TITLE: Underground Utility Assessment District No. 117 — Notice of
Completion for Contract No. 7337-1
ABSTRACT:
On June 26, 2018, City Council awarded Contract No. 7337-1 for the Underground Utility
Assessment District No. 117 project to Asplundh Construction Corp. The work is now
complete and staff requests City Council acceptance and close out of the contract.
RECOMMENDATION:
a) Accept the completed work and authorize the City Clerk to file a Notice of Completion
for the project. On June 26, 2018, the City Council found this project exempt from the
California Environmental Quality Act (CEQA) pursuant to Class 2 Section 15302(d);
b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the
Notice of Completion has been recorded in accordance with applicable portions of
Civil Code; and
c) Release Faithful Performance Bond one year after acceptance by the City Council.
FUNDING REQUIREMENTS:
Funds for this construction contract were included within the approved Capital
Improvement Program budget and were expended from the following accounts:

DISCUSSION:
Underground Utility Assessment District No. 117 (AD 117) is the first City managed and
constructed utility undergrounding construction project that undergrounded overhead
power, telephone and cable facilities. AD 117 is the area bounded by Bayside Drive,
Avocado Avenue, Coast Highway and Carnation Avenue and includes 268 properties
within district boundaries.
The undergrounding construction work for AD 117 included traffic control, water pollution
control, trenching, the construction of vaults, vents, pull boxes, handholes, installing
conduit with poly -pull ropes and associated items necessary such as backfilling,
pavement restoration, resurfacing and replacement of existing concrete improvements for
the conversion of existing overhead electrical power, telephone, and cable television
services to underground locations as required by the contract.
The project was complex and proved to be challenging due to issues with groundwater,
broken sewer mains and laterals that needed repair, obstructions with abandoned gas
and water mains, and existing concrete encasements in alleys where conduits were to be
constructed. There were also plan changes to the SCE design that required more work
and additional conduit that had to be constructed for Time Warner Cable. Seventy-seven
change orders were approved for the abovementioned work, bringing project costs to
24.8 percent above the original contract award amount. In anticipation of this first ever
undergrounding effort managed by the City, a Contingency Allowance of 15% was
approved at the time of award. City Manager approval was obtained per Council policy
to increase that to the final 24.8% contingency allowance.

Contract No. 7337-1, Underground Utility Assessment District No. 117, has been
completed to the satisfaction of the Public Works Department. The final negotiated
contract amount is $2,704,451.48. A summary of the construction cost is as follows:

A summary of the project schedule is as follows:

Public Works staff directed the contractor to delay the start of work until Summer 2018 in
order to minimize traffic disruptions related to the Christmas holiday and other year-end
events plus wait until school's summer session to remove traffic impacts to school drop-
off and pick-up times. The start delay, coupled with utility challenges during construction,
extended the contract completion date to June 14, 2019. Post construction work items
and change order negotiations with the contractor contributed to the delay for the closeout
of this contract. To date, all but one of the SCE connections to the properties have been
completed. AT&T and Time Warner will be finalizing their connections in the next couple
months and poles should be removed by end of Summer, as anticipated.
ENVIRONMENTAL REVIEW:
On June 26, 2018, City Council found this project exempt from the California
Environmental Quality Act (CEQA) pursuant to Section 15302(d) Class 2 (conversion of
overhead electrical utility distribution lines where the surface is restored to the condition
existing prior to the undergrounding) of the CEQA Guidelines, California Code of
Regulations, Title 14, Chapter 3, because it will not have an adverse effect on the
environment.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
