On March 12, 2020, Governor Newsom issued Executive Order N-25-20, which allows staff to attend Zoning Administrator meetings by electronic means. Please be advised that to minimize the spread of COVID-19, the Zoning Administrator may attend this meeting either electronically or telephonically. Also, please be advised that on March 17, 2020, Governor Newsom issued Executive Order N-29-20, which allows for the public to participate in any meeting of the Zoning Administrator telephonically or by other electronic means. Given the health risks associated with COVID-19, the City of Newport Beach will conduct this meeting via Zoom. As a member of the public, if you would like to participate in this meeting, you can participate via the following options: 1. You can submit your questions and comments in writing for the Zoning Administrator to consider. Please send them by email to the Community Development Department at CDD@newportbeachca.gov by Wednesday, November 11, 2020, at 12:00 p.m. to give the Zoning Administrator time to consider your comments. All emails will be made part of the record. 2. You can connect with a computer by joining through Zoom. Click the link below to register for the meeting using a valid email address. Brown Act. Among other things, the Brown Act requires that the Zoning Administrator agenda be posted at least seventy-two (72) hours in advance of each regular meeting and that the public be allowed to comment on agenda items before the Zoning Administrator and items not on the agenda but are within the subject matter jurisdiction of the Zoning Administrator. The Zoning Administrator may limit public comments to a reasonable amount of time, generally three (3) minutes per person. The City of Newport Beach’s goal is to comply with the Americans with Disabilities Act (ADA) in all respects. If, as an attendee or a participant at this meeting, you will need special assistance beyond what is normally provided, we will attempt to accommodate you in every reasonable manner. NOTICE REGARDING PRESENTATIONS REQUIRING USE OF CITY EQUIPMENT Any presentation requiring the use of the City of Newport Beach’s equipment must be submitted to the Community Development Department 24 hours prior to the scheduled meeting. If in the future, you wish to challenge in court any of the matters on this agenda for which a public hearing is to be conducted, you may be limited to raising only those issues which you (or someone else) raised orally at the public hearing or in written correspondence received by the City at or before the hearing. APPEAL PERIOD: An appeal may be filed with the Director of Community Development or City Clerk, as applicable, within fourteen (14) days following the date the action or decision was rendered unless a different period of time is specified by the Municipal Code (e.g., Title 19 allows ten (10) day appeal period for tentative parcel and tract maps, lot line adjustments, or lot mergers). Recommended Action 1.Approve and File IV.PUBLIC HEARING ITEMS Balboa Wine Minor Use Permit No. UP2020-167 (PA2020-266) Site Location: 611 East Balboa Boulevard 2. Project Summary The applicant requests a minor use permit to allow the operation of a 925-square-foot retail store specializing in wine sales and accessory wine tastings (off-sale alcohol). Floor area dedicated to accessory wine tasting is proposed at approximately 125 square feet and includes eight (8) seats. The Applicant intends to acquire a Type 02 (Winegrowers) Alcoholic Beverage Control (ABC) license. No late hours (after 11:00 p.m.) are proposed as part of this application. 1.Conduct a public hearing; 2.Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15301 and 15303 under Class 1 (Existing Facilities) and Class 3 (New Construction or Conversion of Small Structures ), respectively, of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential to have a significant effect on the environment; and 3.Adopt Draft Zoning Administrator Resolution No. _ approving Minor Use Permit No. UP2020-167. Cameo Highlands Lot Line Adjustment No. LA2020-003 (PA2020-080) Site Location: 4800 Surrey Drive, 716 and 722 Cameo Highlands Drive 3. Project Summary A lot line adjustment to realign the rear property line between three residences located at 4800 Surrey Drive, 716 and 722 Cameo Highlands Drive. The lot line adjustment will shift the existing rear property line between the three parcels in a southerly direction, reallocating approximately 1,019 square feet of land to the properties at 716 and 722 Cameo Highlands Drive. Recommended Action 1.Conduct a public hearing; November 12, 2020 Page 3 Zoning Administrator Meeting 2.Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15305 under Class 5 (Minor Alterations in Land Use Limitations) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential to have a significant effect on the environment; and 3.Adopt Draft Zoning Administrator Resolution No. _ approving Lot Line Adjustment No. LA2020-003. V.PUBLIC COMMENTS ON NON-AGENDA ITEMS Public comments are invited on agenda and non-agenda items generally considered to be within the subject matter jurisdiction of the Zoning Administrator. Speakers must limit comments to three (3) minutes. Before speaking, we invite, but do not require, you to state your name for the record. The Zoning Administrator has the discretion to extend or shorten the speakers’ time limit on agenda or non-agenda items, provided the time limit adjustment is applied equally to all speakers.
