Brown Act. Among other things, the Brown Act requires that the special meeting City Arts Commission agenda be posted at least seventy-two (72) hours in advance of the meeting and that the public be allowed to comment on agenda items before the Commission and items not on the agenda but are within the subject matter jurisdiction of the City Arts Commission. The Chair may limit public comments to a reasonable amount of time, generally three (3) minutes per person. The City of Newport Beach’s goal is to comply with the Americans with Disabilities Act (ADA) in all respects. CURRENT BUSINESS A. Items for Review and Possible Action Sculpture Exhibition in Civic Center Park, Phase V - Curatorial Panel Assessment of Submitted Works 4. The curatorial panel, which includes the City Arts Commission, will recommend ten of the submitted works for inclusion in the Sculpture Exhibition in Civic Center Park, as well as three alternates. Draft of 12/12/2019 Minutes Motion made by Commissioner Flanagan, seconded by Commissioner Baker, and carried (7-0-0-0) to approve the Minutes of the December 12, 2019 City Arts Commission meeting as presented. Financial Report – Review of financial information Library Services Director Tim Hetherton reported expenses pertained to maintenance of sculptures and routine items such transcription of the minutes. Expenditures for the 4 Newport Beach City Arts Commission Regular Meeting Minutes January 16, 2020 Page 2 following month would include de-installation of Phase III Sculpture Garden pieces. Staff has prepared a contract amendment for $500 to retain Burnt Matchstick through June 30. In response to Commissioners' questions on the restoration of the Samurai sculpture, Library Services Director Hetherton explained that someone stole the sword from the Friendship Statue located in Irvine Terrace Park over the summer. The restoration firm fabricated a new sword from granite and attached it to the statue. The cost to clean and wax the three bronze statues was $870. When meeting with the City Manager about the budget in February, Library Services Director Hetherton would request additional funding for maintenance of artwork. Staff can present Policies I-9 and I-11 for review and propose revisions such as including a provision for maintenance of public art. The Cultural Arts Grants fund contains approximately $24,000, but that amount will be expended when the last few contracts are completed. The cost for maintenance of Sphere 112 is high because cleaning the many tiny pieces is labor intensive. The piece is cleaned quarterly to prevent discoloration and corrosion. Chair Greer announced the City Council did not approve the grant for the Newport Beach Film Festival. Library Services Director Hetherton advised that he would speak with the Finance Department to determine how to handle the funds awarded to the Film Festival. Chair Greer proposed using the funds for a Backhausdance performance during the Sculpture Garden opening event. 3. Cultural Arts Activities – Monthly review of cultural arts activities from the Library Administrative Office for upcoming Library and City arts events and services Library Services Director Hetherton indicated Gail White's photographic exhibit, Shore and Marsh Birds, is on display in the Central Library gallery. A complementary exhibition of driftwood bird sculpture by Cindy English Gillis is on display in the glass cases. Both exhibitions have received many favorable comments. The City Attorney's Office has reviewed and approved the contract for the State Department of Parks and Recreation grant. The Department of Parks and Recreation has advised that it will retain 3 percent of the grant amount as an administrative fee. The City will receive $485,000 in grant funds. The call for artists for the Sculpture Garden Phase V has closed. Applications have been received for 60 pieces. The public survey would open the following day. Chair Greer noted the costs for the next phase of the Sculpture Exhibition will be slightly more than anticipated and new pads are needed for several of the sculptures. In reply to inquiries, Library Services Director Hetherton related that if the City Arts Commission wishes to install benches in the Sculpture Garden, a funding source would have to be identified and approvals obtained. Staff will pay expenses for the Sculpture Garden from the Sculpture Garden budget and then seek reimbursement from the Department of Parks and Recreation grant. The grant funds are not allocated to specific expenditures. The grant application included a description of the Sculpture Garden project, estimated expenses, and total cost. Administrative Support Technician Francine Jacome reported the Central Gallery is booked through January 2022, and she has received three additional applications. Chair Greer suggested Linda Serrao might have some sculptures that fit inside the glass cases 5 Newport Beach City Arts Commission Regular Meeting Minutes