TITLE: Resolution No. 2019-82: Authorization to Submit an Application for
the Housing and Community Development SB 2 Planning Grants
Program
ABSTRACT:
On March 28, 2019, the State Department of Housing and Community Development
(HCD) issued a Notice of Funding Availability (NOFA) related to the SB 2 Planning Grants
Program (PGP). This program is intended to help offset costs incurred by local
jurisdictions for the preparation, adoption, and implementation of plans or projects that
streamline housing approvals and, thus, may accelerate housing production. Included are
several Priority Policy Areas (PPAs) such as the creation of objective design and
development standards, as well as expedited building permit processing. The program is
not competitive and rewards jurisdictions with compliant Housing Elements. Grant funds
are already allocated for each jurisdiction based on a population range. For City Council's
consideration is an application for the maximum allotment of $310,000 and a resolution
authorizing the submittal of the application. The application is due November 30, 2019,
and would be submitted immediately after City Council authorization.
RECOMMENDATION:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA)
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because
this action will not result in a physical change to the environment, directly or indirectly;

FUNDING REQUIREMENTS:
The Budget Amendment appropriates $310,000 in additional revenue from the SB 2
Planning Grants Program to partially reimburse the cost of the new Permit System in the
IT Replacement Fund (Account No. 76504-431506). Since the Permit System is already
fully funded within the current budget, the proposed budget amendment contemplates a
commensurate amount, $310,000 be transferred to the General Fund to augment the
General Plan Update appropriations by the same amount (Account No. 01201928-
980000-20M11). There is currently $1.5 million budgeted for the General Plan Update;
staff anticipates the total cost for the update to be approximately $2.5 million. Since the
increased General Plan expenditure appropriations will be offset by the new grant
revenue allocation, there is no impact on fund balance in either the General Fund or the
IT Strategic Fund.
DISCUSSION:
On March 28, 2019, HCD issued a NOFA related to the SB 2 PGP. This program is
intended to help offset costs incurred by local jurisdictions for the preparation, adoption,
and implementation of plans or projects that streamline housing approvals and, thus, may
accelerate housing production. Included are several PPAs such as the creation of
objective design and development standards, as well as expedited building permit
processing. The program is not competitive and rewards jurisdictions with compliant
Housing Elements. Grant funds are already allocated for each jurisdiction based on a
population range. Staff has prepared an application for the maximum allotment of
$310,000.
This grant would be used to offset a portion of the City's cost to implement the new land
management system. The land management system was selected for the application
because the new system would help expedite the permitting process. This justification
has the highest possible chance of receiving the full allotment of funds.
In the event an award is not granted for the land management system update, additional
potentially eligible activities for use of the grant funds are included in the draft application.
These include keeping the City's Accessory Dwelling Unit Ordinance in conformance with
State law, updating the Housing Element and creating objective design standards to
streamline permitting for new housing projects. However, staff has been working closely
with the State's technical reviewer and anticipates receiving the award as proposed.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.

RESOLUTION NO. 2019-182
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, AUTHORIZING
AN APPLICATION FOR, AND RECEIPT OF, SB 2
PLANNING GRANTS PROGRAM FUNDS
WHEREAS, the State of California, Department of Housing and Community
Development ("Department") has issued a Notice of Funding Availability ("NOFA") dated
March 28, 2019, for its Planning Grants Program ("PGP");
WHEREAS, the City Council desires to authorize City of Newport Beach ("City")
staff to submit a 2019 PGP application, as described in the NOFA and SB 2 Planning
Grants Program Guidelines released by the Department for the PGP to expedite the City's
building permit processing, to keep its Accessory Dwelling Unit Ordinance in conformance
with State law, and/or to begin conducting preliminary analysis on the current housing
opportunity sites listed in the City's Housing Element; and
WHEREAS, the Department is authorized to provide up to an aggregate total of
One Hundred and Twenty Three Million Dollars and 00/100 ($123,000,000.00) under the
SB 2 Planning Grants Program for the Building Homes and Jobs Trust Fund for
assistance to local jurisdictions (as described in the Health and Safety Code section
50470 et seq.) related to the PGP.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as
follows:
Section 1: The City Council does hereby authorize and direct City staff to submit
an application for the 2019 PGP in the amount of Three Hundred and Ten Thousand
Dollars and 00/100 ($310,000.00).
Section 2: If the City's PGP grant application is approved by the Department,
the City Manager is authorized to enter into, execute, and deliver a State of California
Agreement ("Standard Agreement") for an amount up to Three Hundred and Ten
Thousand Dollars and 00/100 ($310,000.00), and any and all other documents required
or deemed necessary or appropriate to evidence and secure the PGP grant, the City's
obligations related thereto, and all amendments thereto (collectively, the "PGP Grant
Documents").

