09 - Approval of a Purchase Agreement for the Purchase of Rescue Ambulances
Q EwPpRT O c — '9 CITY OF NEWPORT BEACH City Council Staff Report TO: FROM: PREPARED BY: PHONE: TITLE: ABSTRACT: October 27, 2020 Agenda Item No. 9 HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL Jeff Boyles, Fire Chief - 949-644-3101, jboyles@nbfd.net Mary Locey, Fire Administrative Manager, mlocey@nbfd.net 949-644-3352 Approval of a Purchase Agreement with Halcore Group, Inc., DBA Leader Industries for the Purchase of Rescue Ambulances The Fiscal Year 2020-21 (FY 2020-21) budget includes funding for the purchase of three rescue ambulances. The request to purchase is per City Council Policy F-9: City Vehicle/Equipment Replacement Guidelines with a waiver of City Council Policy F-14: Authority to Contract from a single source provider. RECOMMENDATIONS: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; b) Waive City Council Policy F-14; and c) Approve a Purchase Agreement with Halcore Group, Inc., DBA Leader Industries for a total not to exceed amount of $980,977.67 for the purchase of three rescue ambulances. FUNDING REQUIREMENTS: The current adopted budget includes $320,000 in appropriations for the replacement of each rescue ambulance for a total of $960,000. The budgeted replacement cost is based on the most recent purchase price plus an allowance for annual increases in CPI. In 2018, two rescue ambulances were replaced at a cost of $300,000 each. Due to changes in specifications, the new units have a replacement cost of $326,992.56 each for a total purchase price of $980,977.68. Funds are set aside annually in an internal service fund (ISF) to ensure critical equipment and infrastructure can be replaced on a perpetual basis. If approved, the additional $20,977.67 will be covered by the ISF appropriated in the FY 2020-21 adopted budget. This will also adjust the vehicle replacement and maintenance rates for similar vehicles in future budget years. This purchase will be expensed to the equipment purchase budget (Account No. 7529032-911016) in the Public Works Department. 9-1 Approval of a Purchase Agreement with Halcore Group, Inc., DBA Leader Industries for the Purchase of Rescue Ambulances October 27, 2020 Page 2 DISCUSSION: The Fire Department operates a fleet of six rescue ambulances, three of which are in service 24 hours per day, seven days per week as frontline ambulances. The remaining three reserve ambulances are deployed as needed during periods of high call volume, for large community events, or when the frontline ambulances are in for service. The age and mileage of the ambulances currently in service are shown in the table below. Per City Council Policy F-9 (Attachment B), City Vehicle/Equipment Replacement Guidelines, the replacement schedule is eight years or 100,000 miles for frontline ambulances and four years for reserve ambulances. Frontline ambulances are specifically assigned to a fire station for daily use. After eight years or 100,000 miles, these ambulances rotate out of the frontline status and into the reserve status. Reserve ambulances are used for an additional four years during peak periods and/or when frontline ambulances are in for maintenance and/or repairs. Providing emergency medical services is a vital part of the Fire Department's service delivery, accounting for approximately 80% of the calls for service. A rescue ambulance (referred to in the industry as a medic van) provides lifesaving personnel, equipment and transportation to the hospital for the residents and visitors of Newport Beach. Additionally, the ambulances and personnel can be routed to calls for service in neighboring cities when needed. Due to the high volume of medical -related calls, rescue ambulances spend a large amount of their service life on the road responding to incidents, transporting patients to area hospitals, and often being dispatched again before returning to the station. These heavy-duty vehicles tend to have high mileage and carry a large amount of heavy medical equipment inside, which puts additional stress on the tires, brakes, shocks and chassis. Funds for the replacement of three -rescue ambulances are included in the FY 2020-21 budget. The new ambulances are scheduled to replace the current 2013 models - Unit 2646, Unit 2647, and Unit 2648. The estimated delivery for each ambulance is 150 to 175 days from the time the vendor receives the chassis. 