TITLE: Annual Concrete Replacement Program — Notice of Completion for
Contract No. 7682-1 (20R06)
ABSTRACT -
On February 11, 2020, City Council awarded Contract No. 7682-1 for the Annual
Concrete Replacement Program project to S&H Civilworks, Inc. The work is now
complete and staff requests City Council acceptance and close out of the contract.
RECOMMENDATION:
a) Accept the completed work and authorize the City Clerk to file a Notice of Completion
for the project;
b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the
Notice of Completion has been recorded in accordance with applicable portions of
Civil Code; and
c) Release Faithful Performance Bond one year after acceptance by the City Council.

This project included replacement of deteriorated sidewalks, driveways, curbs and
gutters, and removal of overgrown trees within the Harbor View, Newport Ridge and
Newport Coast neighborhoods.
The contracted work has now been completed to the satisfaction of the Public Works
Department. A summary of the construction cost is as follows:

The final contract cost was $788,894.60, which was approximately 3.3 percent higher
than the original bid amount. The actual cost of bid items constructed was approximately
$77,000 below the original bid amount as some of the concrete improvements were not
necessary as determined in the field. The overall project cost increase was primarily due
to additional concrete improvements needed to address existing drainage issues at
various locations.

The start of construction was delayed by approximately one month as a result of
contractor contractual issues. This contract was originally awarded to the lowest
responsible bidder, Western Construction Specialist, Inc., who informed the City that they
were unable to meet the construction schedule as required by the contract documents.
The City subsequently awarded this contract to the next lowest responsible bidder, S&H
Civilworks, Inc., who was able to complete the work within the allowed contract time.

ENVIRONMENTAL REVIEW:
On February 11, 2020, the City Council found this project exempt from the California
Environmental Quality Act (CEQA) pursuant to Section 15301(c), Class 1 (maintenance
of existing public facilities involving negligible or no expansion of use) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential to have a significant effect on the environment.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
