DATE: May 23, 1988 A. ROLL CALL. B. Reading of Minutes of Meeting of May 9, 1988, was waived, approved as written and ordered filed. C. Reading in full of all ordinances and resolutions under consideration was waived, and City Clerk was directed to read by titles only. D. HEARINGS: 1. Mayor Cox opened the public hearing and City Council review of an appeal by JAMES M. ORULEY, Newport Beach, from the denial of the Planning Commission on April 21, 1988, of Modification No. 3381, a request of RAY CUDDY, Newport Beach, to permit the retention of an "as built" six foot high wrought iron fence (and 10t ft. of netting on top of said fence) on the SPORTING HOUSE ATHLETIC CLUB property, which encroaches 10t ft. into the required thirty foot landscaped setback adjacent to Jamboree Road; and the retention of three "as built" volleyball courts which encroach 10t ft. into said landscaped setback. Property located at 3601 Jamboree Road, in the Newport Place Planned Community; zoned P -C. Report from the Planning Department, was presented. Appeal Application from James M. Okuley, was presented. The City Manager summarized the staff report, noting that the fence and portions of the three volleyball courts that encroach into the setback area, had been on the site when the applicant acquired the property eighteen months previously, and that it was felt by the applicant that it would be a financial hardship to remove the fence or relocate it further from the street. However, it was also felt by the Planning Commission, that if this modification were approved, it could set a precedent for the approval of other encroachments into the thirty foot wide landscaped setback adjacent to Jamboree Road. He stated that the applicant would like to maintain the facility in its existing condition in order to keep the volleyball courts for tournament play. He displayed slides depicting the building from Jamboree Road, referencing the landscaped area, fencing and volleyball courts. He stated that the netting above the fencing is to keep volleyballs from going onto Jamboree Road. He also stated that the fence and volleyball courts do not obstruct any views. Discussion ensued as to whether or not other encroachments have been approved within Newport Place Planned Community, wherein it was noted in the staff report, that two requests to encroach into the subject 30 foot wide landscaped setback have been approved by the City, i.e., Koll office - industrial complex located on Birch Street between Quail Street and Dove Street, and Benihana Restaurant at 4250 Birch Street. Richard Jennings, 434 Esther Avenue, Costa Mesa, addressed the Council in support of the appeal. He stated that he was the Executive Director of the California Beach Volleyball Association, and that their association has been the only sanctioning body for outdoor volleyball for the last 25 years. They now host 156 outdoor amateur events. The Sporting House Athletic Club is the only private facility to be allowed sanctioned volleyball events by the CBVA, and its primarily due to their excellent facility. Mr. Jennings stated that their association has printed approximately 15,000 volleyball schedules this year and distributed them through the various recreational departments, high schools and colleges. The Sporting House Athletic Club does appear on the flyers for four (4) sanctioned tournaments, three of which are yet to be played, and if the appeal is denied, it would hinder their efforts to offer volleyball tournaments any longer. The scheduled tournaments will conclude in October. He stated that he has been a pro -beach volleyball player for three years and is a member of a team which r tours the United States. He felt that • the Sporting House Athletic Club was one of the finest volleyball facilities he has ever played at, and he would not like to see the use discontinued. Bruce Endsley, 713 Poinsettia Avenue, addressed the Council in support of the appeal. He stated he was President of the UCI Boosters Club and one of their concerns is the availablility of controlled facilities for practice and tournament play. He stated that Corona del Mar and Newport Harbor High Schools, are ranked as the top ten high schools in the nation for volleyball., as well as UCI being ranked in the top twenty, which proves that this area of the county has a strong interest in the sport. Hearing no others wishing to address the Council, the public hearing was closed. Motion x Following comments by Council Member Turner, motion was made to sustain the action of Planning Commission, with the • exception that the applicant be given until December 31, 1988 to restore the property, which would allow completion of the scheduled tournaments. Motion x Following discussion, substitute motion was made to sustain the action of the Planning Commission, with the provision that by December 31, 1988 the fence be moved back 10 feet, but that the volleyball courts remain where currently exist. Discussion ensued with regard to possible future owners of the subject property, wherein the City Attorney recommended that the following two conditions be added if the modification is allowed. "That applicant record a document that will give notice to subsequent owners of the terms and conditions of this modification. The form and • content of this document shall be approved by the Planning Director and City Attorney. Council Member Sansone expressed his concerns as to the shortage of recreational facilities in the City, and felt it would be a shame to have to move the subject fence 10 feet, and therefore moved a second substitute motion to overrule the decision of the Planning Commission and grant the appeal, with the two conditions set forth in the above by the City Attorney. 