TITLE: Resolution No. 2021-67: SB 2 Permanent Local Housing Allocation
Grant Application and Five -Year Plan
ABSTRACT:
In 2017, Senate Bill (SB 2) created the Building Homes and Jobs Act and the Permanent
Local Housing Allocation (PLHA) program. The purpose of the program is to provide a
permanent funding source for affordable housing and related programs through recording
fees on real estate transactions. The majority of the revenues collected will go to local
jurisdictions through an application process and will be allocated in the same manner as
the Community Development Block Grant (CDBG) program. The City of Newport Beach
is entitled to receive $1,017,678 over the current five-year application period.
RECOMMENDATION:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA)
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because
this action will not result in a physical change to the environment, directly or indirectly;
b) Adopt Resolution No. 2021-67, A Resolution of the City of Newport Beach, California,
Authorizing the Application and Adopting the PLHA Plan for the Permanent Local
Housing Allocation Program; and
c) Authorize the City Manager to execute the PLHA Program Application, the PLHA
Standard Agreement and any subsequent amendments as required by the State of
California.
DISCUSSION:
SB 2 was passed in 2017 and created the Building Homes and Jobs Act and the PLHA.
The purpose of the bill is to establish a permanent source of funding for affordable
housing. Revenue for this program is generated through recording fees on real estate
transactions and will therefore vary from year to year depending on activity.

Beginning in 2019, the majority of the revenues collected will flow to local jurisdictions
through the PLHA funding allocation. This application period covers 2019 through 2023.
PLHA funds are distributed to local agencies using the same formula as the Community
Development Block Grant (CDBG) program. The State Department of Housing and
Community Development (State HCD) has determined that the City of Newport Beach
(City) is entitled to approximately $1,017,678 over the five-year period covered by the
application (2019-2023). Should the application be approved, the City will receive its 2019
and 2020 allocation, totaling approximately $433,244.
The PLHA funds provides a stable funding source for local governments to address the
affordable housing stock shortages in the following manner:
• Increase the supply of affordable housing
• Increase assistance to affordable, owner -occupied, workforce housing
• Assist persons experiencing or at risk of homelessness
• Facilitate housing affordability
• Promote projects and programs to meet the local government's unmet share of
the regional housing needs allocation.
The City must submit a PLHA program application to receive the funding allocation. The
application must meet the following requirements:
• The City's Housing Element is in substantial compliance with State Housing
Element Law
• The City submitted the General Plan's Annual Progress Report to State HCD as
required
• The PLHA application requests an allocation to one or more eligible activities and
the submission is authorized by the City Council
• PLHA funds distributed to a program operation do not have a conflict of interest
and must be accessible to the public.
• A five-year, PLHA activity plan (incorporated into the application) is approved and
adopted by the City Council.
The proposed Plan, as outlined in Attachment B, requests that the City fund eligible
activities as identified in Section 301(a)(6) of the SB 2 Guidelines which, in part, state:
"Assisting persons who are experiencing or At risk of homelessness,
including, but not limited to, providing rapid rehousing, rental assistance,
supportive/case management services that allow people to obtain and retain
housing, operating and capital costs for navigation centers and emergency
shelters, and the new construction, rehabilitation, and preservation of
permanent and transitional housing..."
This program will provide on -going financial assistance to fund a portion of the City's
share of the costs for the Navigation Center in Costa Mesa.

