Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Brad Sommers, Principal Civil Engineer, bsommers@newportbeachca.gov PHONE: 949-644-3326 TITLE: Resolution No. 2021-22: Authorizing the Request for Delay of Measure M2 Project V Funding for the Balboa Island/Corona del Mar Microtransit Feasibility Study Project ABSTRACT: The City of Newport Beach (City) successfully applied for and was awarded Orange County Transportation Authority (OCTA) Measure M2 Project V grant funds to prepare the Balboa Island/Corona del Mar Microtransit Feasibility Study. This project is intended to study the feasibility of local transit options to increase mobility in and around the Balboa Island and Corona del Mar communities. The COVID-19 pandemic has caused, at least temporarily, a sharp decline in transit operation, reduced public opinion of transit and changed traffic patterns. It has also limited the opportunities for public outreach. For these reasons, staff proposes to delay the project to ensure the study can accurately represent the communities' travel patterns, needs and desires. To comply with OCTA Combine Transportation Funding Program (CTFP) guidelines, staff requests City Council adoption of Resolution No. 2021-22, authorizing a formal request for delay of project funding from Fiscal Year 2021 to Fiscal Year 2023. RECOMMENDATION: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Adopt Resolution No. 2021-22, A Resolution of the City Council of the City of Newport Beach, California, Authorizing a Request for the Orange County Transportation Authority to Delay Measure M2 Comprehensive Transportation Funding Program Project V Funds for the Balboa Island/Corona del Mar Microtransit Feasibility Study Project to Fiscal Year 2023. 6-1 Resolution No. 2021-22: Authorizing the Request for Delay of Measure M2 Project V Funding for the Balboa Island/Corona del Mar Microtransit Feasibility Study Project March 23, 2021 Page 2 DISCUSSION: As part of the 2019 OCTA Project V call for projects, the City successfully applied for and was awarded $58,500 in Project V grant funds to prepare the Balboa Island/Corona del Mar Microtransit Feasibility Study. This study is intended to analyze the feasibility of local transit options to increase mobility in and around the Balboa Island and Corona del Mar communities. The Covid-19 pandemic has caused a sharp decline in transit operation, reduced public opinion of transit, significantly changed traffic patterns and limited opportunities for public outreach. Understanding these pandemic -related conditions may be temporary, staff has delayed the project to ensure that necessary, normalized travel demand and pattern data can be collected so that the study will accurately represent the long-term needs of and the potential uses by the community. As the crisis continues and there is no clear date on when the conditions will "normalize", staff plans to request the maximum 24 -month project funding delay from OCTA, programming the funding for Fiscal Year 2022-23. If the project is able to begin earlier, a request can be made to OCTA to advance the funding if necessary. FISCAL IMPACT: The Fiscal Year 2020-21 Capital Improvement Program Budget includes $65,000 for completion of the Balboa Island / Corona Del Mar Microtransit Feasibility Study (21T13). The funding includes $58,500 in OCTA Project V grant funds and $6,500 as the required 10 percent local grant match. In partnership with the City, the Balboa Island Marketing, Inc. and Balboa Island Improvement Association pledged to provide the required $6,500 local grant match as a contribution. The appropriated project funds will be reprogrammed through the budget adoption process. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). ATTACHMENT: Attachment A — Resolution No. 2021-22 6-2 ATTACHMENT A RESOLUTION NO. 2021-22 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA AUTHORIZING A REQUEST FOR THE ORANGE COUNTY TRANSPORTATION AUTHORTY TO DELAY MEASURE M2 COMPREHENSIVE TRANSPORTATION FUNDING PROGRAM PROJECT V FUNDS FOR THE BALBOA ISLAND/CORONA DEL MAR MICROTRANSIT FEASIBILTY STUDY PROJECT TO FISCAL YEAR 2023 WHEREAS, the Orange County Transportation Authority ("OCTA") conducted a Call for Projects under its Comprehensive Transportation Funding Program's ("CTFP") Community -Based Transit/Circulators Program ("Project V") under the Renewed Measure M ("M2"); WHEREAS, the City of Newport Beach ("City") has received an allocation of $58,500.00 in Project V funds for the Balboa Island/Corona del Mar Microtransit Feasibility Study Project; WHEREAS, the City initially established Fiscal Year 2021 as the program year for the Project; WHEREAS, the COVID 19 crisis has delayed the Balboa Island/Corona del Mar Microtransit Feasibility Study Project because the ability for data collection and the public outreach necessary has been limited; and WHEREAS, CTFP Guidelines require agencies to request authorization from their governing board if delays are expected to be incurred beyond the allocated funding Fiscal Year. NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: Section 1: The City of Newport Beach hereby authorizes the request for a 24 month delay of Project V funding for the Balboa Island/Corona del Mar Microtransit Feasibility Study Project and that OCTA reprogram the funding to Fiscal Year 2023. Section 2: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution. 6-3 Resolution No. 2021 - Page 2 of 2 Section 3: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 4: The City Council finds the adoption of this resolution exempt from the requirements of the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Section 5: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution.
