A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH DECLARING CITY°S INTENTION TO VA-
CATE A PORTION OF LA JOLLA DR.; ACCEPTING A MAP
SHOWING THE PORTIONS OF LA JOLLA DR. AND OTHER
AREAS RESERVED FOR EASEMENTS WHICH ARE PROPOSED
• TO BE VACATED; SETTING APRIL 9, 1984 AS THE DATE
FOR THE PUBLIC HEARING CONCERNING THE INTENDED
VACATION (NRTHLY OF THE INTERSECTION OF SANTA ANA
& LA JOLLA DR.)
WHEREAS, the City Council of the City of Newport Beach,
pursuant to the provisions of the Street Vacation Act and all
amendments thereto, being Sections 8300 to 8325 and 8340 to 8353
inclusive of the Streets and Highways Code of the State of
California, provides for the vacation of easements; and
WHEREAS, the property owners on La Jolla Dr., have
requested that the easterly half of La Jolla Dr. be vacated; and
WHEREAS, La Jolla Dr. is presently improved from Santa
Ana Ave. to 120 ft. north, with improvements ending south of 206
La Jolla Dr.; the improved portion leaved 15 ft. of unused
right-of-way; and
WHEREAS, all utilities have been notified and the
Southern California Edison Company has requested that an easement
be reserved adjacent to Lots 45, 46 and 47 for their facilities,
which easement will be reserved over that portion to be vacated;
and
WHEREAS, the City will also reserve an 8 ft. wide slope
easement, as well as retaining a storm drain eastment on the
property; and
WHEREAS, the area to be vacated is described on a two -
page map, and depicted on a map, copies of which are attached
hereto marked Exhibits "A" and "B" respectively, and incorporated
• herein by reference; and
WHEREAS, proceedings for vacation of the above -
described areas shall be undertaken by the City Council of the
City of Newport Beach, pursuant to the provisions of the Street
Vacation Act of 1941 and all amendments thereto, being Sections
8300 and 8325 and 8340 to 8353 inclusive, of the Streets and
Highway Code of the State of California.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach, that notice is hereby given that the
City Council of the City of Newport Beach does hereby fix April
9, 1984 at the hour of 7:30 p.m. of said day, in the City Council
Chambers of the City of Newport Beach, located at 3300 Newport
• Boulevard, Newport Beach, California, as the time and place for
hearing all persons interested in, or objecting to, the proposed
vacation proceedings, and the City Council at said time and place
will hear any evidence offered by any person interested in said
vacation; and
BE IT FURTHER RESOLVED that this Resolution of Intent
shall be published at least once in the official newspaper of the
City, and said publication shall be made before the date set for
the hearing of all persons interested in or objecting to the
proposed vacation.

Those portions of La Jolla Drive, 40.00 feet wide, lying easterly
and southeasterly of the centerline of said La Jolla Drive as shown on a map
of Tract No. 444 recorded in book 19, Page 29, of Miscellaneous Maps, Records
of Orange County, California, more particularly described as follows:
Parcel 1
Beginning at the most northerly corner of Lot 46 of said tract;
thence N 500 38' 07" W along the northwesterly prolongation of the northeast-
erly line of said lot to the centerline of said La Jolla Drive; thence south-
westerly along said centerline to the northwesterly prolongation of the north-
easterly line of Lot 49 of said tract; thence southeasterly in a direct line
to the most northerly corner of said lot; thence northeasterly along the north-
westerly lines of Lots 48, 47 and 46 of said tract to the point of beginning.
Reserving therefrom, an easement for storm drain purposes more
particularly described as follows:
Beginning at the intersection of the northwesterly prolongation
of the northeasterly line of said Lot 46 and a line parallel with and 15.00
feet northwesterly, measured at right angles, from the northwesterly line of
said lot; thence N 500 38' 07" W along said prolongation to the centerline of
said La Jolla Drive; thence S 590 48' 36" W along said centerline 15.00 feet;
thence easterly in a direct line to the point of beginning.
Also reserving therefrom, an easement for Southern California Gas
Company facilities more particularly described as follows:
Beginning at the most northerly corner of said Lot 46; thence
N 500 38' 07" W along the northwesterly prolongation of the northeasterly line
of said lot to a line parallel with and 15.00 feet northwesterly, measured at
right angles, from the northwesterly line of said lot; thence S 590 48' 36" W
along said parallel line 120.00 feet; thence southeasterly at right angles from
said parallel line, to the northwesterly line of said Lot 48; thence north-
easterly along the northwesterly lines of Lots 48, 47 and 46 to the point of
beginning.
Parcel 2
Beginning at the most northerly corner of said Lot 49; thence
N 510 50' 13" W along the northwesterly prolongation of the northeasterly line
of said lot to a non -tangent curve having a radius of 111.60 feet and which is
concentric to and 15.00 feet northwesterly, measured radially, from that
certain curve having a radius of 96.60 feet in the easterly right-of-way line

of said La Jolla Drive; thence southerly along said curve through a central
angle of 970 23' 49" a distance of 145.91 feet to the westerly prolongation
of the southerly line.of Lot 50 of said tract; thence S 680 49.' 25" W along
said prolongation to the easterly terminus of that certain curve having a radius
of 25.00 feet in the southerly .boundary of said lot; thence westerly and north-
westerly along said curve through a central angle of 580 34' 42" and a distance
of 25.56 feet to the beginning of said 96.60-foot-radius curve in said easterly
right of way line of La Jolla Drive; thence along said right of way line and
said curve through a central angle 820 45' 08" a distance of 139.52 feet to
the point of beginning.
Reserving therefrom a strip of land, 8.00 feet wide as a slope
easement, the westerly line of which is described as follows:
Beginning at the intersection of the northwesterly prolongation
of the northeasterly line of Lot 49 of said tract and a curve
having a radius of 111.60 feet and which is concentric with and
15.00 feet westerly, measured radially, from that certain curve having a radius
of 96.60 feet in the easterly right of way line of said La Jolla Drive; thence
southerly along said curve through a central angle of 970 23' 49" a distance
of 145.91 feet to the westerly prolongation of the southerly line of said
Lot 50. The side lines of said strip of land shall be prolonged or shortened
at the beginning so as to terminate in said northwesterly prolongation of the
northeasterly line of Lot 49 and at the end thereof so as to terminate in said
westerly prolongation of the southerly line of Lot 50.
Also reserving therefrom that portion of a strip of land 35.00 feet
wide, as a public utilities easement, lying within the above -mentioned Parcel 2
and lying 20.00 feet northerly and 15.00 feet southerly of and adjacent to the
following described centerline:
Beginning at a point in the boundary of Lot 29 of said tract, said
point being the southeasterly terminus of a curve concave northeasterly and
having a radius of 136.60 feet and a length of 7.92 feet; thence northeasterly
along a radial line N 550 28' 07" E a distance of 40.00 feet to said easterly
right of way line of La Jolla Drive.