FISCAL IMPACT:
Should the City receive the grant award, staff will return with a budget amendment. The
State estimates that the City will receive $1,017,678 through this program over the five-
year period covered by the application. These funds will reduce the amount of General
Fund resources that would otherwise be required to support the Navigation Center
operations hosted by the City of Costa Mesa.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
Per HCD requirements, a public notice was published in the Daily Pilot on July 17, 2021,
informing the public of the five-year PLHA plan. The plan is also made available for review
on the City's website. The public was invited to comment on the plan during the ten (10)
day review period from July 16, 2021 through July 26, 2021. Any public comments will be
presented to the City Council at the time of the meeting.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, AUTHORIZING
THE CITY MANAGER TO APPLY FOR THE PLHA
GRANT AND ADOPTING THE PLHA PLAN FOR THE
PERMANENT LOCAL HOUSING ALLOCATION
PROGRAM
WHEREAS, the State of California ("State"), Department of Housing and
Community Development ("Department') is authorized to provide up to $304 million under
the SB 2 Permanent Local Housing Allocation ("PLHA") Program Formula Component
("Program") from the Building Homes and Jobs Trust Fund for assistance to Cities and
Counties (as described in Health and Safety Code section 50470 of seq.);
WHEREAS, the Department issued a Notice of Funding Availability ("NOFA")
dated May 3, 2021, under the PLHA Program;
WHEREAS, the City of Newport Beach ("City") is an eligible local government that
has applied for program funds to administer one or more eligible activities, or a local or
Regional Housing Trust Fund to which an eligible local government delegated its PLHA
formula allocation; and
WHEREAS, the Department may approve funding allocations for PLHA Program,
subject to the terms and conditions of the PLHA Guidelines, NOFA, Program
requirements, the standard agreement, and other contracts between the Department and
PLHA grant recipients.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as
follows:
Section 1: The City Council does hereby represent and certify that if the City
receives a grant of PLHA funds from the Department pursuant to the above referenced
PLHA NOFA, the City will use all such funds in a manner consistent and in compliance
with all applicable state and federal statutes, rules, regulations, and laws, including,
without limitation, all rules and laws of the PLHA Program, as well as any and all contracts
between the City and the Department.
Section 2: City is hereby authorized and directed to receive a PLHA grant, in an
amount not to exceed the five-year estimate of the PLHA formula allocations, as stated
in Appendix C of the current NOFA of Four Hundred Nine Thousand Three Hundred
Eighty -Two Dollars and 00/100 ($409,382.00), in accordance with all applicable statutes,
rules, regulations, and laws.

Section 3: City hereby agrees to use the PLHA funds for eligible activities as
approved by the Department and in accordance with all Program requirements,
Guidelines, other statutes, rules, regulations, and laws, as well as in a manner consistent
and in compliance with the standard agreement and other contracts between the City and
the Department.
Section 4: Pursuant to Section 302(c)(4) of the PLHA Guidelines, Applicant's
PLHA Plan for the 2019-2023 Allocations is attached to this resolution, and City hereby
adopts this PLHA Plan and certifies compliance with all public notice, public comment,
and public hearing requirements in accordance with the Guidelines.
Section 5: City certifies that it has or will subgrant some or all of its PLHA funds
to another entity or entities. Pursuant to Section 302(c)(3) of the PLHA Guidelines, "entity"
means a housing developer or program operator, but does not mean an administering
local government to whom a local government may delegate its PLHA allocation.
Section 6: Pursuant to City's certification in this resolution, the PLHA funds will
be expended only for eligible activities and consistent with all Program requirements.
Section 7: City shall be subject to the terms and conditions as specified in the
standard agreement, the PLHA Program Guidelines, and any other applicable SIB 2
Guidelines published by the Department.
Section 8: The City Manager is hereby authorized to execute the PLHA
Program Application, the PLHA Standard Agreement and any subsequent amendments
or modifications thereto, as well as any other documents which are related to the Program
or the PLHA grant awarded to the City, as the Department may deem appropriate.
Section 9: The recitals provided in this resolution are true and correct and are
incorporated into the operative part of this resolution.
Section 10: If any section, subsection, sentence, clause or phrase of this
resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not
affect the validity or constitutionality of the remaining portions of this resolution. The City
Council hereby declares that it would have passed this resolution, and each section,
subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or
more sections, subsections, sentences, clauses or phrases be declared invalid or
unconstitutional.

