Brown Act. Among other things, the Brown Act requires that the special meeting City Arts Commission agenda be posted at least seventy-two (72) hours in advance of the meeting and that the public be allowed to comment on agenda items before the Commission and items not on the agenda but are within the subject matter jurisdiction of the City Arts Commission. The Chair may limit public comments to a reasonable amount of time, generally three (3) minutes per person. The City of Newport Beach’s goal is to comply with the Americans with Disabilities Act (ADA) in all respects. Upcoming Arts Foundation meetings will focus on review of Art in the Park, increasing membership, and 2020 programs and budgets. V. CONSENT CALENDAR A. Approval of Minutes of the September 12, 2019 City Arts Commission Special Meeting 1. Draft of 09/12/2019 Minutes Chair Greer requested her written notes regarding Item VI.A.4 presented during the September 12 meeting be appended to the Minutes. In the second paragraph of her notes, the reference to Phase V should be 2020 rather than 2019. Motion made by Commissioner Flanagan, seconded by Commissioner LeGrand, and carried (6-0-0-1) to approve the Minutes of the September 12, 2019 City Arts Commission special meeting as amended. Consent Calendar Items 2. Financial Report – Review of financial information Library Services Director Tim Hetherton reported the budget is in good shape. The next major expenditure will be expenses for the 2020 Art Exhibition, and $32,000 should be sufficient to cover expenses. The expenses shown in the Sculpture Garden budget are artist honoraria for a previous phase. Because of City accounting procedures and the timing of Sculpture Garden phases, the expenses appear in the current year. Motion made by Commissioner Bendetti, seconded by Chair Greer, and carried (6-0-0-1) to approve the Financial Report. AYES: Greer, Little, Bendetti, Flanagan, Kaufman, LeGrand NOES: None ABSTENTIONS: None ABSENT: Baker 3. Cultural Arts Activities – Monthly review of cultural arts activities from the Library Administrative Office for upcoming Library and City arts events and services Library Services Director Hetherton advised that Marketing Specialist Katherine Mielke has created a map of public art and placed it on the Cultural Arts website. Three Phase III sculptures have been de-installed from the Sculpture Exhibition in Civic Center Park. Approximately 3,000 people attended the Flashback Heart Attack concert. Staff continues to work with Bret Price to restore Metalfor, but Mr. Price wants the site for the piece determined before restoration occurs. Motion made by Vice Chair Little, seconded by Chair Greer, and carried (6-0-0-1) to approve the Consent Calendar. Items for Review and Possible Action Chair Greer announced Item VI.A.7 will be heard first. 4. Cultural Arts Grants 2019/20 – Staff recommends that the City Arts Commission review the grant applications and approve the recipients for recommendation to City Council for FY 2019/20 Cultural Arts Grants in 6 Newport Beach City Arts Commission Regular Meeting Minutes October 10, 2019 Page 3 accordance with City Council Policy I-10 – Financial Support for Culture and the Arts. In response to Commissioner LeGrand's inquiries, Chair Greer explained that $4,000 could be retained and used subsequently for an unexpected program. Library Services Director Hetherton clarified that $40,000 was budgeted for Cultural Arts for the entire fiscal year. Potential applicants have suggested the City Arts Commission award grants at the beginning of the fiscal year to fund programs scheduled for the fall of the year. The only component of the application process that cannot be changed is the total amount of funding. Commissioner LeGrand supported retaining some funds with the caveat that it could be spent prior to the end of the fiscal year. Commissioner Kaufman summarized the applications submitted for Cultural Arts Grants. The subcommittee recommends approval of Cultural Arts Grants as follows: Balboa Island Improvement Association $2,500 Baroque Music Festival $4,000 Chuck Jones Center for Creativity $2,000 Kontrapunktus $2,000 Laguna Playhouse $5,000 Newport Beach Film Festival $5,000 Newport Elementary School Foundation $500 Pacific Symphony $5,000 Philharmonic Society of Orange County $5,000 South Coast Repertory $5,000 Total $36,000 Chair Greer noted six of the recommended recipients propose programs for grades K-6 and two propose programs for twelfth graders. Jim Mosher indicated the City Arts Commission may not have any flexibility to modify or withdraw contracts once the City and the recipients have signed the contracts. He inquired about the marketing of Cultural Arts Grants as many of the applicants are the same year after