" W I T N E S S E T H WHEREAS , CONSULTANT has submitted to CITY a proposal to prepare 'an Initial Study including four projects in the Mariner' s Mile Specific Plan area. WHEREAS , CITY desires to accept said proposal . NOW, THEREFORE, in consideration of the foregoing , the parties hereto agree as follows : 1 . GENERAL CONSULTANT agrees to prepare an Initial Study on the four projects in the Mariner' s Mile Specific Plan area in accordance with the requirements set forth in Paragraph 2 o•f this Agreement. CITY agrees to remit to CONSULTANT the amounts set forth in Paragraph 3 of this Agreement in accordance with the terms and conditions set forth in this document. 2 . SCOPE OF WORK The subject Initial Study will be prepared in accordance with . the Consultant' s proposal dated August 7 , 1978, which is attached to this Agreement marked as Exhibit "A" and by this reference incorporated herein at this point as if fully set forth . 3. BILLING AND PAYMENT CONSULTANT shall be paid under this Agreement on a time and material basis . In no event shall the maximum amount of this Agreement exceed Three Thousand Eight Hundred and no/100 Dollars ($3 ,800) . Partial payments shall be made by CITY to CONSULTANT upon CONSULTANT ' s presentation of statements verifying the time and material costs incurred by it in connection with this Agreement. 4 . FAITHFUL PERFORMANCE CONSULTANT shall use diligent efforts to complete the provisions within thirty (30) days after execution of this Agreement. The subject Initial Study must meet the approval of the Environmental Affairs Committee of the City. 5 . TERMINATION This Agreement is subject to termination by the City at any time upon serving written notice to CONSULTANT. The. CITY shall be thereafter liable to CONSULTANT only for fees and costs incurred as of the date CONSULTANT receives such notice of termination . WESTEC Services , Inca is pleased :-to submit this letter proposal to prepare the :initial studies for fourseparate -but related projects located in Mariner's Mile. Mohle, Perry and Associates will assist WESTEC Services in the '.preparation 'of these .'studies . Scope of Services The initial studies will be based on the Mariner' s Mile Specific Plan and the Mariner' s Mile Specific Plan EIR. The studies will determine the degree towhich the four projects , individually and cumulatively, are consistent with the Specific Plan. In addition, the studies will determine whether the impacts of the proposed projects are within the parameters established in the Specific Plan EIR. WESTEC Services and Mohle, Perry and Associates will prepare an overview which will relate the four "projects to the Specific Plan,. and then will prepare an individual analysis of each of the four projects . The major issues to be considered are land use , traffic, and parking. However, a "checklist" analysis will be completed for the full range of potential impacts . Management and Schedule William Foley of WESTEC Services , and Henry Mohle of Mohle, Perry and Associates will serve as project managers for these studies . The studies will be completed within four weeks of the date of the contract. This schedule assumes prompt provision of site plans and other project data by each applicant, and further assumes that no significant changes in the projects will occur during the study. Fees WESTEC Services will prepare the initial studies for a fee of $3, 800. 00 . This fee will include the submittal of thirty copies of the overview and each individual initial study. Additional studies required to prepare Conditional Negative Declarations or Environ- mental Impact Reports will be subject to the negotiation of a subse- quent contract._ Representation at public hearings , if required by the City of Newport Beach or requested by the applicant, will be provided on a. time and materials basis . Acceptance This proposal shall remain in effect for sixty days . Box 2116 Newport Beach , CA 92663 Dear Mr. Porter : The Community Development Department has had -several requests to review land development and harbor activities permit applications in the Mariners Mile area in the past few months . Your application is one of these proposals , and the project has been evaluated by the staff for possible environmental impacts . There are several issues that are raised in each of the projects•, such as adequate parking , traffic generation and circulation , conversion of existing land uses to office/restaurant/parking lot uses , water quality, and compliance with the Mariners Mile Specific Area Plan. An Environmental Impact Report was prepared in conjunction with the adoption of the Specific Area Plan , but each project must be assessed to determine if any new impacts may result from the specific proposals which were not addressed in the EIR. The City presently does not have sufficient data on file to make this determination. The proposed project must also be evaluated in - light of the recently-adopted Traffic Phasing Ordinance . In order to comply with the requirements of