Brown, City Clerk TITLE: Resolution No. 2019-104: Setting City Council Regular Meeting Dates for Calendar Year 2020 ABSTRACT: Pursuant to City Charter Section 407, City Council regular meetings should be set by ordinance or resolution. RECOMMENDATION: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Adopt Resolution No. 2019-104, A Resolution of the City Council of the City of Newport Beach, California, Setting the Time and Dates of City Council Regular Meetings for Calendar Year 2020. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: The City's Charter reads, in pertinent part, as follows: Section 407. Regular Meetings. The City Council shall hold two meetings per month except in the months of August and December when there shall be at least one regular meeting in August and one regular meeting in December. The City Council shall hold regular meetings at such times as it shall fix by ordinance or resolution. All regular meetings shall be publicly noticed according to the Ralph M. Brown Act, or any successor law. 3-1 Resolution No. 2019-104: Setting City Council Regular Meeting Dates for 2020 December 10, 2019 Page 2 The proposed Resolution sets the following regular meeting schedule for 2020 for the second and fourth Tuesdays of each month, as follows: January 14 and 28 February 11 and 25 March 10 and 24 April 14 and 28 May 12 and 26 June 9 and 23 July 14 and 28 August 11 September 8 and 22 October 13 and 27 November 10 and 24 December 8 City Council Policy A-1 (City Council) sets forth the hours for the conduct of business at each regular meeting. The proposed Resolution incorporates those hours. In addition, the proposed Resolution recognizes that the Mayor or a majority of the members of the City Council may call emergency or special meetings on an as -needed basis in compliance with the Brown Act, or revise the regular meeting schedule when necessary by adoption of a resolution. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). ATTACHMENT: Attachment A — Resolution No. 2019-104 3-2 ATTACHMENT A RESOLUTION NO. 2019404 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, SETTING THE TIME AND DATES OF CITY COUNCIL REGULAR MEETINGS FOR CALENDAR YEAR 2020 WHEREAS, Section 407 of the City of Newport Beach's City Charter directs that the City hold regular meetings at least twice each month except in the months of August and December when there shall be at least one regular meeting in August and one regular meeting in December; and WHEREAS, the Charter also directs that the times and dates of the regular meetings be set by ordinance or resolution. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach, California, as follows: Section 1: The City Council does hereby establish the following dates as the schedule for regular meetings of the City Council for calendar year 2020: CITY COUNCIL REGULAR MEETING SCHEDULE January 14 and 28 February 11 and 25 March 10 and 24 April 14 and 28 May 12 and 26 June 9 and 23 July 14 and 28 August 11 September 8 and 22 October 13 and 27 November 10 and 24 December 8 Section 2: Pursuant to City Council Policy A-1 (City Councio, regular meetings shall begin at 4:00 p.m., or as otherwise scheduled due to the demand of business, for Study Sessions, with Closed Sessions to follow immediately thereafter, followed by recess after Closed Session until reconvening at 7:00 p.m. or as otherwise scheduled due to the demand of business. Section 3: The Mayor or a majority of the members of the City Council may call emergency or special meetings on an as -needed basis in compliance with the Brown Act. The regular meeting schedule may be revised by adoption of a resolution amending the regular meeting schedule. 3-3 Resolution No. 2019 - Page 2 of 2 Section 4: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution. Section 5: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 6: The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Section 7: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution.