year. He questioned whether proposed programs duplicate programs offered by schools. The City Council's contribution to the Newport Beach Film Festival should be a factor in Commissioners' decision to award a grant to the Newport Beach Film Festival. Pat Jorgensen related that there is little funding for arts programs in schools and appreciated the City Arts Commission's focus on programs in schools. Chair Greer reported each recipient is required to submit a detailed completion report in order to apply for subsequent Cultural Arts Grants. The applicants do not charge admission for the programs. If approved, the Cultural Arts Grant for the Newport Beach Film Festival will fund a free educational seminar about the film industry. While some applicants have very large annual budgets, those applicants typically allocate a small portion of funding to outreach programs. Cultural Arts Grants can support outreach programs for students. Commissioner Kaufman explained that, based on her experience 7 Newport Beach City Arts Commission Regular Meeting Minutes October 10, 2019 Page 4 with the Art Masters' Program, the Newport Elementary School Foundation's program is not the type of arts program the City Arts Commission seeks. The subcommittee prioritized the quality of programming over the applicant's annual budget. Commissioner Bendetti shared her positive experiences related to Kontrapunktus concerts and Balboa Island Improvement Association's use of prior Cultural Arts Grants. Laguna Playhouse's production of I Never Saw Another Butterfly is timely and appropriate for students. Commissioner Flanagan advised that she considered the people served by the proposed programming and preferred to fund programs that could reach larger audiences. Motion made by Vice Chair Little, seconded by Commissioner Bendetti, and carried (6-0- 0-1) to recommend the City Council approve Cultural Arts Grants as recommended by the Cultural Arts Grants/Youth Programming Ad Hoc Subcommittee. Review of Banner Locations – Staff provides an overview of banner locations, policies, and procedures. Library Services Director Hetherton related that banners are governed by City Council Policy L-16. The City Council could direct Public Works staff to identify additional locations to display banners. Because City Arts Commission events are well attended and the analysis of potential locations is complex, advocating for additional banner locations may not be worth the effort. Vice Chair Little explained that she mentioned the issue to Mayor Dixon based on comments from the community expressing their lack of awareness of events. Mayor Dixon requested Vice Chair Little raise the issue during a City Arts Commission meeting. Library Services Director Hetherton advised that members of the public can subscribe to email notifications from the Library and the City or follow City departments on social media to learn of City events. He could speak with the City Manager about bringing the issue before the Council. Jim Mosher understood Council Policy L-16 applied to banners requested by third parties and may not apply to City events. 6. Public Forum for the Arts – Staff presents background and discussion of a public forum for City arts. Library Services Director Hetherton indicated public forums have been held in the past. Some were well attended, and some were not. A 2014 community forum regarding an Arts Master Plan garnered community complaints about the narrow scope of discussion. Programming funding could be used to hire a facilitator. A forum would be an opportunity to educate the public about City Arts Commission programming. Staff could identify one 8 Newport Beach City Arts Commission Regular Meeting Minutes October 10, 2019 Page 5 or more facilitators and present information to the City Arts Commission. The City Arts Commission or a subcommittee could determine whether to hold a public forum. Information from the forum could inform the General Plan Update or be integrated into it. Commissioner Kaufman departed the meeting at 6:34 p.m. 7. Date for 2020 Newport Beach Art Exhibition – Determine a date for the 2020 Newport Beach Art Exhibition. Library Services Director Hetherton indicated possible dates for the Art Exhibition are June 13, 20, and 27. Chair Greer proposed scheduling the Art Exhibition on June 20, 2020 from 1 p.m. to 6 p.m. with the awards ceremony at 4:30 p.m. The community has enjoyed the scheduling of the Art Exhibition and Concert on the Green during the Father's Day weekend. Motion made by Commissioner Flanagan, seconded by Vice Chair Little, and carried (6-0-0-1) to schedule the Newport Beach Art Exhibition on June 20, 2020. Performing Arts for Balboa Peninsula Ad Hoc Subcommittee – Commissioner Marie Little, Commissioner Michelle Bendetti, Commissioner Ritch LeGrand Vice Chair Little reported the September 29 concert at Marina Park was a success. Members of the Newport Beach Arts Foundation and the City Council attended the concert. Residents of Balboa Peninsula are looking forward to additional programs. 