The property is not located within a Planned Unit Development or an overlay district. For the abutting properties to the north and south, the Zoning District is Commercial Corridor (CC) and the General Plan land use designation is Corridor Commercial (CC). The properties across Coast Highway are within the Private Institutions (PI) Zoning District and the Private Institutions (PI) General Plan land use designation. The properties to the east are within the Two-Unit Residential (R- 2) Zoning District and the Two-Unit Residential (RT) General Plan land use designation. At the time the building permits were finaled, the building and parking requirements were in substantial conformance with the development standards of the City of Newport Beach Municipal Code. If the subject property does not comply with the current regulations, it is considered to be nonconforming and is subject to Chapter 20.38 (Nonconforming Uses and Structures) of the Newport Beach Municipal Code. Research of the permit and entitlement history of the property verifies that discretionary approvals were acquired from the City of Newport Beach Planning Division for development of the property. With the exception of the discretionary PA2019-199 approvals for signs, copies of those approvals are attached. The hours of operation are 8:00 am to 7:00 pm, weekdays and Saturdays. It is anticipated that no more than two employees and two to four patrons will occupy the facility at any one time. The facility will not provide massage services at this time. The property is located in the RSC District. Director's Action: Approved,August5,2005 The Planning Director, in approving this application, analyzed issues with regard to the parking requirements of Chapter 20.66 of the Newport Beach Municipal Code. The detailed discussion can be found in the attached appendix. In consideration of those aspects, the Planning Director determined in this case that the proposal would not be detrimental to persons, property or improvements in the neighborhood. In addition, the approved Use Permit would be consistent with the legislative intent of Title 20 of the Newport Beach Municipal Code based on the following findings: FINDINGS: 1. The proposed use is consistent with the Land Use Element of the General Plan and is compatible with the surrounding land uses. PA2019-199 2. This project has been reviewed, and it has been determined that it is categorically exempt from the requirements of the California Environmental Quality Act under Class 1 (Existing Facilities). 3. The approval of Planning Director's Use Permit No. UP2005-028 (PA2005-127} will not - under the circumstances of this case-be detrimental to the health, safety, peace, morals, comfort and general welfare of the city for the following reasons: • The proposed use is a support use for the residential, office and commercial properties in the area and surrounding neighborhoods. • The health and fitness facility, based on its limited class size, will have a parking demand that can be adequately accommodated by the existing on-site available pool of parking. The anticipated peak demand periods will not generally conflict with the peak demands of the other remaining uses on-site. • The noise impacts on the adjacent residential and commercial uses have been addressed to prevent any potential noise complaints by requiring that the doors and windows remain closed during the business hours of the establishment and the performance of the individual or class instruction sessions. The tenant space will primarily be used as a personal improvement facility specializing in pilates/fitness conditioning with limited size group sessions. The operator of the instructional facility shall be responsible for the control of noise generated by the subject operation. The noise generated by the proposed use shall comply with the provisions of Chapter 10.26 of the Newport Beach Municipal Code. Any changes to the existing parking lot configuration shall be subject to further review by the City Traffic Engineer for the on-site parking, vehicular circulation and pedestrian circulation systems. STANDARD CITY REQUIREMENTS: 1. All signs shall conform to the provisions of Chapter 20.67 of the Municipal Code (Sign Code). 2. The facility shall be designed to meet exiting and fire protection requirements, as specified by the Uniform Building Code and shall be subject to review and approval by the Building Department. 3. The project shall comply with State Disabled Access requirements. 4. Should this business be sold or otherwise come under different ownership, any future owners or assignees shall be notified of the conditions of this approval by either the current business owner, property owner or the leasing company. 5. No temporary "sandwich" signs, balloons or similar temporary signs shall be permitted, either on-site or off-site, to advertise the health and fitness facility, unless specifically permitted in accordance with the Sign Ordinance of the Municipal Code. Temporary signs shall be prohibited in the public right-of-way, unless otherwise approved by the Public Works Department in conjunction with the issuance of an encroachment permit or encroachment agreement. The facility is generally limited to provide physical fitness/conditioning services. As shown on the floor plan, the overall square footage of the personal service facility is approximately 1,300 square feet. Parking Requirement Since the subject use is a personal service use, the parking demand is not any greater than for a general office or a retail use that is permitted by right without approval of a use permit. Hours of Operation The applicant has indicated that the daily hours of operation are 8:00 am to 7:00 pm. The latest sessions are finished by 7:00 pm. Staff has recommended a closing hour of 9:00 pm for the facility. This will adequately address the present and future needs of the facility. Noise Concerns The early sessions have the greatest potential to create adverse noise impacts with neighboring and adjacent properties. In order to prevent potential noise concerns, staff recommends that the doors of the facility remain closed at all times. This is especially critical during the early morning sessions. Music is generally not utilized during training sessions, but if utilized the volume will be limited. Staff believes that the noise issues are adequately addressed by the recommended conditions of approval that include strict compliance with the Noise Ordinance of the Municipal Code and restrict the hours of operation. Should noise complaints occur, Standard City Requirement No. 4 above allows the Planning Director or the Planning Commission to add or modify conditions of approval to address the complaint.