January 16, 2020 Page 3 at Central Library. Library Services Director Hetherton stated the Balboa Island Museum has expressed interest in loaning some pieces for exhibition in Central Gallery. Motion made by Commissioner LeGrand, seconded by Commissioner Baker, and carried (7-0-0-0) to approve the Consent Calendar. Recommendations for 2020 Concerts on the Green – Staff recommends that the City Arts Commission approve the performers recommended by the Performing Arts for Concerts on the Green Ad Hoc Subcommittee for the summer 2020 Concerts on the Green series. Library Services Director Hetherton advised that the community seems to like tribute bands, and the proposed bands are good. Perhaps the four concerts could be scheduled after July 1 and the start of the fiscal year to provide some additional funding for the Sculpture Garden opening event. The City Arts Commission may want to select a performer for the Balboa Peninsula concert at the February meeting. Chair Greer suggested rescheduling the Father's Day concert to July because the weather was cold in 2019 and the Newport Beach Art Exhibition and Sculpture Garden Phase V are planned for the same weekend. Library Services Director Hetherton proposed July 5 for the first Concert on the Green and a second one two weeks later. Commissioner Bendetti recommended scheduling Yachty by Nature or Petty Breakers for July 5. Motion made by Commissioner Bendetti, seconded by Commissioner Flanagan, and carried (7-0-0-0) to approve the recommended performers for the summer 2020 Concerts on the Green series and to approve July 5 as the first concert date. Update on Burnt Matchstick – Staff will discuss the repairs required for Burnt Matchstick. Library Services Director Hetherton advised that the City's vendor for electrician services has assessed Burnt Matchstick and submitted a quote of $2,400 to restore power to the sculpture. 6. Update on Restoration and Relocation of Metalfor Sculpture –Staff will discuss the plan for repairing Metalfor. 6 Newport Beach City Arts Commission Regular Meeting Minutes January 16, 2020 Page 4 Library Services Director Hetherton announced Metalfor does not have to be de-installed until the beginning of 2021, and Legacy Fine Arts has indicated restoration work cannot begin until June 2020. The City Arts Commission has time to find another location for the sculpture after its restoration. Chair Greer explained the process that resulted in Metalfor being placed in its current location. Library Services Director Hetherton recommended the City Arts Commission consider located the sculpture in Sunset Ridge Park. 7. Newport Beach Arts Foundation Contributions to City Arts Commission, 2018-2019 – Staff presents an overview of Newport Beach Arts Foundation gifts in 2018 and 2019. Library Services Director Hetherton listed the Newport Beach Arts Foundation's contributions to City Arts Commission programming in 2018 and 2019, including $5,000 for the 2018 Tijuana Dogs Concert on the Green, $10,000 for 2019 Phase IV Sculpture Exhibition honoraria, and $5,000 for the 2019 Sculpture Exhibition artist luncheon. The Newport Beach Art Exhibition is the primary fundraiser for the Newport Beach Arts Foundation. B. Monthly Reports 8. Metalfor Relocation Ad Hoc Subcommittee – Commissioner Arlene Greer, Commissioner Miriam Baker, Commissioner Ritch LeGrand See Agenda Item VI.A.6 9. Newport Beach Art Exhibition Ad Hoc Subcommittee – Commissioner Arlene Greer, Commissioner Marie Little, Commissioner Maureen Flanagan Chair Greer reported marketing and publicity for the June 20, 2020 Newport Beach Art Exhibition have been determined. The call for artists will open on January 20 and close on May 29. Staff is awaiting bids from some vendors. The subcommittee will likely choose a juror in the next week. Visitors to the Art Exhibition can also visit the Sculpture Exhibition and the Bow Seat Ocean Awareness exhibit in Central Library. In 2020, 30 percent of art sales will be donated to the Arts Foundation, and the Arts Foundation will contribute the donations to City Arts Commission programming. 10. Newport Beach Arts Foundation Liaison Ad Hoc Subcommittee – Commissioner Maureen Flanagan, Commissioner Arlene Greer, Commissioner Marie Little Chair Greer advised that Commissioner Flanagan and she attended the Newport Beach Arts Foundation holiday party in December. She thanked the Arts Foundation for its generous contributions to the City Arts Commission. Pat Jorgensen, Newport Beach Arts Foundation President, presented a Purchase Agreement between the Newport Beach Arts Foundation and Karl Unnasch for the 7 Newport Beach City Arts Commission Regular Meeting Minutes January 16, 2020 Page 5 purchase of Burnt Matchstick. The purchase price of $55,000 is to be paid in five installments of $11,000 each. The City Arts Commission is responsible for obtaining the City Council's acceptance of the gift on or before June 30, 2020, and the City is responsible for