14. Performing Arts for Concerts on the Green Ad Hoc Subcommittee – Commissioner Michelle Bendetti, Commissioner Arlene Greer, Commissioner Wayan Kaufman Commissioner Bendetti related that attendance for all concerts equaled or surpassed attendance in prior years. In the next several months, the subcommittee will discuss bands for the 2020 season. 15. Publicity Liaison Ad Hoc Subcommittee – Commissioner Arlene Greer, Commissioner Marie Little, Commissioner Michelle Bendetti None 16. Sculpture Exhibition in Civic Center Park Phases IV and V Development Ad Hoc Subcommittee – Commissioner Arlene Greer, Commissioner Marie Little Chair Greer indicated the subcommittee is developing a proposal for the potential acquisition of Burnt Matchstick. An appraisal of the piece will be prepared and submitted to staff. The subcommittee will consult with the Arts Foundation regarding funding for the acquisition. Backhausdance is interested in participating in the opening of Phase V of the Sculpture Garden or other events in the Sculpture Garden. An member of the community has expressed interest in leading a native plant tour of the Sculpture Garden. Commissioner Bendetti departed the meeting at 6:43 p.m. VII. The early years of Neil Diamond’s groundbreaking and legendary concerts came to life, embodied through the performing artist and impressionist, Jason Lohrke. During this vividly captivating retro concert, Jason personified Neil’s look, voice, movements, and crowd interactions to a T, taking the crowd of like- minded Diamond fans back in time as they recreated hit songs such as Solitary Man, Cherry Cherry, I’m A Believer, Cracklin’ Rosie, I Am I Said, Sweet Caroline and so many more. Local Specified Assistance Grant/Sculpture Exhibition Update After City Council approval on October 22, staff forwarded the Resolution authorizing the Library Services Director as the grant applicant to the California State Department of Parks and Recreation. The Office of Grants and Local Assistance then sent a contract to the City upon receipt of the resolution. As the authorized representative for the City, I will sign and return the contract to the Office of Grants and Local Assistance after review by the City Attorney’s Office. The Office of Grants and Local Assistance will then sign and return a copy of the fully executed contract. Staff will then commence work on the grant application. Destination Art on Exhibit The Newport Beach City Arts Commission presents an exhibition of acrylic paintings by artist Sherry Marger, on display at the Newport Beach Central Library gallery. The exhibit, titled Destination Art, features 24 paintings inspired by travel destinations, including colorful landscapes of the Netherlands, Italy, and Germany, as well as several paintings of Newport Beach’s Back Bay and Crystal Cove. 13 2 of 2 Sherry Marger is an acrylic landscape painter, born in New York City, raised in New Jersey. She now lives in Orange County. As a youngster, never having been to an airport or on an airplane, little did she suspect that in the future she would be able to fly to far off places of more interest and experience firsthand the astounding beauty that awaited her. She studied computer graphics and majored in Art Education in college, developing skills for representational artwork over the years by teaching others and observing the artists around her. According to Sherry, “It wasn’t until much later in life, when I started traveling, that I began to paint more seriously. Traveling became my inspiration.” Sherry works in an impressionistic style with acrylic paints. She is primarily a studio artist who takes photos and creates plein air watercolor sketches on location to lay the groundwork for the finished paintings done later in acrylic on canvas or paper. The exhibition will be on display during Central Library operating hours, November 4, 2019 through January 3, 2020. In August 2019, the City Arts Commission authorized the use of the Lenahan Estate fund to pay for the restoration of the sculpture Metalfor. The Lenahan Estate stipulates that the fund may be utilized by the City, after recommendation from the City Arts Commission, for arts related matters for or relating to the City but not for regular operational costs of the City Arts Commission or the City. The Lenahan Estate fund is an important source of funds for special contingencies, as the Cultural Arts Division has no budget set aside for maintenance or repair of art. DISCUSSION: