Good morning, sorry we had technical difficulties last night on the zoom session (first time that has happened to me),
but I have some suggestions as to wording on the city council resolution for tonight. This is somewhat a repeat of what
Sue Dvorak read last night as she was reading from an email I sent her.
My view and how Newport Beach should respond is:
Since Addendum 16 forced the respondents to back track on the OC Supervisors resolution / commitment on retaining
the balance of hangars and tie downs commensurate with the current ratios through the yellow / green designated
areas, we must require the supervisors to define a way to immediately codify their commitment (the Steel Amendment)
through the appropriate legal or contractual framework that will protect the original commitment, and ensure its
survival to the conclusion of the lease terms, irregardless of changes in political leadership and/ or airport or county
administration going forward.
The City of Newport Beach should ensure any resolution by the council :
• Demand the county provide this guaranteed framework before beginning negotiations with winning bidders
and,
Request a delay in both the airport commissioners meeting and Supervisors meetings of August 5 and August 11
respectively, until this framework has been defined, publicly posted, and approved
The above in rough words is what I think would be the appropriate path forward.
In addition, the AWG legal counsel has questioned the legality of enforcing Amendment 16 to the RFP as it is in conflict
with a legal requirement passed by the OC Supervisors on protecting the yellow / green spaces with direction that the
green area be set aside as hangars and tie downs for small aircraft, as the EIR 627 is now a conflict with the OC BOS
action which was not rescinded . Could the city research this? This may be grounds for a delay