the California Environmental Quality Act, and to make the mandatory findings regarding the appropriate environmental documentation , we must prepare an Initial Study . Since the information which you supplied to us and our own evaluation did not provide sufficient data , our normal procedure is to hire an environmental consultant to research the areas where our data is lacking , and then to prepare the appropriate documentation . We have contacted Westec Services , Inc. to prepare the Initial Study. I would suggest that we set up a meeting , at your convenience , to discuss your project in depth with our staff and the consultant. After this review, we will request a written cost estimate from the consultant. You will be required to deposit this amount with the City plus an administrative fee to initiate the work. No advertising signs shall be displayed on the exterior of the vessels. 7. No sound amplifying equipment be mounted or used on the exterior of the vessel . 8. Any sound eminating from any live or recorded music shall not be audible at a distance of 100 feet from the vessel . 9. The hours of operation be limited to between ll :OO a.m. and 1 :00 a.m. (past midnight) including maintenance operations. Page Two APPLICANT: JIM PORTER 10. Dock side trash containers and minimum refuse disposal of three times weekly be provided. 11. Sewage holding tank pumpout shall be provided in a manner satisfactory to the Marine Director, proof of a contract for holding tank pumpout shall be submitted by the applicant. 12. The chartered group sightseeing tours shall be -limited to the hours between 11 :00 a.m. and 2:30 p.m. 13. Land transportation to the Arches Marina for the daytime sightseeing charter groups shall be by bus only and the applicant shall provide evidence of an off-site parking agreement for the storage of the busses during the hours of the sightseeing tours. 14. On-site parking arrangement shall include provisions for parking of busses during evening hours of operation, ingress and egress for maintenance trucks, and evidence that the parking lot is adequate to handle all businesses using the lot. The CAHP shall not be issued until the above requirements have met the satisfaction of the City Traffic Engineer. 15. The vessels embarkation and debarkation point shall be the Arches Marina. 16. The consumption of alcoholic beverages shall be confined to the vessel. No elaohollc beverages may be removed' from th@ vessel by patrols of th@ vassal , 17. Adequate restrooms shall be provided on the vessel which discharge into holding ' tanks and which shall be approved by the Orange County Health Department. 18. A copy of an Alcoholic Beverage Control License for this vessel shall be provided by the applicant. 19. All litter shall be contained on the vessel for disposal at the Arches Marina. 20. The vessel shall be restricted to the following areas of the Harbor so as to avoid conflicts with other uses of the Harbor: a. Between the Balboa Pavilion and the harbor entrance, the water area lying between Mooring Areas A-10 and A-11 , Mooring Areas A-10 and A-12, bayward of Mooring Areas C-2 and C-3, and no closer than 150 feet to the pierhead line where mooring areas are not established. b. Between the Balboa Pavilion and Coast Highway Bridge, the water area lying between Mooring Areas A-7 and A-8, between Mooring Areas C-1 and A-6, between Areas A-3 and A-6, and no closer than 150 feet of the pierhead line where mooring areas are not established. c. On the Lido Isle Reach, the water areas 150 feet from the pierhead lines on both sides of the channel . d. Off the southeasterly end of Lido Isle, either'easterly of Mooring Area C-1 or close aboard the westerly limits of Mooring Area C-1 , no closer than 150 feet from the pierhead line. ., ,• • • , Page. The South Lido Channel , northerly of Mooring Areas A-4 and A-5, and close aboard Mooring Areas A-2 and B-1 maintaining at least 150 feet from the pierhead lines along Lido Isle, Lido Peninsula and Balboa Peninsula. Discussion This application has been brought to the Joint Harbor Committee for review and recommendation in accordance with the Newport Beach Municipal Code. The Municipal Code also requires this application to be referred to the City Police Department and the Orange County Harbor District for investigation and report. Chapter 17.41 .060 of the Municipal Code requires the following factors to be considered in determining whether to issue a Commercial Activities Harbor Permit or to deny the application. 1. Whether the proposed commercial activity is compatible with the predominantly recreational character of Newport Harbor. 2. Whether the proposed commercial activity is likely to create an unreasonable level of noise which will interfere with the rights of the public to peace and quiet and/or property owners whose properties abut or are in close proximity to the Harbor, to the peaceful enjoyment of their property. 