In 1986, Warren Hancock, a Newport Beach art collector, donated the sculpture Metalfor to the City of Newport Beach. The value of the piece when it was donated to the City was $15,000. Created by Bret Price, Metalfor was originally placed outside the Newport Beach City Hall for part of 1986 and 1987, until it was moved to the front of the Newport Center Library. When the Newport Center Library closed in 1994, the City relocated Metalfor to a grassy area beneath a bluff on the east side of the intersection of Superior Avenue and West Coast Highway. The royal blue painted steel abstract work, which weighs 1,400 pounds and is 8½ feet tall, was the centerpiece of the 22nd annual Newport Beach City Art Festival in 1986. Intense heating of the metal to make it malleable created its curvilinear form. The steel was repeatedly bent and rolled during this period of elasticity to give it "a sense of softness (and an) illusion of flexibility," sculptor Price explained. 15 2 of 5 This photo, dated circa 1983, is of the piece in its original, pristine state: Because of a scheduled construction project to build a pedestrian bridge across Superior Avenue to Sunset Ridge Park, Metalfor will need to be relocated to a new site. Council Policy I-9, Art in Public Places, gives the Arts Commission the authority to review any future modifications, relocation, repairs, and/or replacement of parts or works for art located in public places. Council Policy I-11, Acquisition of Art by the City of Newport Beach, tasks the City Arts Commission to advise the City Council regarding appropriate City property or City buildings for display of Art, in conjunction with the City commission, committee, board and/or department that has responsibility for planning or maintaining the proposed location. In August 2019, Chair Greer appoint an Ad Hoc Subcommittee to determine a new site for the piece. The piece requires restoration work. Metalfor has endured great deal of exposure to the elements. The royal blue paint has faded and there are signs of corrosion. There are patches of discoloration and oxidization. 16 3 of 5 These photos, taken to document Metalfor’s condition, were taken on May 6, 2015: 17 4 of 5 In September 2019, Mr. Hector Dominguez submitted a competing quote for $4,800 for the restoration of the Metalfor. Mr. Dominguez proposes to deinstall the sculpture and transport the piece to Gemtech Coating Service in Santa Ana. The sculpture will be sanded, repaired and powder coated. The color sample the Metalfor Committee recommended is “Candy Blue” by Gem Tech Coatings/ Olympic Powder Coating. Mr. Dominguez estimates that it will take three weeks to restore the piece. Mr. Dominguez will deliver the piece back to Newport Beach. FUNDING REQUIREMENTS: No funding requirement. DISCUSSION: ARTICLE IX of the Newport Beach Arts Foundation’s Articles of incorporation, “Disposition of Funds”, stipulates that the Arts Foundation Board of Directors shall request annually from the City of Newport Beach Arts Commission a statement of funding priorities. In lieu of this request, staff has prepared a report on a potential funding opportunity for the piece Burnt Matchstick by Karl Unnasch. Karl Unnasch is an artist with a national reputation. Over the past 15 years, he has designed and installed numerous large glass-related projects throughout the United States, including commissioned works designed for permanent installation. Burnt Matchstick debuted in Rochester, Minnesota in 2015 and was moved to Newport Beach, California in 2017 for the Sculpture Exhibition in Civic Center Park. Sculptor Karl Unnasch’s website states the following: “Impactful and monumental by day, the revolutionary outdoor piece turns into a glowing beacon of rich color by night. This 40-foot tower of backlit opalescent glass captures a fleeting moment in time: the split-second after which a burning wooden matchstick has been extinguished by a gust of air. A vast play on scale for so trivial an object, Burnt Matchstick is a call to reflection on the boundless potential of a transformative force. With poignant relevance in today's political and ecological world climates, the piece touches on notions of fragility, ephemerality, transience and beyond.” Mr. Unnasch has offered the piece for sale at a price of $50,000. Staff contracted Page Art Inc. to appraise the piece. Mr. Fred Page’s analysis is as follows: “Unnasch’s re-imagining of a disposable object as a modern sculptural statement is a witty and elegant concept. One thinks of the fires of the imagination, or the burning desire of will, or perhaps even the fiery passion of a young mind studying in the Library at the far end of the public green. Will there be a "Eureka! moment for this young thinker when he or she sees