2. Mayor Cox opened the public hearing Harbor Towg to consider rate increases for HARBOR (70) TOWING, and G 8 W TOWING, the Official Police Towing Services. G & W Towg (70) Report from Business License Supervisor, was presented. The City Manager explained the requests of both towing companies, as enumerated in the staff report, noting that the last rate increases were in May, 1987. The staff's investigation of the requested rate increases indicate that they are competitive with other towing companies and will not interfere with the level of service being provided. Wayne Miller of G & W Towing Company, and David Cook, representing Harbor Towing Company, addressed the Council and stated they were available for questions. Hearing no others wishing to address the Council, the public hearing was closed. Motion was made to adopt Resolution No. Res 88 -40 88 -40 to increase the rate charges for Harbor Towing, and to adopt Resolution No. 88 -41 to increase the rate charges Res 88 -41 for G & W Towing. Volume 42 - Page 205 COUNCIL MEMBERS • Motion All Ayes • CITY OF NEWPORT BEACH MINUTES May 23, 1988 Council Member Strauss stated he had some concerns regarding Council Member Turner's Memorandum on this subject, and indicated he felt the analysis should consist of the technical aspects of the initiative and not involve political assumptions. He also indicated he would be opposed to hiring any private engineering consultant from Orange County or one that has been heavily involved in Orange County work, to perform the technical analysis. In response to Council Member Strauss, Council Member Turner stated that he felt "user fees" were a major issue in this regard. He also thought the traffic management initiative is an extremely complicated document and room for different interpretations. He also discussed the impact of the initiative on property owners of single- family residences, as well as the impact on the Planning Commission and City Council. Discussion ensued and it was pointed out that Phase I of the proposed scope of services would be as outlined in the Traffic Engineer's memorandum of May 9, 1988, plus the technical items (Nos. 1, 2, 3) suggested by Council Member Turner. The scope of services for Phase II would consist of the remaining elements of Council Member Turner's expanded scope, with any additions or revisions to be determined by the Council when Phase II is authorized. It is also possible that different consultants would be desirable for Phase I and II. Hearing no other comments, motion was made to direct the staff to retain a private engineering consultant to perform a technical analysis of the Traffic Management Initiative. 2. Special Events Permit Application No. 88 -132 - Fireworks for the Newport Dunes 25th annual fireworks presentation at 8:30 p.m. on Monday, July 4, 1988, was presented. Council Member Plummer expressed her concerns with regard to the impact on traffic if the subject application was approved. She read from the Police Department's report last July 4th, citing that vehicles were double - parked three -to -four deep, vehicles were parked Volume 42 - Page 206 Tra f f is Management Initiative (39) 65) COUNCIL • Motion • Motion All Ayes Motion • MEMBERS \ 00¢� %_�q x x CITY OF NEWPORT BEACH x MINUTES May 23, 1988 in posted tow -away zones and blocking Permit/ fire hydrants, driveways, etc. Special Twelve citations were issued and several Events vehicles had to be moved by their owners. The Police officer covering the Dunes event was dispatched to another location, only to find his police vehicle was "blocked -in" by illegally parked automobiles. Council Member Plummer stated that the Police Department is very concerned with the traffic problems and congestion caused by this event and therefore the Police Department strongly recommends denial of the application. In view of the foregoing, motion was made to deny the application of Newport Dunes for fireworks display on July 4, 1988. Council Member Sansone commented that he was driving on Pacific Coast Highway between Jamboree Road and the Bay Bridge last July 4th during the Dunes event, and noticed that vehicles were parked "all over the place." He did not feel the police report referenced by Council Member Plummer accurately reflected the actual traffic problems that occurred in that area. Discussion ensued wherein it was noted that the City Council had just