TITLE: Confirmation of Appointment to the Newport Beach Restaurant
Association Business Improvement District Advisory Board of
Directors
ABSTRACT:
The California Streets and Highways Code Sections 36500 et seq., grants the City
Council the authority to appoint an advisory board for Business Improvement Districts
formed under the Parking and Business Improvement Area of Law of 1989.
On June 23, 2020, the City Council appointed eleven (11) applicants to the NBRA BID
Advisory Board of Directors for FY 2020-2021. On July 24, 2020, the City Clerk's Office
learned of an unscheduled vacancy on the Board of Directors.
RECOMMENDATION:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA)
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because
this action will not result in a physical change to the environment, directly or indirectly;
and
b) Appoint Micah Schiesel, representing The Lounge Group, to the NBRA BID Advisory
Board of Directors for term ending June 30, 2021.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item.
DISCUSSION:
The Newport Beach Restaurant Association Business Improvement District (NBRA BID)
was formed pursuant to the Parking and Business Improvement Area Law of 1989 (1989
Law), codified in Streets and Highways Code Sections 36500 et seq., for the purpose of
financing activities and programs to benefit businesses located and operating in the area.

The City Council has the authority to appoint an Advisory Board to the NBRA BID and
limit membership on the Advisory Board to persons subject to the BID assessment. The
Advisory Board that serves on the NBRA BID is not appointed in the same manner as
other City Boards, Commissions, and Committees. The City relies on the Streets and
Highways Code for Business Improvement District advisory board appointments rather
than City Council Policy A-2, Boards, Commissions and Committees.
On July 24, 2020, the City Clerk was informed that Kenyon Paar had resigned from her
position at the Five Crowns restaurant. The City Clerk prepared and posted a Notice of
Unscheduled Vacancy on July 27, 2020, in the City Clerk's Office, on the City's webpage,
and on the bulletin board located in the City Council Chambers; and published the Notice
of Vacancy in the Daily Pilot on July 29, 2020. Four (4) applications were considered for
the vacant seat.
It is the NBRA BID Advisory Board's desire to fill the unscheduled vacancy on the Board
of Directors for the remaining FY 2020-21 term, ending June 30, 2021. The NBRA BID
Advisory Board of Directors reviewed the applications on file at its September 23, 2020
meeting and is recommending that the City Council appoint Micah Schiesel, representing
The Lounge Group, to the Advisory Board of Directors for FY 2020-2021.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