relocating and maintaining the sculpture. In answer to queries, Chair Greer indicated the City Arts Commission will seek Council approval of the gift once conditions have been met. Burnt Matchstick has to be relocated, and the subcommittee will explore locations next. Library Services Director Hetherton explained that the community is not pleased with the location of the sculpture next to the flags and with the sculpture being taller than the flagpole. The Council agreed to the current location as a temporary location. Neighbors across the roadway have requested lights at the Civic Center be extinguished at night; therefore, there is some concern about the sculpture being lit. No one has complained about Burnt Matchstick. The estimate to move the sculpture is $10,000-$15,000. Staff will obtain an estimate of maintenance costs. No one could recall how long Burnt Matchstick has needed repairs. Commissioner Kaufman departed the meeting at 6:05 p.m. Laura Curran suggested lighting the sculpture could impact birds, and the location is near a bird habitat. The City Arts Commission may want to prepare an assessment of the impact on birds. 11. Chair Greer requested agenda items for Burnt Matchstick, Backhausdance's proposal regarding the opening celebration of the Sculpture Garden Phase V, review of Policies I-9 and I-11, and an update of Phase V submissions from ArtsOC. VIII. So far, artwork consists of oils, acrylics, watercolors, mixed media and sculptures. The fee to enter is $40 for two pieces, $30 for a single piece. The City Arts Commission will review the recommendations, and make a final recommendation to City Council at the March 10, 2020 regular meeting. DISCUSSION: The Sculpture Exhibition in Civic Center Park is an integral feature of the Newport Beach Civic Center project. Civic Center Park, which turned nearly half a million square feet of undeveloped land into a new public park, was designed by renowned landscape architectural firm Peter Walker and Partners (PWP). PWP developed a master plan for art in the park, and identified various spots in the park where art, particularly sculpture, may be exhibited. The City Arts Commission determined that a rotating exhibition was an optimal approach to bring sculpture to the City in a cost-efficient manner. In August 2013, the Newport Beach City Council authorized the City Arts Commission to implement an inaugural rotational sculpture exhibit in Civic Center Park. The acquisition program that the City Arts Commission developed for the exhibition created a model in which pieces are loaned for a 2-year period. Sculptors of works chosen for the exhibition are provided with a small honorarium to loan their work to the City. The City is responsible for installing the art, while sculptors are responsible for the maintenance and repair of their work. Admission is free and the exhibition continues to be enjoyed by a wide demographic, including schoolchildren, the local community and visitors from Southern California and beyond. In essence, the exhibition has become a “museum without walls” that offers the temporary display of public art that allows the City to avoid the obligation and expense of owning public art. The city sought to have a well-balanced representation of public art that would appeal to a diverse audience of all ages, while including artistic merit, durability, practicality and site responsiveness as criteria in the selection. The rotational nature of the exhibit ensures that residents and guests are exposed to a variety of work. In 2019, City Council authorized Phase V of the exhibit. The City has hired Arts Orange County to manage the project. A call for entry was opened in January 2020 and 66 sculptors submitted works. The February 13, 2020 regular City Arts Commission meeting includes curatorial selection panel meeting where public can express their preferences. In addition to the City Arts Commissioners, the panel will include David Michael Lee and Tyler Stalling. Mr. Lee is Director and Curator of the Coastline Art Gallery at Coastline College in Newport Beach, where he also teaches art. Previously, he oversaw the Phyllis & Ross Escalette Permanent Collection of Art at Chapman University. He holds a BA in photo/studio arts from Columbia College Chicago, and an MFA in drawing, painting and printmaking from California State University Fullerton. He has curated or organized nearly 100 exhibitions at university, community and private art galleries in the region. As an artist, his work has been seen in 7 solo exhibitions and nearly 100 group exhibitions. He studied painting with the celebrated late artist Tony DeLap. Mr. Stallings is director of Orange Coast College’s Frank M. Doyle Arts Pavilion. He was Artistic Director at UCR ARTSblock’s -- encompassing the California Museum of Photography and the Barbara & Art Culver Center of the Arts, from 2007-2017, and was Chief Curator at Laguna Art Museum from 1999-2006. DISCUSSION: At their November 