approved a request on the consent calendar for fireworks display at the Big Canyon Country Club. In view of the foregoing, motion was IBig Canyon made to reconsider agenda item No. Country Club F- 21(b), request of Big Canyon Country Fireworks Club. It was noted that the Police Department had recommended denial of the request of Big Canyon Country Club due to illegal and hazardous parking that occurs on San Joaquin Hills Road, Jamboree Road, Ford Road, and MacArthur Boulevard. In addition, hazardous pedestrian violations occur frequently. Council Member Plummer stated that she was not against celebrating the 4th of July, but that in her opinion, the City is now compromising the safety of too many people if these requests are approved, and therefore, she revised her motion to deny the applications of Newport Dunes and Big Canyon Country Club for fireworks displays. Report from the Marine Department recommending approval of application by Hornblower Yachts to revise their commercial harbor activities permit, was presented. The City Attorney suggested an additional condition be added to the subject permit which he read as follows: l "Condition No. 17: Permittee shall keep and maintain true and accurate records of the following: 1. The name and time boarded of all passengers on each vessel during each day of operation; 2. The passenger name and time and vessel boarded of all passengers bussed to the berthing location; and 3. Such other records as the Tidelands Administrator may reasonably require to enable the Tidelands Administrator to determine if permittee is complying with the conditions of approval and to ascertain if the boarded bus system is operating effectively. Permittee shall submit records each month and these records may also be inspected by the • Tidelands Administrator during regular business hours." Volume 42 - Page 208 (51) t/ ies COUNCIL MEMBERS • Motion All Ayes Motion Ayes X x CITY OF NEWPORT BEACH MINUTES May 23, 1988 David Pahl, representing Hornblower Yachts, addressed the Council regarding Condition No. 17, stating that they are willing to accept the added requirement, but would like to delete paragraphs 1 and 2 as being "overly burdensome and somewhat unreasonable." He stated they are willing to keep monthly records as mentioned in paragraph 3, and described their individually ticketed program. In view of the foregoing, the City Attorney recommended that paragraphs 1 and 2 of Condition No. 17 be deleted, and that paragraph 3 suffice for the time being. He stated that if in the future it is determined that more detailed records are necessary, and a dispute arises between Hornblower Yachts and the Tidelands Administrator, then this issue: can be brought back to Council. The City Attorney also recommended that the words "on approval or review" be deleted from Condition No. 16 in order to give the Marine Director and /or City Council the power to impose new or revised conditions when deemed necessary. Hearing no other comments, motion was made to approve the Commercial Harbor Activities Permit of Hornblower Yachts, as revised, subject to conditions listed in the staff report, including the change to Condition No. 16 and the addition of Condition No. 17 as recommended by the City Attorney. 4. Report from the Executive Assistant to the City Manager, recommending resolution be adopted declaring intention to grant a franchise to the Balboa Ferry, and setting public hearing for June 13, 1988, was presented. Motion was made to continue this item for 90 days for further study. There being no objections, Mayor Cox appointed Council Member Strauss (Chairman) and Council Members Maurer and Turner to the ad -hoc Committee to study this matter and report back. Proposed ORDINANCE NO. 88 -16, being, Ord 88 -16 Vehicle Code AN ORDINANCE OF THE CITY COUNCIL OF /Harbor THE CITY OF NEWPORT BEACH ADDING Pointe SECTION 12.66.085 TO THE NEWPORT Development BEACH MUNICIPAL CODE TO PROVIDE FOR (85) APPLICATION OF VEHICLE CODE TO PRIVATE STREETS IN THE HARBOR POINTE DEVELOPMENT, was presented with report from Public Works /Traffic Engineering dated May 9, 1988. Motion was made to adopt Ordinance No. 88 -16. I. CONTINUED BUSINESS: None. J. CURRENT BUSINESS: 1. Report from the City Manager regarding proposed resolution MODIFYING ORDINANCE PROCEDURE and authorizing the City Clerk to set public hearing for and on behalf of the City Council, was presented. The City Manager summarized his report, noting that at the May 9th study session, the Council requested the opportunity to vote on changing the current practice as to how public hearings are scheduled and placed on the agenda. He explained the two -month calendar attached to his report, showing the current schedule and proposed schedule for setting public hearings. If the City Clerk is authorized to set public hearings as enumerated in the proposed schedule, it will result in a delay of two weeks in the second reading from the current schedule the City is following. Following consideration and discussion, motion was made to disallow the proposed resolution.
