In relation to the above-referenced application, the City entered into a Professional Services Agreement
with Kimley-Horn and Associates, Inc. dated 6/15/20 to complete the contemplated supporting EIR
Addendum and related documentation and analyses. Kimley Horn is now being directed to perform
work beyond the original Scope of Services under the Agreement to prepare certain additional analyses
and comprehensively respond to the various allegations raised in project opposition letters received late
on 1/11/21.
This letter shall memorialize the obligation by the applicant, The Picerne Group, to be financially
responsible for such additional costs and expenses incurred by the City in having Kimley Horn perform
this additional work. Of course, please let us know if you will need anything additional to so proceed on
this matter.