14, 2019 regular meeting, the City Arts Commission approved a funding request to the Newport Beach Arts Foundation for the purchase of Burnt Matchstick. The Foundation agreed to negotiate with the artist for the purchase of the piece. At the January 16, 2020 City Arts Commission meeting, Pat Jorgensen, Newport Beach Arts Foundation President, presented a purchase agreement between the Newport Beach Arts Foundation and sculptor Karl Unnasch. Pending City Council acceptance of the piece into the City art inventory, the parties agreed to a purchase price of $55,000, paid in annual installments of $11,000 over a five-year period. The Newport Beach Arts Foundation has stipulated that the City Arts Commission will be responsible for relocating and maintaining the sculpture in perpetuity. The City Arts Commission should withdraw their request for the purchase of the piece for the following reasons: 1. Relocation and installation: the City Arts Commission’s budget has insufficient funds to pay for the de-installation of the piece from its present location and its installation at its permanent site. Display Inc. estimates that the deinstallation, relocation, and installation of Burnt Matchstick could be as high as $29,885. This figure includes estimates for labor, equipment rentals, excavation, concrete pad installation, engineering, and permits. Display also expressed concern about the effect of the City’s marine environment on their ability to easily de-install and reassemble the piece. 2. Maintenance: While the work’s creator, Karl Unnasch, estimates annual maintenance of the piece at $500, staff thinks the City will incur additional maintenance fees for electrical work. The sculpture’s electrical system failed after 18 months in Civic Center Park, and recent electrical repair work (including specially ordered parts) was quoted at $2,400. Moreover, the cost of maintaining the City’s art inventory continues to increase as the City acquires more art and addresses issues with pieces already in the inventory. For example, the piece Sphere 112, acquired in April 2017, costs the City $3,300 annually for cleaning and maintenance. The City pays $3,936 annually for the maintenance of the Ben Carlson statue. The Tokugawa Ieyasu sculpture in Irvine Terrace Park was recently repaired at a cost of $2,435. In June 2020, Metalfor will be restored at a cost of $4,000. 75 2 of 2 3.Impact upon Newport Beach Arts Foundation support: The Newport Beach Arts Foundation is dedicated to supporting City Arts Commission programming and remains a valued partner in enhancing the cultural experiences of Newport Beach residents and guests. The City Arts Commission relies heavily upon the Foundation for funding support for programs, Sculpture Exhibition honorariums, and expenses outside the City Arts Commission’s general fund support. For example, in 2018 and 2019, the City Arts Commission requested funding assistance from the Newport Beach Arts Foundation on various occasions. The City Arts Commission requested funding to help stage the Frank Sinatra tribute on Father’s Day 2018. The Arts Foundation provided $5,000 to help stage this event. In 2019, the Arts Foundation provided $10,000 to augment the City Arts Commission budget for Phase IV of the Sculpture Exhibition in Civic Center Park to help pay artist honorariums. This private funding proved to be critical in gaining City Council’s support for Phase IV. The Arts Foundation also provided $5,000 for the luncheon held for the Phase IV artists in June 2019 (as they did for all previous phases of the exhibition). This private event for artists, City Council, and the Arts Commission could not have been held without Arts Foundation assistance. If the Arts Foundation allocates $11,000 annually for the next 5 years to the purchase of Burnt Matchstick, their ability to support essential City Arts Commission funding requests will be severely compromised. 4.Borrowing art vs. purchasing art: In 2013, City Council envisioned the Sculpture Exhibition in Civic Center Park as a temporary rotating exhibit of loaned pieces. With City Arts Commission recommendation, the exhibition was conceived as a means to expose residents and guests to a collection of artworks without committing funds towards their purchase or maintenance. The temporary rotating exhibit offers guests and residents the facility to enjoy pieces for a 2-year period with minimal cost to the City. Conversely, if residents and guests dislike a piece, they can take consolation in the fact that it will be gone in 2 years. Purchasing art truly is a forever proposition, and public artworks require active management and the budget to support that management. Staff appreciates the effort that the Arts Foundation has put into acquiring Burnt Matchstick, and the deep appreciation of the piece among the members of the City Arts Commission. However, for the reasons detailed above, staff cannot recommend the acquisition of the piece.
