(ECI). This project will restore 11.3 acres in the central portion of Big Canyon Nature Park by removing non-native Brazilian Pepper Trees, other invasive plants and trees, and pest -infested willows, and replant with fire-resistant and pest -free native plants and trees. RECOMMENDATION: a) Find the requirement for environmental review under the California Environmental Quality Act ("CEQA") is satisfied by the January 22, 2019 Council adoption of Resolution No. 2019-9, A Resolution of the City Council of the City of Newport Beach, California, Adopting Mitigated Negative Declaration No. ND2018-001 (SCH No. 2018081098) for the Big Canyon Coastal Habitation Restoration and Adaptation Project - Phase 2A (PA2018-078), including the Mitigation Monitoring and Reporting Plan, prepared for the Big Canyon Coastal Habitat Restoration and Adaptation Project - Phase 2A (PA2018-078), pursuant to the California Environmental Quality Act, State CEQA Guidelines and City Council Policy K-3; b) Approve the project drawings and specifications; c) Award Contract No. 8208-2 to ECI for the total bid price of $985,348, and authorize the Mayor and City Clerk to execute the contract; and d) Establish a contingency of $147,000 (approximately 15 percent of total bid) to cover the cost of unforeseen work not included in the original contract. 6-1 Big Canyon Restoration Project — Phase 2A — Award of Contract No. 8208-2 (20X12) June 9, 2020 Page 2 FUNDING REQUIREMENTS: Sufficient funding is available in the current Capital Improvement Program budget for the award of this contract. The proposed project will be expensed to Account No. 13801- 980000-20X12 (Environmental Contributions) for the Big Canyon Restoration Project — Phase 2A project. The City and Newport Bay Conservancy (NBC) have been working together cooperatively on a plan to restore the Phase 2A area of Big Canyon Nature Park. NBC has been awarded two grants totaling $1,688,731 to fund the implementation of the Phase 2A restoration. Proposed fund uses are: Vendor Environmental Construction, Inc Environmental Construction, Inc. On -Call Inspection Services On -Call Geotechnical Services Purpose Amount Construction Contract $ 985,348 Construction Contingency $ 147,000 Inspection Services $ 99,000 Geotechnical Servcies $ 5,000 Total: $ 1,236,348 Staff recommends establishing $147,000 (approximately 15 percent of ECI bid) for contingency purposes and unforeseen conditions associated with construction. Pursuant to the terms of an agreement with NBC, the proposed FY 2020-21 Capital Improvement Program Budget will include an appropriation of $100,000 from the Upper Newport Bay Restoration Fund, a tidelands trust fund designated for construction of improvements that benefit the Upper Newport Bay. These funds will cover any auxiliary tasks or improvements such as trail improvements, or other unforeseen and non -grant eligible costs associated with the project. DISCUSSION: The proposed Big Canyon Restoration Project — Phase 2A straddles Big Canyon Creek and covers 11.3 acres in the central portion of Big Canyon Nature Park (see attached Location Map). The project will remove and replace existing invasive exotic vegetation, stabilize the creek banks and restore connectivity with the floodplain, restore riparian habitat and create a mosaic of native and (fire and pest) resilient habitats that promote biodiversity and healthy ecosystems. A 6.3 -acre portion of the project area is populated almost solely by non-native Brazilian Pepper Trees ("Clearing and Grubbing" area). The restoration of this area includes complete removal of the pepper tree grove, including root systems, with subsequent replanting with native plants. The other 5.0 -acre portion of the project includes Brazilian pepper trees intermixed with willows and other native vegetation. In these areas, Brazilian 6-2 Big Canyon Restoration Project — Phase 2A — Award of Contract No. 8208-2 (20X12) June 9, 2020 Page 3 pepper trees, invasive plants, and willows infected by the polyphagous pothole borer will be selectively removed ("Select Removal" areas). On February 11, 2020, the City entered into an agreement where NBC will use the grant funds identified above to reimburse the City for costs associated with hiring a construction contractor, geotechnical consultant, outside contract inspectors, and other consultants or inspectors as needed. In return, City agrees to manage the construction. At 10:00 a.m. on May 15, 2020, the City Clerk opened and read the bids for this project: The City received six bids for this project. The low bidder, Environmental Construction, Inc. (ECI), possesses a California State Contractor's License Classification "C27", as required by the project specifications. ECI has successfully implemented several important projects for the City including the Buck Gully Restoration Project (2012) and the Big Canyon Phase - 1 Project (2017). The low bid by ECI is 18 percent below the Engineer's Estimate of $1,200,000. The six bids show a good spread with three bids below the Engineer's Estimate and three bids above. The current economic downturn may have been a factor in the more competitive bids. Pursuant to the Contract Specifications, the Contractor shall have 80 consecutive working days to complete all construction tasks within the "Clearing and Grubbing" areas. An additional 30 consecutive working days is allowed to complete removals within the "Select Removal" areas. The Plant Maintenance and Establishment period is 120 consecutive calendar days, which commences after the Engineer has determined the work complete in in the Clearing and Grubbing areas. Agency permits for the project prohibit commencement of work until after the bird - breeding season. NBC will hire a biologist to inspect the project site for nests. If no nests are found, it is possible that construction could start mid-August. An early project start is desirable as it would be possible to be substantially complete with the project tasks before the end of the year ahead of the typical storm seasons when construction would need to cease due to muddy conditions on site. Portions of the project are so densely vegetated that neither City staff nor the contractor has been able to specifically scope the level of effort to remove pepper trees and perform grading along the creek.