Section 3: Should the City accept the grant funds, the City shall be subject to
the terms and conditions as specified in the Standard Agreement, the SB 2 PGP
Guidelines, and any applicable PGP guidelines published by the Department. Funds are
to be used for allowable expenditures, as specifically identified in the Standard
Agreement. Any and all activities funded, information provided, and timelines represented
in the application shall be enforceable through the executed Standard Agreement. The
City hereby agrees to use the funds for eligible uses in the manner presented in the
application, as approved by the Department and in accordance with the PGP NOFA, the
PGP Guidelines, and the 2019 PGP Application.
Section 4: The City Manager is authorized to execute the City's PGP
application, the PGP Grant Documents, and any amendments thereto, on behalf of the
City, as required by the Department for receipt of the PGP grant.
Section 5: The recitals provided in this resolution are true and correct and are
incorporated into the operative part of this resolution.
Section 6: If any section, subsection, sentence, clause or phrase of this
resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not
affect the validity or constitutionality of the remaining portions of this resolution. The City
Council hereby declares that it would have passed this resolution, and each section,
subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or
more sections, subsections, sentences, clauses or phrases be declared invalid or
unconstitutional.
Section 7: The City Council finds the adoption of this resolution is not subject to
the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the
activity will not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3,
because it has no potential for resulting in physical change to the environment, directly or
indirectly.

Planning Grants Program Application Packaging Instructions
The applicant is applying to the Department of Housing and Community
Development (Department) for a grant authorized underneath the Planning Grants
Program (PGP) provisions of SB 2 (Chapter 364, Statutes of 2017). The PGP program
is intended for the preparation, adoption, and implementation of plans that streamline
housing approvals and accelerate housing production. Please refer to the SB 2
Planning Grants Program Guidelines and Notice of Funding Availability (NOFA) for
detailed information on eligible activities, applicants, and awards. If you have questions
regarding this application or the PGP, email sb2planninggrant(a-)_hcd.ca.gov.
If approved for funding, this grant application will be a part of your Standard Agreement
with the Department. In order to be considered for funding, all sections of this application,
including attachments and exhibits if required, must be complete and accurate.
Pursuant to Section X of the NOFA, all applicants must submit a complete, signed,
original application package and an electronic copy on CD or USB flash drive
containing the following documentation, in the order listed below, to the Department by
the specified due date in the Notice of Funding Availability (NOFA) in order to be
considered for award:
1) A complete, signed, original application (the Department will only accept this fillable
pdf as the application) with the following attachments:
a. Attachment 1: State and Other Planning Priorities (All applicants must submit
this form to self -certify compliance)
b. Attachment 2: Nexus to Accelerating Housing Production - NOTE: if the
applicant is proposing only Priority Policy Areas (PPA), as defined in section VIII,
subsection (3) of the NOFA, do not fill out Attachment 2. However, if the applicant
is proposing to fund PPAs AND other activities that are not considered PPAs, the
application must demonstrate how these other activities have a nexus to
accelerating housing production by filling out Attachment 2 of this application.
2) A fully executed resolution authorizing application for, and receipt of, PGP funds (see
Attachment 3: Sample Resolution).
3) A fully executed Government Agency Taxpayer ID Form (available as a download

4) If the applicant is partnering with another local government or other entity pursuant to
Article II, Section 200 of the SB 2 Planning Grant Program Guidelines (the
"Guidelines"), include a copy of the legally binding agreement.
NOTE: All local governments must submit a separate, signed application package,
notwithstanding whether it will partner with another form of government or entity. Only
one application per locality will be accepted by the Department. Joint applications are
not allowed.

