SUBJECT: Request to extend the time limit for Commission action on City of Newport
Beach LCP Amendment Request No. LCP-5-NPB-20-0060-2 Part A and Part B
(No. 2-20), for Commission action at its December 9, 2020 hearing.
On September 30, 2020, the City of Newport Beach submitted a request to amend the City's
certified Local Coastal Program (LCP) it included two parts, Part A with City Council Ordinance
No. 2020-12, and Part B with City Council Resolution No. 2020-72 authorizing submittal of the
LCP amendment to the Commission. The two-part amendment was deemed filed complete on
October 13, 2020. The LCP amendment request only involves the Implementation Plan portion
of the LCP. Part A would amend the IP to revise Setback Map No. S-1A to adjust the required
setbacks for property located at 6501/6503 Seashore Drive, Part B involves IP "clean up"
correcting and clarifying regulations related to minimum lot size and dimensions, overlay zoning
districts, and public hearing notice requirements.
Pursuant to Sections 30512, 30513 and 30514 of the Coastal Act, an IP amendment must be
scheduled for a public hearing and Commission action within 60 working days of the co.mplete
submittal. The 60th day after the October 13, 2020 complete submittal filing is December 12,
2020. Coastal Act Section 30517 and Section 13535(c) of the Coastal Commission
Regulations state that the Commission may extend for good cause the 60-day time limit for a
period not to exceed one year. In this case, Commission staff is requesting the time extension
due to insufficient staff time to adequately review the amendment and prepare a
recommendation. Given the volume of workload and operational constraints related to the
current public health crises, the requested time will allow for Commission review and resolution
of any issues or scheduling conflicts that may arise. Therefore, staff recommends that the
Commission extend the time limit for up to a year because extensions are only considered
once, and it is prudent to allow for the maximum amount of time in case of unexpected delays.
Although staff believes this matter will be brought to a hearing in the near-term, staff
recommends that the Commission extend the deadline for a full year as provided by the
Coastal Act to allow for uncertainty in the review process and flexibility for coordination with
the City of Newport Beach on potential modifications, establishing hearing schedules, and
managing competing priorities.
STAFF RECOMMENDATION
Staff recommends a YES vote. An affirmative vote of the majority of the Commissioners
present is needed to pass the motion.
