Also included in the application is a request to allow a portion of new second floor living area to encroach 2 feet 6 inches into the 10-foot front yard setback. Additional cornice work or other architectural features shall be limited to a maximum of 8 inches for an overall encroachment of 3 feet 2 inches into the 10-foot front yard setback. Original Request. Dear Ms. Gleiter: The Modifications Committee, on January 31, 2001, voted 3 ayes and 0 noes to approve the application request as modified based on the following findings and subject to the following conditions. FINDINGS: 3300 Newport Boulevard, Newport Beach February 5, 2001 Page- 3 • There are no existing views through or across the property that are enjoyed by adjacent properties. CONDITIONS: 1. The development shall be in substantial conformance with the approved plot plan, floor plans and elevations, except as noted in the following conditions. 2. The structural elements of the front of the building shall not be altered or removed without prior approval by the Planning Director. Demolition of a majority of the front of the building or removal of a substantial portion of the existing structural members at the front of the building shall render this modification permit approval null and void. 3. This approval was based on the particulars of the individual case (remodel of the existing building) and does not in and of itself or in combination with other approvals in the vicinity or Citywide constitute a precedent for future approvals or decisions. 4. The face of the living area portion of the addition shall maintain a minimum front yard setback of 7-feet 6-inches from the front property line. 5. Architectural features including but not limited to cornices, mouldings, raingutters, roof overhang shall be allowed to extend an additional 8 inches into the front yard setback and shall maintain a minimum front yard setback of 3 feet 2 inches. 6. Prior to final of the building permit, a survey performed by a licensed surveyor shall be performed to verify the location of the front yard encroachments. 7. In accordance with the provisions of Chapter 13 of the Newport Beach Municipal Code or other applicable section or chapter, additional street trees shall be provided and existing street trees shall be protected in place during construction of the subject project, unless otherwise approved by the General Services Department and the Public Works Department through an encroachment permit or agreement if required. 8. A building permit shall be obtained prior to commencement of the construction. 9. All work performed within the public right of way shall be reviewed and approved by the Public Works Department under an encroachment permit/agreement if required. 10. This approval shall expire unless exercised within 24 months from the date of approval as specified in Section 20.93.055 of the Newport Beach Municipal Code. February 5, 2001 Page -2 The Modifications Committee determined in this case that the proposal would not be detrimental to persons, property or improvements in the neighborhood and that the modification as approved would be consistent with the legislative intent of Title 20 of the Newport Beach Municipal Code, and made the following findings: 1. The Land Use Element of the General Plan designates the site for "Single Family Detached" residential use and the existing residential structure is consistent with this designation. The project is an addition to the single-family dwelling. 2. This project has been reviewed, and it has been determined that it is categorically exempt from the requirements of the California Environmental Quality Act under Class 1 (Existing Facilities). 3. The modification to the Zoning Code as proposed would be consistent with the legislative intent of Title 20 of the Newport Beach Municipal Code and is a logical use of the property that would be precluded by strict application of the zoning requirements for this District for the following reasons: • The encroachment for the new living area is minor and represents only a portion of the entire width of the structure. • The additional eave and cornice encroachment is minor and will extend only slightly beyond the new structure. 4. The modification to the Zoning Code as proposed will not be detrimental to persons, property or improvements in the neighborhood or increase any detrimental effect of the existing use for the following reasons: • The properties to the north of the subject property generally step up or terrace above the project pad elevation which minimizes any detrimental effect. • The proposed front yard setback encroachment is minor in nature. 5. The proposed front yard addition will not affect the flow of air or light to adjoining residential properties because: • The addition is located at the street side of the property and does not result in any increase in the shadow cast by the proposed building. 6. The proposed front yard encroachment will not obstruct views from adjoining residential properties because: i February 5, 2001 Page-4 The decision of the Committee may be appealed to the Planning Commission within 14 days of the date of the decision.