Section 11: The City Council finds the adoption of this resolution is not subject to
the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the
activity will not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3,
because it has no potential for resulting in physical change to the environment, directly or
indirectly.
Section 12: This resolution shall take effect immediately upon its adoption by the
City Council, and the City Clerk shall certify the vote adopting the resolution, to -wit -

Instructions: It the Local Government Recipient of the PLHA Formula Allocation delegated its PLHA formula allocation to a Local Housing Trust Fund or to another Local Government,

§302(c)(4l(Al Describe the manner in which allocated funds will be used for eligible activities.
The City of Newport Beach is desiring to use our allocation to assist person who are experiencing or at risk of being homeless. The City of Newport Beach is in partnership with the City of Costa Mesa for
shelter services. The City contracts for 20 beds at an annual cost of $1,000,000 per year that increases annually by the Consumer Price Index, The current agreement is for a five year term. The shelter is
located at 3175 Airway Avenue, Costa Mesa_ PHLA funds will be used to support the City's 20 beds which include day -today shelter activity, related homeless outreach services, and assistance to hlep
persons who are experiencing or at risk of homelessness to obtain and retain housing.
§302(c)(4)(B) Provide a description of the way the Local government will prioril investments that increase the supply of housing for households with incomes at or below 60 percent of Area Median Income
(AMI).
PHIA funding will only be allocated for homeless services, and serving the homeless meets the requirement to priortize investments that increase the supply of housing for households with incomes at or

The City's current Housing Element, 2014-2021 identifies sites that could provide the 4,612 new hosing units in compliance with the Slate's Regional Housing Needs Assessment as shown on page 5-53 of

The City of Newport Beach entered into a Memodanum of Understanding (MOU) with the City of Costa Mesa_ This MOU identifies the services that will be provided by the City of Costa Mesa in support of our
homeless population. The MOU identifies the responsibilities of Costa Mesa to provide all services necessary to miss the needs of the City's homeless population. Both cities have agreed that this regional
approach to providing services jointly benefits both communizes without additional expensive shelter operations, In addilon to these costs, the City of Newport Beach provides staff resources including a
Homeless Liasion Coordinator, Homeless Liasion Officer and a social services provider that works to move people from the street to the Costa Mesa Bridge Shelter.

§302(e)(4)(E)(iii) A description of major steps/actions and a proposed schedule for the implementation and completion of the Activity.
The City has completed two major steps in workng with the CiVs homeless population. The first step is having a 5 year contract with City Net, a social services contractor who has the skill set and education
to assist the homeless population. The City sees this as an on -going committment of program implementation and funding as the we still have a homeless population that needs assistance. It is anticipated
that this contract will be in place through the 2023 grant period. In addition, the City has a Memorandum of Understanding with the City of Costa Mesa to provide 20 shelter beds to the City of Newport Beach
for the next five years with two optional five year extensions. This contract will be in place through the grant period. This has been a very effective tool to assist our home€ess population and provide them the
necessary support to enter into long-term housing.

PERMANENT LOCAL HOUSING ALLOCATION (PLHA) PROGRAM APPLICATION AND
FIVE-YEAR PLAN
NOTICE IS HEREBY GIVEN that a public hearing will be conducted by the Newport Beach City
Council on Tuesday, July 27, 2021, at 4:00 p.m., or soon thereafter as the matter shall be
heard, a public hearing will be conducted in the City Council Chambers at 100 Civic Center Drive,
Newport Beach. The City Council of the City of Newport Beach will consider the following item:
Consideration of the City's Application and Five -Year Permanent Local Housing Allocation
(PLHA) Plan. The PLHA Program was established pursuant to Senate Bill (SB) 2 and provides
a permanent, on -going source of funding to local governments for housing -related projects
and programs that assist in addressing the unmet housing needs of their local communities.
Estimated funding allocations for Newport Beach over the next five years total $1,017,678, with
the funding allocation for 2019 and 2020 at $433,244. As a requirement of the application, the
City must prepare a Five -Year Plan detailing the activities that will be funded and how it will
prioritize investments that increase the supply of housing for households with incomes at or
below 60 percent of the area median income (AMI). The City is proposing to use all funding
from the State's PLHA Program toward the emergency shelter and related wrap -around services
assisting persons who are experiencing homelessness or at risk of homelessness.
The Five -Year PLHA plan is incorporated in the City's PLHA Grant Funding Application.
