CALL TO ORDER – The meeting was called to order at 10:00 a.m. Staff Present (Remote): Jaime Murillo, Zoning Administrator Joselyn Perez, Assistant Planner Melinda Whelan, Assistant Planner Afshin Atapour, Planning Technician II. REQUEST FOR CONTINUANCES Afshin Atapour, Planning Technician, requested Item Number 5 be continued to May 13, 2021. III. APPROVAL OF MINUTES ITEM NO. 1 MINUTES OF MARCH 25, 2021 Action: Approved IV. PUBLIC HEARING ITEMS ITEM NO. 2 703 Jasmine LLC Condominiums Tentative Parcel Map No. NP2021-001 (PA2021-023) Site Location: 703 and 703 ½ Jasmine Avenue Council District 6 The Zoning Administrator provided a brief description stating this is a basic application for a tentative parcel map for a two-unit condominium. A duplex has been demolished and a new duplex is under construction. No waivers of Title 19 (Subdivisions) are proposed. Applicant and owner, Josef Szigeti, stated that he had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. One member of the public, Mr. Jim Mosher, spoke and identified a minor typographical error in the resolution. He also commented that the City is undergoing a Housing Element Update that focuses on providing more affordable units and that typically an existing duplex tends to be more affordable than a for-sale condominium. He asked if there is a mechanism to allow a condominium approval and map to be deleted in the future and revert back to the duplex. The Zoning Administrator explained that the property owner could rescind the condominium approval and we would work with the County to rescind the condominium map. This process has been used in the past. The Zoning Administrator closed the public hearing. Action: Approved as amended MINUTES OF THE MEETING OF THE NEWPORT BEACH ZONING ADMINISTRATOR 04/15/2021 Page 2 of 3 ITEM NO. 3 Fanticola Residence Coastal Development Permit No. CD2020-155 (PA2020-360) Site Location: 80 Linda Isle Council District 5 Joselyn Perez, Assistant Planner, provided a brief project description stating that the request is for a coastal development permit to allow the demolition of an existing single-family residence and the construction of a new single-family residence within the private community of Linda Isle. The proposed home complies with all applicable development standards. The project also includes the raising and reinforcing of an existing bulkhead to an elevation of 10.90 (NAVD88) for protection against coastal hazards. This coastal development permit does not authorize any improvements seaward of the bulkhead, such as the replacement of an existing cantilevered deck, and subsequent permitting from the California Coastal Commission is required for any work on the deck. Assistant Planner Perez then stated that there are designated public viewpoints of the coast nearby to the project site however the distance between the project site as well as the design of the building should ensure that the views of the coast are not negatively impacted. Applicant JR Walz of Walz Architecture, on behalf of the Owner, stated that he had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. One member of the public, Mr. Jim Mosher, spoke and stated that the project plans did not have an architects rendering and he also noted that there is another coastal viewpoint at the Upper Castaways Park albeit the project site is not very visible from there. The Zoning Administrator closed the public hearing. The Zoning Administrator clarified that renderings are not a requirement for a planning application and then asked Assistant Planner Perez to add Upper Castaways Park to Fact number 12 in support of Finding A. Action: Approved as amended ITEM NO. 4 Cook Residence Coastal Development Permit No. CD2021-007 (PA2021-028) Site Location: 1410 West Ocean Front Council District 1 Afshin Atapour, Planning Technician, provided a brief project description stating that this is for a Coastal Development Permit (CDP) to allow for the remodel and addition of an existing 3,478-square-foot, two-story, single-family residence with an attached 506-square-foot, two-car garage. The proposed addition and remodel would result in a 3,615-square-foot, three-story, single-family residence with an attached 527-square-foot, two- car garage. The project includes new landscape, hardscape, and site walls and will utilize existing drainage facilities within the confines of the private property. The design complies with all applicable development standards and no deviations are requested. The Zoning Administrator asked staff to clarify the third-floor area standards, which staff confirmed that the applicant is complying with the standards. The Zoning Administrator asked staff to include a bird’s eye aerial view in future staff reports to show and assist with neighborhood compatibility. The Zoning Administrator requested clarification from the Applicant about the second-floor balcony encroachment into the front yard setback. Applicant, Katelynn Rodgers, of Brion Jeannette Architecture stated that she would comply with the thirty-six inch maximum encroachment of the second story balcony. The Zoning Administrator asked staff to move facts three and four in support of Finding B to facts in support of Finding A in the resolution. The Zoning Administrator asked staff to include a condition of approval into the resolution clarifying the second story balcony encroachment to comply with the municipal code. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. Action: Approved as amended ITEM NO. 5 Chipotle Mexican Grill Lot Merger No. LM2021-002 and Staff Approval No. SA2021-001 (PA2021-009) Site Location: 3040 and 3050 East Coast Highway Council District 6 Action: Continued to the May 13, 2021, Zoning Administrator meeting. V. PUBLIC COMMENTS ON NON-AGENDA ITEMS None. VI. ADJOURNMENT The hearing was adjourned at 10:25 a.m. The agenda for the Zoning Administrator Hearing was posted on April 9, 2021, at 11:10 a.m. on the digital display board located inside the vestibule of the Council Chambers at 100 Civic Center Drive and on the City’s website on April 9, 2021, at 11:00 a.m.