the beacon lit up in the night sky? I cannot help but think this sculpture - an object transformed - 20 2 of 2 may inspire many who encounter it. Beauty aside, considerations of cost and value are at the center of the discussion of public art. The unique must be seen to embody values sufficient to justify its purchase, installation and maintenance. How are we to value Burn Matchstick? The qualities that make it unique also make financial analysis a challenge. In the simplest tally, the artist keeps his balance sheet: on one scale are materials, labor, shipping, etc. and on the other end of the scale is his premium as an artist, which in turn stands upon two pillars: his body of work, and his reputation among equals. I would like to compare Burnt Matchstick to a large public sculpture that I appraised in San Diego in 2018. It was also a unique, monumental, and metal sculpture with ancillary lighting elements. Coincidentally, the artist is based, like Karl Unnasch, in the Midwest. The price was five times that of Burnt Matchstick. In Costa Mesa in 2016, I evaluated another monumental steel and colored glasswork by a well-known west coast artist. This work was over $250,000. In the past few years, I have also appraised several other large outdoor sculptures on private property in Newport Beach and Irvine. The minimum figure for any of these works was $150,000.” From my own experience in evaluating large-scale sculptures, I believe that Karl Unnasch's Burnt Matchstick is, at $50,000, an excellent value for the City of Newport Beach. This nationally recognized and accomplished artist has created a unique and striking sculpture that fits into its communal site in ways that are both thoughtful and surprising.” The City Arts Commission respectfully requests that the Newport Beach Arts Foundation purchase Burnt Matchstick for $50,000 and donate the piece to the City of Newport Beach as part of the City Art inventory. Mr. Unnasch estimates maintenance costs at $500 annually. The cost of of relocating the piece is to be determined, as is the permanent site of the piece. If the City Arts Commission approves this specific funding opportunity, staff recommends that the request should be submitted to the Newport Beach Arts Foundation at their next scheduled meeting on Tuesday, November 19, 2019 at 6 p.m. in the Small Conference Room at Central Library. DISCUSSION: The City of Newport Beach maintains two exhibit spaces at the Central Library. The Lobby Gallery in the Central Library has approximately 38 feet of linear wall space designed for two-dimensional pieces of art. Additionally, artists may apply to exhibit three-dimensional works in the two display cabinets added to the lobby of Central Library in 2010. The display cases are approximately 24” high x 24” deep x 24” wide. Artists who want their work considered for display submit a completed Application for Review and Consideration of Art. The Library Services Director manages the gallery space. The City Arts Commission’s Art in Public Places Library Gallery Ad Hoc Subcommittee meets periodically to review artist's submissions; and notifies artists of acceptance. Staff arranges the staging of the art. At their November meeting, the Art in Public Places Library Gallery Ad Hoc Subcommittee recommended that the work of artists Cindy English Gillis and Michael Crook be exhibited subject to City Arts Commission approval. Cindy English Gillis’ sculpture designs are inspirations from “reawakened” treasures she has found on her journeys. When she finds a piece that inspires a thought, object or emotion, she will run with it until she has captured, in three dimensions, the inspiration. Michael Crook’s pieces are mixed media, comprising of wood carved in Bas relief and opaque watercolors, a product of Japan. They are then installed in custom shadowbox frames to accentuate the 3D effect. Exhibition dates are to be determined. Each piece is individually carved, using special carving tools and chisels, and handpainted, using opaque watercolors. He has worked in various media -painting and drawing, photography, silversmithing, stained glass, ceramics, printmaking and woodworking. He was born in Lincoln, Nebraska and raised in Sierra Madre, California. He received his art education at Pasadena City College, Chouinard Art Institute, UCLA and Cal State Los Angeles. 1n 1967, he participated in the Combat Artist program in Vietnam in 1967. Michael's drawings and paintings are a part of the U.S. Army Military Art Collection at the U.S. Army Center of Military History in Washington D.C. His paintings were exhibited in "Vietnam 15" show at University of the Pacific in 1987 and his photography was exhibited in "Healing the Wounds" traveling show (The Vietnam Experience) in 1988.