3. Whether the proposed commercial activity will have an adverse effect on the efforts to Wep the Bay free of pollution and litters 4. Whether the vessel or watercraft proposed to be used by the applicant satisfies the applicable standards of the U. S. Coast Guard. 5. Whether the proposed method of operation wi•11 create unreasonable traffic problems in the Newport Harbor, which would interfere with the rights of others to use the harbor. 6. Whether the proposed commercial activity is marine dependent. The applicant has submitted a description of the proposed operation, the vessel he intends to use, and some of the measures he plans to institute to maintain a safe, clean, esthetically pleasing operation (attached as Exhibit I). The proposed operation would consist of "chartered group sightseeing tours" during the day after 11 :00 a.m. and "dinner cruises" in the evening between 7:30 p.m. and 12:00 midnight. The proposed operation will require revisions to the existing boat slips at the Arches Marina, possible revisions to the parking Tot configuration and an amendment to the master lease between the Arches Marina and the County of Orange. The boat slip revision will be accomplished upon approval of plans by the City Traffic Engineer (condition 14). The amendment to the master lease must be accomplished by the master lessee and Orange County Real Property Services. The applicant is currently working with both the City Traffic Engineer and the City Community Development Department to determine parking requirements and methods for compliance with the requirements. The Newport Beach Police Department has reviewed the- proposed operation has submitted two memorandums- indicating a recommendation for approval (attached as Exhibit II). The Marine Department believes that the recommended conditions of approval will provide for compliance with the requirements of "Chapter 17.41 Commercial Activities on the Waters of Newport Harbor" of the Municipal Code should the Joint Harbor Committee and the City Council approve the application. The City Newport of Ne ort Beach LICENSE DIVISION April 24, 1978 Page three LOCATION AND PROPOSED LAND OPERATIONS Contingent on city approval of this application, a 30-year lease has been entered into between the applicant and Newport Arches Marina, Incorporated, the master lessee of the site, for use of parking and docking facilities at the most westerly portion of the Arches Marina at 3333 Pacific Coast Highway. (See Exhibit "C") . The property is owned jointly by the City of Newport Beach and the County of Orange with the County having administrative authority. County staff approval has been obtained , subject to action by the Board of Supervisors. It is important that an unobstructed view of Newport Harbor be maintained. Therefore , specific consideration was given to the design of the vessel and to its docking location. Details are outlined by photographs in Exhibit "D" . Some alteration to the existing dock will be necessary in order to accommodate the proposed vessel. A sketch of the proposed dock alterations is attached as Exhibit "E" . Office space within an existing structure located on the parking lot will be used for ticket sales and other related "on site" activities . No increase in service utilities will be required, and a suitable trash disposal facility will be installed and maintained by a commercial refuse company. On-board sewage holding tanks will be pumped on an as-needed basis by a commercial operator under contract to the applicant. INSURANCE A certificate of insurance will be provided to the City as required by both City Ordinance and the Public Utilities Commission. PARKING After an in-depth review of Code parking requirements and with a regard for good business practices , necessary parking can comfortably and adequately be accommodated in the following. manner: 1. Based upon previous studies , an estimate of three (3) persons per car is considered fair. Again, it is emphasized that all group sales will be contingent on the use of chartered buses for arrival and departure and we look forward . -to a substantial number of group sales. See attached Exhibit "F" for an analysis of available parking. 2. It is also anticipated that a certain percentage of our patrons (particularly by group sales) will visit the Lido Village shops prior to boarding. This practice will permit the use of The Lido Village parking structure and adjacent parking areas. Other nearby parking facilities include the City' s metered parking at Lido' Village and 20 additional day time spaces which have been obtained from the nearby " Villa Nova Restaurant. The Villa Nova has also committed the use of up to 100 night time spaces for our patrons ' use. . MARKETING Potential markets include the general public, corporate meetings, conventions , associations and private groups. These ' markets will be solicited through conventional advertising media, along with personal contact with state and local convention meeting planners , visitor bureaus and hotel sales departments. See Exhibits "G" , "H" and "I" for letters of support for our proposed activity. ENVIRONMENTAL