E. Project Description
Provide a description of the project and the scope of work to be performed below. Use Appendix A for additional
information if necessary. Note. If partnering with another local government or entity, be sure to clarify the
resoonsibilities and deliverables of vour localitv pursuant to such partnership.
On April 23, 2019, the Newport Beach City Council authorized the execution of a software license
agreement with Tyler Technologies, Inc. to replace the City's 25 -year old, outdated land management
software, Permits Plus, which is currently used by the City to track all development.
The new software, Energov, will expedite the City's permitting processes by providing a more
modernized and integrated system. Energov will sustain and advance the City into the next generation
of development and customer services. As technology has advanced tremendously, Energov is
expected to greatly improve the City's efficiency in tracking and streamlining all development service
permits and projects, including building permits for new dwelling units. Furthermore, the City is currently
unable to offer any online interface capability, which severely limits the City in offering many services
the development community now expects. Energov will allow for a robust online platform that creates a
more friendly application and tracking process for the community with any proposed project.
The first phase of the implementation will be to establish the system for Building, Planning, Code
Enforcement, Public Works, and to create a Web Portal. As this is perhaps the most critical phase and
will have the highest immediate impact on development services, the City is requesting the SB 2 grant
funding to help offset only this component. While the City's permitting services currently operate at a
high level, the Energov system will improve communication across departments removing the
inefficiencies that exist with the outdated Permits Plus system. The end result will be modernized
expedited permit processing. It is anticipated building permit review time will decrease by at least 10%.
and entitlement review time is expected to decrease by 20%.
The second phase will be to extend the platform for use by Recreation and Senior Services, Fire
Prevention, the City's Real Property team.
The third and final phase will be to implement electronic plan review.
The overall implementation schedule for all three phases is anticipated to take 24 months with an
overall project cost of approximately $1.5M.

AUTHORIZING APPLICATION FOR, AND RECEIPT OF,
SB 2 PLANNING GRANTS PROGRAM FUNDS
WHEREAS, the State of California, Department of Housing and Community Development (Department) has issued a
Notice of Funding Availability (NOFA) dated March 28, 2019, for its Planning Grants Program (PGP); and
WHEREAS, the [City Council/County Board of Supervisors] of (City/County) desires to submit a project
application for the PGP program to accelerate the production of housing and will submit a 2019 PGP grant application as
described in the Planning Grants Program NOFA and SB 2 Planning Grants Program Guidelines released by the
Department for the PGP Program; and
WHEREAS, the Department is authorized to provide up to $123 million under the SB 2 Planning Grants Program from
the Building Homes and Jobs Trust Fund for assistance to Counties (as described in Health and Safety Code section
50470 et seq. (Chapter 364, Statutes of 2017 (SB 2)) related to the PGP Program.
NOW, THEREFORE, THE [CITY COUNCIUCOUNTY BOARD OF SUPERVISORS] OF
RESOLVES AS FOLLOWS:
SECTION 1. The [City Council/County Board of Supervisors] is hereby authorized and directed to apply for and submit to
the Department the 2019 Planning Grants Program application released March 28, 2019 in the amount of

As alternate activities, the City submits:
1) Anticipated revisions to the ADU Ordinance to comply with State Law. While the City already
has an effective ADU Ordinance, there is legislation that will necessitate revisions to the
Ordinance for compliance.
The estimated recovery cost for work required to update the Ordinance is $5,512.
2) Consultant preliminary work to analyze housing opportunity sites inventory prior to eventual
Housing Element Update, which may include efforts to rezone for by -right housing projects. The
City intends to have a consultant review the existing housing opportunity sites for compliance with
State Law. As part of the review, the consultant will also help to create an outreach program for
owners of potential opportunity sites and will further identify new potential opportunity sites.
The estimated recovery cost for the consultant's work is $22,500.
Lastly, although not included in the budget, the City has also contemplated requesting SB 2
funding for the following:
1) The creation and implementation of objective design and development standards.
The estimated recovery cost for staffs time (and possibly that of a consultant) for efforts in
developing these standards with community buy -in is $100,000.
2) Pre -approved architectural and site plans for creating ADUs on eligible lots.
The estimated recovery cost for staffs time (and possibly that of a consultant) for efforts in
developing these plans is $50,000.
3) Additional updates to the Housing Element related to policies encouraging housing production
and an increased affordable housing stock.
The estimated recovery cost for this effort is $75,000.