9-2 • • 'JA FTIM n. Since then, the City has purchased six Leader ambulances. Leader's ambulances have proven to be reliable over the last seven years of use by the department. r Ji The standardized fleet for the department's paramedics allows personnel and their equipment to easily transition between the 4ti4, ambulances. This is a critical time- saving element during emergency ® If response situations. From a maintenance standpoint, there is a reduction in the type and amount of Photo credit: Leader Industries training required for the fleet mechanics and they can stock similar replacement parts for use throughout the fleet, which is easier to manage and more cost effective. Additionally, the units are assembled in South EI Monte, which ensures a quick turnaround for warranty repairs, parts, or other needed services. To maintain consistency for fire personnel, as well as fleet maintenance personnel, staff recommends purchasing the three rescue ambulances from Leader. Staff requests City Council's approval to forego the competitive bidding procedures pursuant to City Council Policy F-14: Authority to Contract (Attachment C), normally applicable to an equipment purchase of this amount and scope. This request takes into consideration the benefits detailed in this section of fleet consolidation and the fact that Leader is a local ambulance manufacturer. This single source purchase approval request is being made because a direct purchase in this instance serves a greater benefit to the City as opposed to conducting a bid. Leader provided a price quote of $326,992.56 per vehicle for the requested ambulances. The price includes factory rebates and a multi -unit purchase discount. See the cost details in the below table. Even though no competitive bidding was administered for this purchase, staff performed a due diligence analysis of the proposed pricing and compared it to prices paid by other fire agencies for their ambulances. Staff found the pricing to be consistent with recent purchases of Leader rescue ambulances. 9-3 Leader Ford Type 196/173 Ambulance $303,462.00 $910,386.00 Sales Tax (7.75%) 23,518.31 70,554.93 California Tire Fee ($1.75 per tire)(7 tires) 12.25 36.75 Total Purchase Price $326,992.56 $980,977.68 Even though no competitive bidding was administered for this purchase, staff performed a due diligence analysis of the proposed pricing and compared it to prices paid by other fire agencies for their ambulances. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). FORCE MAJEURE Vendor shall not be assessed with liquidated damages or unsatisfactory performance penalties during any delay beyond the time named for the performance of this Agreement caused by any act of God, war, civil disorder, employment strike or other cause beyond its reasonable control, provided that Vendor gives written notice of the cause of the delay to City within forty-eight (48) hours of the start of the delay and Vendor avails itself of any available remedies. i lloomelaat1:l`Ir►s1Ikr'i Vendor agrees to maintain the confidentiality of all City and City -related records and information pursuant to all statutory laws relating to privacy and confidentiality that currently exist or exist at any time during the term of this Agreement. Types of Contracts and Method of Award It is recognized that by their nature, service contracts cannot always be awarded as a result of a competitive bid process. However, competitive proposals should be obtained whenever possible before resorting to negotiated awards. F, L • I F-14 A. Professional Services Contracts Professional consultant services differ from other services in that they are of a professional nature, and due to the ethical codes of some of the professions involved, as well as the nature of the services provided, do not readily fall within the competitive bidding process. Professional consultants should be individually selected through a qualifications -based selection process for a specific project or service based on demonstrated competence and qualifications for the types of services to be performed and with the objective of selecting the most qualified consultant at a fair, reasonable and verifiably appropriate cost. The procedures for achieving this goal shall be adopted and applied by the City Manager in the Administrative Procedures Manual. This section shall include, but not be limited to, procurements for services in the following fields: Engineering (civil, mechanical, electrical, structural, traffic, geotechnical, etc.); Building plan review and grading plan review and/or inspection services; Architecture; Landscape Architecture; Construction Project Management Firms; Environmental; Planning; Economic Analysis; Property Appraisals; Land Surveying; Financial Services; Data Processing Services; Legal Services not otherwise authorized in the section titled Authority to Enter into Contracts, A (3), of this policy; and Training and Temporary Labor Services.
