW Driver:

DISCUSSION:
At the time of the heavy rain storms during Winter 201012011, the Civic Center project was
undergoing mass grading work being overseen and managed by CW Driver_. Mud overflowed
onto Avocado Avenue, and the Central Library experienced some flooding in its basement. CW
Driver cleaned up the mud and debris and restored earthwork that was impacted by the heavy
rain storms. The responsive effort also included repair of scoured slopes at the Civic Center site

and the MacArthur Boulevard embankments; installation of slope stabilization measures; and,
additional storm runoff controls to prevent against further damage.
The California Emergency Management Agency and FEMA have worked cooperatively with the
City to implement a joint recovery strategy in response to President Obama's disaster
declaration for eleven California counties affected by the severe winter storms, flooding, debris
and mud flows beginning in late December 2010. The City applied for repair funds offered under
a FEMA program for the Civic Center emergency response work as well as other areas
damaged within the City's boundaries. The emergency response work at the Civic Center site
has been completed, CW Driver has been paid for the work, and now reimbursement has been
received. This staff report acknowledges the receipt of federal monies for accounting purposes.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this project exempt from the California Environmental
Quality Act ( "CEQA ") pursuant to Section 15269 of the CEQA Guidelines, California Code of
Regulations, Title 14, Chapter 3, because emergency projects are exempt from the
requirements of CEQA.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of the
meeting at which the City Council considers the item). The Notice Inviting Bids was advertised
in the City's official publication and in construction industry publications.
