TITLE: Resolution No. 2020-87: Adding Street Sweeping Parking
Restrictions on Terrace Ridge
ABSTRACT:
In order to address parking conditions and street sweeping effectiveness, staff is
proposing the establishment of parking restrictions for street sweeping purposes on
Terrace Ridge on Tuesdays between 7:00 a.m. and 9:00 a.m.
RECOMMENDATION:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA)
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because
this action will not result in a physical change to the environment, directly or indirectly;
and
b) Adopt Resolution No. 2020-87, A Resolution of the City Council of the City of Newport
Beach, California, Establishing "No Parking" Restrictions on Designated Streets on
Specific Days and Times to Improve Street Sweeping Effectiveness and Rescinding
Resolution No. 2017-66.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item.
DISCUSSION:
Residents of the Newport Ridge Estates have indicated to staff their concerns with cars
parking for extended periods on Terrace Ridge, a street adjacent to their neighborhood.
They have noted that it is difficult for the street sweeper to properly sweep with the long-
term parking of vehicles. The residents have requested that parking restrictions for street
sweeping purposes be established to address their street sweeping and other parking
concerns.

Staff is recommending rescinding Resolution No. 2017-66 and adopting a new Resolution
to add parking restrictions for street sweeping purposes on both sides of Ridge Park on
Tuesdays between 7:00 a.m. and 9:00 a.m. Attachment A shows the limits of the
proposed parking restrictions.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH, CALIFORNIA, ESTABLISHING "NO
PARKING" RESTRICTIONS ON DESIGNATED STREETS
ON SPECIFIC DAYS AND TIMES TO IMPROVE STREET
SWEEPING EFFECTIVENESS AND RESCINDING
RESOLUTION NO. 2017-66
WHEREAS, Section 12.44.150 of the Newport Beach Municipal Code ("NBMC")
provides that the City Council shall by resolution designate streets or portions of streets on
which the parking or standing of vehicles is to be prohibited.
WHEREAS, the City Council shall designate in the resolution the days of the week
and the exact hours during which such prohibition shall be in effect; and
WHEREAS, the City Council has determined that it is reasonable and in the public
interest to prohibit parking of vehicles at certain times and in certain areas of the City in order
to effectively operate the City street sweeping program.
NOW, THERFORE, the City Council of the City of Newport Beach resolves as
follows:
Section 1: The City Council hereby prohibits the parking of vehicles between the
hours of 8:30 A.M. to 12:30 P.M. on the following days and in the following areas:

Section 10: In accordance with NMBC Section 12.44.150(6), the City Traffic
Engineer shall erect all necessary signs to provide notice of said parking restrictions.
Section 11: All prior versions of "No Parking" restrictions on designated streets
on specific days and times to improve street sweeping effectiveness are hereby repealed,
including Resolution No. 2017-66.
Section 12: The recitals provided in this resolution are true and correct and are
incorporated into the substantive portion of this resolution.

Section 13: If any section, subsection, sentence, clause or phrase of this
resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not
affect the validity or constitutionality of the remaining portions of this resolution. The City
Council hereby declares that it would have passed this resolution, and each section,
subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or
more sections, subsections, sentences, clauses or phrases be declared invalid or
unconstitutional.
Section 14: The City Council finds the adoption of this resolution is not subject to
the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the
activity will not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3,
because it has no potential for resulting in physical change to the environment, directly or
indirectly.
Section 15: This resolution shall take effect immediately upon its adoption by the
City Council, and the City Clerk shall certify the vote adopting this resolution.