IMPACT The proposed vessel will be constructed to conform to air quality standards as prescribed by law. It will be „ equipped with sewage holding tanks to preclude any possibility of polluting the harbor. The main salon will be fully enclosed and the engines muffled to minimize noise. Again, the vessel will be constructed and docked in such a manner as to have no effect upon the scenic view of the harbor. As indicated in the attached drawing (Exhibit "B") , a "cruise ship" theme will be utilized not only by the design of the vessel, but through nautically uniformed personnel and '" other such innovations. we look forward to providing a most unique and enjoyable experience on the waters of Newport Harbor. Upon approval of this application , the applicant will immediately contract with a boat builder for the construction of the proposed vessel in accordance with the specifications set forth in Exhibit "A" hereto. Pending completion of the proposed vessel , however, the applicant intends to buy or lease a vessel which will comply substantially with Exhibit "A" but which will in any case , meet the code requirements of the City` and of the Coast Guard. This vessel will be placed in service as soon as possible. The City of Newport Beach LICENSE DIVISION April 24, 1978 Page three LOCATION AND PROPOSED LAND OPERATIONS Contingent on city approval of this application, a 30-year lease has been entered into between the applicant and Newport Arches Marina, Incorporated, the master lessee of the site, for use of parking and docking. facilities at the most westerly portion of the Arches Marina at 3333 Pacific Coast Highway. (See Exhibit "C") . The property is owned jointly by the City of Newport Beach and the County of Orange with the County having administrative authority. County staff approval has been obtained , subject to action by the Board of Supervisors. It is important that an unobstructed view of Newport Harbor be maintained. Therefore , specific consideration was given to the design of the vessel and to its docking location. Details are outlined by photographs in Exhibit "D" . Some alteration to the existing dock will be necessary in order to accommodate the proposed vessel. A sketch of the proposed dock alterations is attached as Exhibit "E" . Office space within an existing structure located on the parking lot will be used for ticket sales and other related "on site" activities. No increase in service utilities will be required, and a suitable trash disposal facility will be installed and maintained by a commercial refuse company. .On-board sewage holding tanks will be pumped on an as-needed basis by a commercial operator under contract to the applicant. INSURANCE A certificate of insurance will be provided to the City as required by both City. Ordinance and the Public Utilities Commission. PARKING After an in-depth review of Code parking requirements and with a regard for good business practices , necessary parkipq can comfortably and adequately be accommodated in the following. - manner: 1. Based upon previous studies, an estimate of three (3) persons per car is considered fair. Again, it is emphasized that all group sales will be contingent on the use of chartered buses for arrival and departure and we look forward . •to a substantial number of group sales. As prescribed by the City Code, the requirements for 67 parking spaces will be met by the use of the adjoining parking lot at the Arches Marina. See attached Exhibit "F" for an analysis of available parking. 2. It is also anticipated that a certain percentage of our patrons (particularly by group sales) will visit the Lido Village shops prior to boarding . This practice will permit the use of The Lido Village parking structure and adjacent parking areas. other nearby parking facilities include the City' s metered parking at Lido• Village and 20 additional day time spaces which have been obtained from the nearby Villa Nova Restaurant. The Villa Nova has also committed the use of up to 100 night time spaces for our patrons ' use. . MARKETING Potential markets include the general public, corporate meetings, conventions , associations and private groups. These markets will be solicited through conventional advertising media, along with personal contact with state and local convention meeting planners , visitor bureaus and hotel sales departments. See Exhibits "G" , "H" and "I" for letters of support for our proposed activity. ENVIRONMENTAL IMPACT The proposed vessel will be constructed to conform to air quality standards as prescribed by law. It will be .. . equipped with sewage holding tanks to preclude any possibility . of polluting the harbor. The main salon will be fully enclosed and the engines muffled to minimize noise. Again , the vessel will be constructed and docked in such a manner as to have no effect upon the scenic view of the harbor. Extraordinary efforts will be made. to keep the Harbor free of pollution and litter including on-board holding tanks and trash disposal facilities; 4. All U. 8.
