I. CALL TO ORDER – The meeting was called to order at 10:00 a.m. Staff Present (Remote): Matthew Schneider, Zoning Administrator David Lee, Associate Planner Afshin Atapour, Planning Technician II. REQUEST FOR CONTINUANCES None. III. APPROVAL OF MINUTES ITEM NO. 1 MINUTES OF JULY 15, 2021 Action: Approved as amended. IV. PUBLIC HEARING ITEMS ITEM NO. 2 1572 East Ocean Front L.L.C. Residence Coastal Development Permit No. CD2021-016 (PA2021-084) Site Location: 1572 East Ocean Front Council District 1 David Lee, Associate Planner, provided a brief project description stating that a coastal development permit is requested for the demolition of an existing single-unit residence and the construction of a new 3,761-square-foot single-unit residence with an attached 709-square-foot attached 3-car garage. Mr. Lee stated the zoning of the property and stated that the project complies with all development standards, including setbacks, floor area, open space, and parking. Mr. Lee stated that a coastal hazards report was provided, which states that the project is safe from coastal hazards for the next 75 years. Finally, Mr. Lee stated that there is no impact to public access or public views. Applicant Bill Guidero, on behalf of the Owner, stated that he had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. One member of the public, Jim Mosher, spoke and commented that the legal description provided in the Draft Resolution should be more extensive. Additionally, Mr. Mosher commented about grammatical errors in Condition of Approval No. 4 of the Draft Resolution. Mr. Mosher asked a question regarding the height of the protective curb. The Zoning Administrator asked Mr. Lee to clarify the legal description and make any necessary changes to the final resolution. The Zoning Administrator requested that Mr. Lee revise the grammatical errors in Condition of Approval No. 4. Finally, Mr. Lee clarified that the curb height changes from the street side to the alley side. The Zoning Administrator closed the public hearing. Action: Approved as amended ITEM NO. 3 Rosen Residence Coastal Development Permit No. CD2021-021 (PA2021-110) Site Location: 3906 River Avenue Council District 1 MINUTES OF THE MEETING OF THE NEWPORT BEACH ZONING ADMINISTRATOR 07/29/2021 Page 2 of 2 Afshin Atapour, Planning Technician, provided a brief project description stating that this is for a Coastal Development Permit (CDP) and tentative parcel map to allow the demolition of an existing duplex and construction of a new 4,081-square-foot, three-story, two-unit condominium with two attached single-car garages totaling 464 square feet and two carport spaces. The project includes landscape, hardscape, drainage, and accessory structures all within the confines of the property. The project also includes a reinforced bulkhead with cap for coastal hazards protection. The project complies with all development standards and no deviations from the Zoning Code are requested. The Zoning Administrator opened the public hearing. Stephen Dolle, spoke and expressed concerns about generalized construction activity related to noise, construction times, areas, and other various concerns. Mr. Dolle also, expressed concerns related to how the City implements and regulates construction noise within the City which represents the health and safety impact to the local residents. Jim Mosher, spoke and asked for clarification regarding California Coastal Commission’s permit jurisdiction boundary bisection of the property and the permitting process between the City and California Coastal Commission. Mr. Mosher referenced minor edits that needed to be made in the resolution’s conditions. Mr. Atapour confirmed that the Applicant was aware of the property being bisected by the California Coastal Commission’s permit jurisdiction boundary and explained the permitting process by both the City and California Coastal Commission. The Zoning Administrator clarified and Mr. Atapour confirmed that only what is within the City’s permit jurisdiction is being approved. The Zoning Administrator requested that staff incorporate a condition related to California Coastal Commission’s permit jurisdiction boundary into the resolution, as well as minor edits to be incorporated into the resolution. In response to Mr. Dolle’s comments, the Zoning Administrator clarified the City of Newport Beach Municipal made Code updates related to construction noise in 2019. The Zoning Administrator requested that staff incorporate a condition in the resolution related to construction noise to alert construction staff of the noise regulations. The Zoning Administrator closed the public hearing. The Applicant William Guidero, Architect, stated that he had reviewed the draft resolution and agrees with all the required conditions. Action: Approved as amended V. PUBLIC COMMENTS ON NON-AGENDA ITEMS None. VI.
